Additional modeling was performed as agreed in the meeting held. on Wednesday July 31 attended by Franklin County, LKC Engineering and NPDES staff. An alternative modeling approach was used in which the limits for oxygen consuming wastes were lowered and the effluent dissolved oxygen was increased. The model predicted DO above 5 mg/1 for a flow of 4.5 MGD with BOD limit of 5 mg/1, ammonia limit of 0.5 mg/I and effluent DO limit of 6 mg/l. For a discharge of 3.0 MGD the model predicted DO above 5 mg/1 with a BOD limit of 4 mg/1, ammonia limit of 0.5 mg/1 and effluent DO limit of 8 mg/1. Table 1 presents a summary of the speculative limits. At this time the Division is working on developing a methodology to determine the individual allocations for permittees. Relocation of the existing 3.0 MGD discharge to the Tar River will not require a State Environmental Review Act (SEPA) review or Engineering Alternative Analysis (EAA), however, expansion of the treatment system above 3.5 MGD will meet the criteria for SEPA and EAA. Engineering Alternatives Analysis (EAA). Please note that the Division cannot guarantee that an NPDES permit for an expanded discharge will be issued with these speculative limits. Final decisions can only be made after the Division receives and evaluates a formal permit application for the expanded discharge. In accordance with the North Carolina General Statutes, the practicable wastewater treatment and disposal alternative with the least adverse impact on the environment is required to be implemented. Therefore, as a component of all NPDES permit applications for new or expanding flow, a detailed engineering alternatives analysis (EAA) must be prepared. The EAA must justify requested flows and provide an analysis of potential wastewater treatment alternatives. A copy of Division guidance for preparing EAA documents is attached. State Environmental Policy Act (SEPA) EA/EIS Requirements. A SEPA EA/EIS document must be prepared for all projects that 1) need a permit; 2) use public money or affect public lands; and 3) might have a potential to significantly impact the environment. For existing discharges, significant impact is defined as an expansion of > 500,000 gpd additional flow. The NPDES Unit will not accept an NPDES permit application for an expanded discharge until the Division has approved the SEPA document and sent a Finding of No Significant Franklin County Utilities August 16, 2013 Page 3 of 3 Impact (FONSI) to the State Clearinghouse for review and comment. A SEPA Environmental Assessment (EA) should contain a clear justification for the proposed project. If the SEPA EA demonstrates that the project may result in a significant adverse effect on the quality of the environment, you must then prepare a SEPA EIS (Environmental Impact Statement). The EAA requirements discussed above will need to be folded into the SEPA document. The SEPA process will be delayed if all EAA requirements are not adequately addressed. Completed in September 1988, the 7Q10 discharge was estimated at approximately 7 cfs, based on transfer of flow characteristics from two nearby continuous -record streamgages located on the Tar River. No USGS discharge records are known to exist for your point of interest. A basin delineation for your point of interest completed using the online NC StreamStats application (http://water.usgs.gov/osw/streamstats/north carolina.html) indicates the drainage area is 366 sqmi. Where no or insufficient data is available for a low -flow analysis, a determination of low -flow characteristics is based on assessment of low -flow yields at nearby location(s) where such statistics have previously been determined. Previously published low -flow information for streams in your area of interest... For streams in Franklin County, the most recently published low -flow information is a statewide report completed in the early 1990's. It is USGS Water -Supply Paper 2403, 'Low -flow characteristics of streams in North Carolina" (Giese and Mason, 1993). An online version of the report is available through http://pubs.uscis.gov/wsp/2403/report.pdf.i The report provides the low -flow characteristics (based on data through 1988) via regional relations and at -site values for sites with drainage basins between 1 and 400 sqmi and not considered or known to be affected by regulation and/or diversions. Franklin County is considering relocating the existing wastewater discharge from Cedar Creek to the Tar River at SR 1003 and expanding the discharge to 4.5 MGD. Speculative limits were requested for flows of 3.0 MGD and 4.5 MGD. The Division evaluates new discharges using a Level B model intended to assess protection of the water quality standard for dissolved oxygen.- The model used by the Division predicts instream dissolved oxygen below the water quality standard of 5 mg/I under both flow scenarios. Based on the results of the model the Division can't provide speculative limits at the proposed location. Other water quality concerns that could influence a relocation request are the presence of endangered or protected species and stream impairments. The model results and water quality issues are discussed below. Receiving Stream. The Tar River has a stream classification of WS-V, NSW. At the proposed discharge location the Tar River has a summer 7Q10 flow of 4.4 cfs, a winter 7Q10 flow of 20.1 cfs, and an annual average flow of 360 cfs. This segment of the Tar River from a point 0.6 miles upstream of Taylor Creek to a point 0.3 miles downstream of Coole Creek is impaired for turbidity. A TMDL has not been developed to address the impairment. Generally turbidity impairments are associated with non -point sources or contribution or process wastewaters contributions. An additional water quality concern in this section of the Tar River is the presence of threatened or endangered species. The Natural Heritage Program data base lists five federal species of concern in this segment of the Tar River. These are the Roanoke Bass, Yellow Lance, Atlantic Pigtoe, Yellow Lampmussel, Neuse River Waterdog and the Carolina 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 Location: 512 N. Any proposed discharge to this area will require the input and recommendation from the US Fish and Wildlife Service. Water Quality Model. The model results show that the dissolved oxygen standard is not protected when the proposed discharge flows are modeled. The length of the segment modeled was 23.3 miles and includes the discharge from Louisburg WWTP located 8.6 miles downstream of the proposed location. The dissolved oxygen sag occurs downstream of the Louisburg discharge with the lowest predicted DO around 4.7 mg/I. The limitations of this model indude the assumption of standard background conditions and the absence of a calibration step. The Division maintains several ambient monitoring stations in the Tar River where dissolved oxygen data is collected among other parameters. The station on the downstream side of the two modeled discharges consistently shows dissolved oxygen below 5 mg/1 during summer months. The model assumption of dissolved oxygen levels above the water quality standard is not supported by existing data. The Division understands the importance of planning for future growth and expansions. If the County wants to pursue a discharge at this location or explore other option in the Tar River the Division would recommend a more detailed modeling effort using an alternative modeling tool. At this point the NPDES Complex Permitting Unit only has the capability to run Level B models as the one used for this analysis. A calibrated model incorporating existing data may offer a better picture of the allowable capacity in the river. They are planning to expand the facility to 4.5 MGD to accommodate wastewater from Novozymes and relocate to the Tar River. The site does not have continuous record for flow. Station 02081500, drainage area 167 mi2, and station 02081747, drainage area 427 miZ, were used as the index sites. As a result of recent droughts the estimates for the Tar River are 41% lower than flow statistics published in the 1990's. Station 01025000 at SR 1003: This station is at the proposed discharge location. DO data for the past five years show DO levels above 5 mg/I except on one occasion in 2008 with a result of 3.5 mg/I. Summer DO averages 7.1 mg/I and winter DO averages 11.1 mg/I. Ammonia averaged 0.08 mg/I for the summer and 0.07 mg/I for the winter. Station 01100000 at US 401 in Louisburg: This station is upstream of the Louisburg WWTP discharge. DO averaged 7.06 mg/I for the summer and 10.6 mg/I for the winter with no samples less than 5 mg/I. Ammonia is not sampled at this station. Station 02000000 at SR 1001 near Bunn: This station is downstream of Cedar Creek. Summer DO averages 6.08 mg/I with many instances below 5 mg/I. Ammonia averages 0.08 mg/I for summer and 0.1 mg/I for winter. Endangered Species: There are five federal species of concern in this segment of the Tar River according to the NC Natural Heritage Program database. Wastewater discharges: The Town of Louisburg discharges 1.37 MGD (NC0020321) to the Tar River 8.66 miles downstream of the proposed discharge location. Louisburg's permit limits for CBOD are 8 mg/I summer and 16 mg/I winter and for ammonia 3 mg/I summer and 6 mg/I for winter. The CBOD limit of 8 mg/I is equivalent to BOD of 9.6 mg/I.
