Guy and Niki,
Restoration Systems sold Greensboro 333 buffer mitigation credits for the Alamance Road Project in March of 2020 for
an impact to 333 square feet of buffer that required 999 buffer mitigation credits. NCDWR has audited our ledgers,
identified the error, and requested we reach out to you explaining the situation. Attached is the original mitigation
credit transfer certificate, and corrected mitigation credit transfer certificate as well as an updated ledger for our bank
both referencing that this credit sale was for partial fulfillment of the mitigation need.

Barrett,
The information Ryan reiterated/confirmed here indicates that 999 Zone 1 buffer credits were required to fulfill the
project's needs. Because the ledger and MCTC only indicated 333 credits, both documents need to more fully indicate
that what was provided by RS only PARTIALLY fulfilled the requirement. I'm afraid the fact that the partial fulfillment
happened to be 1/3 of what was needed and the mitigation ratio factor was 1:3 may have further confused things.
• Please add "PARTIAL" to the project name in the ledger: "(DWR #2020-0237)- PARTIAL".
• As a reminder, for partial fulfillment of the required credits, the MCTC also must acknowledge that credits sold
only satisfy a portion of the permit requirement and that the remaining credits need to be purchased by another
mitigation bank/ provider. The MCTC must be corrected and reissued to the applicant, with DWR copied on that
correspondence.
Once the requested action items are completed and documentation addressing the items above has been received,
DWR can proceed with finalizing the credit sale audit.

In review of the project folder, please find reference to the approval letter issued for this project on 3-11-2020. 333 feet
of Buffer Zone 1 impact was proposed, at a 3:1 ratio is 999 feet of mitigation as listed on page 2.

Niki Maher at NCDWR audits Restoration Systems buffer credit transactions and flagged this transaction asking for
clarification on the amount of riparian buffer restoration credits required. Tiffani no longer works at Restoration
Systems and I think Niki is trying for figure out if you all are requiring 333 buffer restoration credits or more as you list
under specific conditions that you need mitigation for impacts to 333 square feet and usually the mitigation is some
multiple of the impact.

DWR # and indication of partial fulfillment with the project information in the entry.
Regarding the Alamance Church Road widening project... April Norton is now with the Corps of Engineers. If you
didn't get an auto response or forwarding information in return from your email, it might be best to contact
Kristi Lynn Carpenter (copied in Tiffani's email) for help in determining which project manager might be able to
provide verification of the information for the project.

Thank you for supplying the materials needed to perform the credit sale audit of the Nutrient Offset & Buffer
Mitigation Banks for Restoration Systems, LLC. The results of the Bass Mountain audit are detailed below:
Nitrogen Ledger: no transactions in 2020
Phosphorus Ledger: no transactions in 2020
Buffer Ledger:
a. Alamance Church Road Widening (3/18/20)- It is unclear if the 333 buffer credits sold were a partial
or full fulfillment of credits for the project. Please reach out to the permitting authority and get
clarification of the mitigation requirement for our audit review. If partial, "(DWR #2020-0237)-
PARTIAL" needs to be added to the project name in the ledger.
3M Pittsboro Mine (11/19/20)- add "(DWR #200-0659v2)- PARTIAL" to project name in ledger as
credits provided do not meet the full 695,376 sf requirement.
Once all the action items are completed, and written notification with all supporting documentation addressing
the items above has been received, DWR can proceed with finalizing the credit sale audit.
