The purpose of this letter is to request an impact neutral permit modification for the Wendell Falls
development located in Wake County, North Carolina. As detailed below, the applicant proposes to
eliminate two road crossings in order to re- habilitate a failing dam and expand an irrigation source.
The dam embankment and riser structure on a pond located within the development needs to be
brought up to current safe standards. The existing conditions include a six inch PVC outlet (which is
undersized) and sheet flow across the top of the dam (which results from the undersized outlet).
Additionally, the dam is steeper than current safety standards and there are stumps within the
embankment. The structure needs to be rehabilitated.
The applicant has identified that 15 acres within the development will need to be irrigated. Their
preference is to expand the existing pond for the irrigation water instead of using potable water
from a municipal system. The thinking is that a pond will maintain recharge. The applicant has
projected a 1.o to 1.5 acre inch application per week in drought conditions. The applicant has
calculated that 3 acre feet of water will be necessary for 3 weeks of irrigation. In gallons, 15 acres will
require approximately 407,000 gallons of irrigation water. Each acre foot of pond totals
approximately 326,000 gallons. The irrigation demand is projected to drop the water surface
elevation by 4 or more feet during periods of high demand.
Using potable water for irrigation water is irresponsible and expensive. Therefore it was considered
to be a non - viable alternative. Similarly, using multiple wells to generate irrigation waters was
determined to be non - viable.
The following narrative presumes that the submitted design is approved under the Dam Safety
Program. Their review is independent and it is possible that the actual impacts will be slightly more
or less than what is presented here. The applicant proposes to finalize the actual impact amounts
and mitigation based on the approved drawings. Be aware that the proposed drawings were
generated using a "worst- case" set of scenarios and that it is most likely that the actual impacts will
be less than requested. Under this rationale, we propose that we submit the final approved
drawings within 14 days of their receipt. And, at that time, we will finalize the mitigation
requirements.

Stream Impacts
The modifications to the dam and pond will result in permanent impacts to 135 linear feet of
moderate quality stream downstream of the embankment. This length will be impacted by
temporary construction areas, embankment fill and the proposed plunge pool. It is very possible
that a small channel can be re- established after construction has been completed.
Additional minor flooding will occur - upstream of the pond. The end of jurisdiction of this
intermittent stream was established approximately 125 feet upstream of the normal pool of the
pond. Approximately 45 linear feet of this reach will be flooded. A stream assessment found the
channel to be of low to moderate quality; score 32.
Stream Mitigation
The applicant proposes to abandon crossing Ri and re- distribute the mitigation to off set impacts for
the dam embankment. The approved road crossing impacted 133 linear feet of stream. The crossing
can be abandoned because the lot yield is not sufficient for the small area of high ground that would
be accessed.
Wetland Impacts
The, majority of the wetland impacts are temporary in nature and result from the need to have safe
working areas; temporary impacts total 0.o6 acres. The embankment will impact 0.03 acres and the
plunge pool will impact 0.03 acres. It is important to note that the plunge pool will have standing
water within it after construction. All temporary impact areas will be seeded with a wetland seed
mix and will be staked with willow.
Wetland Mitigation
The,applicant proposes to abandon crossing R7 and re- distribute the mitigation to off set impacts for
the dam embankment. The approved road crossing impacted o.11 acres of wetlands. The crossing
can be abandoned because the lot yield is not sufficient for the small area of high ground that would
be accessed.
