RESPONSE TO USACE LETTER DATED May 14, 2014.
Mr. Lastinger:
On behalf of the owners, Standard Pacific of the Carolinas, LLC (StanPac), we hereby provide the
following responses to the USACE letter dated May 14, 2014 and associated letter from the Neuse
Riverkeeper Foundation dated April 24, 2014.
Responses to the USACE May 14, 2014 Letter:
1. It is necessary for you to have taken all appropriate and practical steps to reduce waters
and wetland losses. Please provide information on the justification for the proposed fills,
showing that you have done all you can especially regarding modification of plans to
reduce adverse impacts. Please provide information on avoidance and minimization,
primarily through the relocation or spanning of the proposed Padstone Drive and
relocation of Bodwin Lane, which would avoid and minimize potential impacts to 137
linear feet of stream channel and 0.0318 acres of jurisdictional wetlands.
Impact #1 - Sheet 1 / Intermittent Stream Impact = 137 If (0.009 ac) of intermittent stream is
proposed to be impacted to construct Padstone Drive extension. This is required to access
properties along the eastern property boundary, to construct the proposed Wragby Lane and
associated lots and stormwater BMP. This road will also provide a connection to the adjacent
(but separate, as confirmed by the USACE) James Street Station development to the east.

The stream runs through the property and as such crossing it is the only way to gain access to
the available upland areas to the east. The impacts have been minimized as much as practicably
by designing the crossing with steep shoulders and using headwall structures. It is cost
prohibitive to use a span structure in this location. Also, the use of a span would require the
decking or top of bottomless culver to be low and would not provide adequate height to maintain
a stable stream channel and would at the very least require the stream to be riprapped. For these
reasons as well as long term maintenance, the applicant has proposed the use of a pipe which is
a standard construction practice for a stream of this size and nature.
Impact #13 — Jurisdictional Wetland Impact = 0.0318 acres of jurisdictional wetland proposed to
be impacted to construct Bodwin Lane. Bodwin Lane is a single - loaded street (lots only on one
side) providing safe driveway access to seven (7) single family residential lots. Again, these lots
could not be constructed without this street because driveway access to Apex Peakway is not
permissible by the Town given that it is a major thoroughfare loop road to connect other major
routes. The project has been designed to stop the impacts short of the protected riparian buffer
and thereby allow for protection of the stream to the west. Re- aligning the street to the east to
avoid the impact would result in the inadequate lot depths and thereby the loss of the seven lots.
2. Please provide a final and complete compensatory mitigation plan to offset impacts to
aquatic features from the proposed project. This includes but is not limited to: justification
as to the specific type of mitigation to be used (i.e. mitigation bank, in -lieu fee, on -site, or
off -site mitigation), financial assurances, easement holders, restoration plans, monitoring
plans, etc. Please be reminded that no Department of the Army (DA) permit can be
authorized without the submittal, review and approval of a final compensatory mitigation
plan.
Mitigation:
The owner has already made the mitigation payments to the N.C. Ecosystem Enhancement
Program (EEP) for the required 474 feet of stream mitigation per the 2012 Individual Permit, 417
feet of stream mitigation per the previous 2010 Nationwide Permit(s), and 0.75 acres of riparian
wetlands mitigation (rounded up to' /4 acre, required mitigation was only 0.586 acres) per the
2010 Nationwide Permit (invoices & receipts attached). Mitigation payments to date totaled
$360,613.50.
The new impacts to 0.0565 acres of wetlands in addition to the previously approved impacts would still not
exceed the 1 -acre DWR mitigation threshold and as such no mitigation should be required by DWR for these
additional impacts. The USACE would require mitigation for this additional impact, however StanPac
already paid for an equivalent amount of 0.75 acres of riparian wetland mitigation credits given the EEP' /4
acre rounding requirement, and as such the mitigation for these additional impacts has already been
satisfied.
StanPac has already purchased 891 feet of stream mitigation credits for 486 feet of stream impacts,
resulting in a delta of 405 feet. The newly proposed 137 feet of intermittent stream impact would fall within
this delta and as such the DWR requirement of 1:1 mitigation ratio has been satisfied. The USACE has
determined that mitigation will not be required for this impact to this intermittent stream lacking significant
aquatic function.

No fill to will occur in the FEMA mapped floodplains. The closest FEMA mapped flooplain
is almost a mile downstream on the other side of 540 near the 540/US -1 intersection. See
attached exhibit showing Salem Village in relation to the floodplain.
4. Address any concerns and comments raised from the public and other state and federal
agencies during the public notice period Specifically pertaining to a stormwater plans.
These letters will be attached as exhibits to this letter.
See responses below to the recommendations made in the Neuse Riverkeeper
Responses to the April 24, 2104 Letter:
1. Sedimentation and Erosion Control measures designed to exceed basic stormwater
management must be designed, constructed, and maintained properly for the entire site,
including f lture construction;
The development is held to fill compliance with sediment and erosion control measures
which is further required as per conditions 5, 6 & 7 of the attached 401 Certification
issued for these impacts on May 5, 2014.
2. Alternatives to the proposed stream and wetland impacts by Standard Pacific of the
Carolinas, LL(' must be considered to determine a best course of action to have as little
additional impacts on streams and wetlands as possible.
Please see responses above to any minimization and avoidance concerns. The developer
has made every effort to minimize and avoid these impacts. The need for housing in the area
is very strong and having to request this modification has caused significant delays which
they certainly would have avoided if at all possible.
Please let us know if you require any additional information to modify your existing permits.

Dear Mr. Methven:
Reference your application for Department of the Army (DA) authorization to permanently
impact 137 linear feet of unnamed tributary to Big Branch, and 0.138 acres of jurisdictional
wetlands associated with phases 2, 2c, and 3 of the Salem Village subdivision. The project, is
bordered to the north and west by South Salem Street, and to the east by Tingen Road, in the
town of Apex, Wake County North Carolina. Coordinates (in decimal degrees) for the site are
36.71360 North, - 78.8647 West. The site is located in the Cape Fear River Basin (8 -Digit
Cataloging Unit 03030004).
On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a
memorandum of agreement (MOA) establishing procedures to determine the type and level of
mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This
MOA provides for first, avoiding impacts to waters and wetlands through the selection of the
least damaging, practical alternative; second, taking appropriate and practical steps to reduce
impacts on waters and wetlands; and finally, compensating for any remaining unavoidable
impacts to the extent appropriate and practical. To enable us to process your application in full
compliance with this MOA, we request that you provide the following additional information:

Comments on Salem Village 404 Permit
The Salem Village subdivision development has had a number of large impacts on the quality and functionality
of Big Brach and its tributaries. The majority of negative impacts on the water quality and functionality to Big
Branch and tributaries are a result of construction activities (individual lots and road construction), failing Best
Management Practices (BMPs), and a failure to control stormwater runoff on site.
My concern is that additional wetland and steam impacts along with the impacts and water pollution currently
taking place on site will lead to a much larger degradation of water quality and over all functionality of Big
Brach and in turn will lead to poor water quality downstream to White Oak Creek and Harris Lake. With the
growing population of the Middle Cape Fear River Basin, stream functionality and downstream impacts must be
taken into consideration when asking for additional onsite stream and wetland impacts.
I recommend that you place the following conditions on Salem Village Section 404 permit.
Sedimentation and Erosion Control measures designed to exceed basic stormwater management must be
designed, constructed, and maintained properly for the entire site, including future construction;
2. Alternatives to the proposed stream and wetland impacts by Standard Pacific of the Carolinas, LLC must

2. Stormwater Management Plan
You are required to provide one copy of the approved SMP for each phase of the project,
including plan details on full -sized plan sheets, with proof of Town of Apex's approval. The
approved SMP shall be submitted to the DWR 401 & Buffer Permitting Unit (1650 Mail Service
Center, Raleigh, NC 27699 -1650) before any impacts authorized in this certification occur.
Submittal of the plans and approval documents may be provided electronically to
bev.strickland@ncdenr.gov in lieu of providing paper copies. After it is approved and
submitted to the Division, the SMP may not be modified without prior written authorization
from the Town of Apex. If the SMP is modified in the future, then you shall provide one
modified SMP with proof of approval to the DWR 401 & Buffer Permitting Unit prior to the
commencement of the modifications.
3. Compensatory Mitigation Using the Ecosystem Enhancement Program (EEP)
Mitigation must be provided for the previously approved and proposed impacts as specified in
the table below. For accounting purposes, this Authorization Certificate authorizes payment to
the EEP to meet the following compensatory mitigation requirement:

4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre - Construction Notification for this
project. All construction activities, including the design, installation, operation, and
maintenance of sediment and erosion control Best Management Practices shall be performed
so that no violations of state water quality standards, statutes, or rules occur. Approved plans
and specifications for this project are incorporated by reference and are enforceable parts of
this permit.
5. Sediment and Erosion Control
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices and if applicable, comply with the specific conditions and requirements
of the NPDES Construction Stormwater Permit issued to the site:
a. Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal or exceed the requirements specified in the
most recent version of the North Carolina Sediment and Erosion Control Manual. The
devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil)
projects, including contractor -owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
c. Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act and the
Mining Act of 1971.
d. Sufficient materials required for stabilization and /or repair of erosion control measures
and stormwater routing and treatment shall be on site at all times.
6. Sediment and erosion control measures shall not be placed in wetlands or waters. Exceptions
to this condition require application submittal to and written approval by the Division. If
placement of sediment and erosion control devices in wetlands and waters is unavoidable,
then design and placement of temporary erosion control measures shall not be conducted in a
manner that may result in dis- equilibrium of wetlands, stream beds, or banks, adjacent to or
upstream and downstream of the above structures. All sediment and erosion control devices
shall be removed and the natural grade restored within two (2) months of the date that the
Division of Energy, Mineral and Land Resources (DEMLR) or locally delegated program has
released the specific area within the project.

7. Construction Stormwater Permit NCG010000
An NPDES Construction Stormwater Permit is required for construction projects that disturb
one (1) or more acres of land. This Permit allows stormwaterto be discharged during land
disturbing construction activities as stipulated in the conditions of the permit. If your project is
covered by this permit, full compliance with permit conditions including the erosion &
sedimentation control plan, inspections and maintenance, self- monitoring, record keeping and
reporting requirements is required. A copy of the general permit (NCG010000), inspection log

8. 8. Work in the Dry
All work in or adjacent to stream waters shall be conducted so that the flowing stream does
not come in contact with the disturbed area. Approved best management practices from the
most current version of the NC Sediment and Erosion Control Manual, or the NC DOT
Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams,
and other diversion structures shall be used to minimize excavation in flowing water.
9. If concrete is used during the construction, then all necessary measures shall be taken to prevent
direct contact between uncured or curing concrete and waters of the state. Water that
inadvertently contacts uncured concrete shall not be discharged to waters of the state due to
the potential for elevated pH and possible aquatic life /fish kills.
10. Placement of Culverts and Other Structures in Waters and Wetlands
Culverts required for this project shall be installed in such a manner that the original stream
profiles are not altered and to allow for aquatic life movement during low flows. Existing
stream dimensions (including the cross section dimensions, pattern and longitudinal profile)
must be maintained above and below locations of each culvert.
Placement of culverts and other structures in waters, streams must be below the elevation of
the streambed by one (1) foot for all culverts with a diameter greater than 48 inches, and 20
percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low
flow passage of water and aquatic life.
Installation of culverts in wetlands must ensure continuity of water movement and be
designed to adequately accommodate high water or flood conditions. Additionally, when
roadways, causeways, or other fill projects are constructed across FEMA- designated floodways
or wetlands, openings such as culverts or bridges must be provided to maintain the natural
hydrology of the system as well as prevent constriction of the floodway that may result in
destabilization of streams or wetlands.

The establishment of native, woody vegetation and other soft stream bank stabilization
techniques must be used where practicable instead of rip rap or other bank hardening
methods.
11. All temporary fill and culverts shall be removed and the impacted area returned to natural
conditions, within 60 days of the determination that the temporary impact is no longer
necessary. The impacted areas shall be restored to original grade, including each stream's
original cross sectional dimensions, plan form pattern, and longitudinal bed and bed profile, and
the various sites shall be stabilized with natural woody vegetation (except approved
maintenance areas) and restored to prevent erosion.
12. All temporary pipes /culverts /riprap pads etc, shall be installed in all streams as outlined in the
most recent edition of the North Carolina Sediment and Erosion Control Planning and Design
Manual so as not to restrict stream flow or cause dis- equilibrium.
13. Any riprap required for proper culvert placement, stream stabilization, or restoration of
temporarily disturbed areas shall be restricted to the area directly impacted by the approved
construction activity. All riprap shall be buried and /or "keyed in" such that the original stream
elevation and streambank contours are restored and maintained. Placement of riprap or other
approved materials shall not result in de- stabilization of the stream bed or banks upstream or
downstream of the area.
14. Any riprap used for stream stabilization shall be of a size and density so as not to be able to be
carried off by wave, current action, or stream flows and consist of clean rock or masonry
material free of debris or toxic pollutants. Riprap shall not be installed in the streambed except
in specific areas required for velocity control and to ensure integrity of bank stabilization
measures.
15. A one -time application of fertilizer to re- establish vegetation is allowed in disturbed areas
including riparian buffers, but is restricted to no closer than 10 feet from top of bank of streams.
Any fertilizer application must comply with all other Federal, State and Local regulations.

16. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands,
waters and protective buffers within the project boundaries in order to assure compliance for
future wetland, water and buffer impact. These mechanisms shall be put in place at the time of
recording of the property, or of individual lots, whichever is appropriate. A sample deed
notification can be downloaded from the 401 &Buffer Permitting Unit website at
httpl /portal.ncdenr.org/ web /wq /swp /ws /401 /certsandpermits a I forms. The text of the
sample deed notification may be modified as appropriate to suit to this project. Documentation
of deed notifications shall be provided to the Division upon request.
17. This Certification does not relieve the applicant of the responsibility to obtain all other required
Federal, State, or Local approvals.
18. Continuing Compliance
Grey Methven and Standard Pacific of the Carolinas, LLC shall conduct construction activities in
a manner consistent with State water quality standards (including any requirements resulting
from compliance with section 303(d) of the Clean Water Act) and any other appropriate
requirements of State and Federal law. If the Division determines that such standards or laws
are not being met (including the failure to sustain a designated or achieved use) or that State
or federal law is being violated, or that further conditions are necessary to assure compliance,
the Division may reevaluate and modify this Certification. Before modifying the Certification,
the Division shall notify Grey Methven and Standard Pacific of the Carolinas, LLC and the U.S.
Army Corps of Engineers, provide public notice in accordance with 15A NCAC 02H .0503 and
provide opportunity for public hearing in accordance with 15A NCAC 02H .0504. Any new or
revised conditions shall be provided to Grey Methven and Standard Pacific of the Carolinas,
LLC in writing, shall be provided to the U.S. Army Corps of Engineers for reference in any
Permit issued pursuant to Section 404 of the Clean Water Act, and shall also become
conditions of the 404 Permit for the project.
19. This approval is for the purpose and design described in your application and as described in the
Public Notice. The plans and specifications for this project are incorporated by reference and are
an enforceable part of the Certification. If you change your project, you must notify the Division
and you may be required to submit a new application package with the appropriate fee. If the
property is sold, the new owner must be given a copy of this Certification and is responsible for
complying with all conditions. Any new owner must notify the Division and request the
Certification be issued in their name.
20. The applicant and /or authorized agent shall provide a completed Certificate of Completion Form
to the DWR 401 & Buffer Permitting Unit within ten days of project completion (available at:
http: //portal.ncdenr.org web/wg /swp /ws/401 certsandpermits a I forms).

21. This certification grants permission to the director, an authorized representative of the Director,
or DENR staff, upon the presentation of proper credentials, to enter the property during normal
business hours.
This approval to proceed with your proposed impacts or to conduct impacts to waters as depicted
in your application shall expire upon expiration of the 404 or CAMA Permit. The conditions in
effect on the date of issuance shall remain in effect for the life of the project, regardless of the
expiration date of this Certification.
Non - compliance with or violation of the conditions herein set forth may result in revocation of this
Certification and may also result in criminal and /or civil penalties.
