SUBJECT: NOTICE OF VIOLATION
Failure To Control Cooling Water Discharge From A Local Industry
TOWN OF BISCOE WWTP
NPDES Permit No. NC 0021504
Montgomery County
Dear Mr. Blake:
On Friday, November 2, 2001, near the end of a routine Biomonitoring Inspection, solids were observed by Dale
Lopez, DWQ-FRO,being lost over the weirs of the clarifier to the chlorine contact chamber and over the WWTP effluent
001weir, which discharges into Hickory Branch, then to White Oak Creek and to Cedar'ICreek, a tributary of Little River.
The sludge blanket of the clarifier was measured as the full depth of the clarifier (greater than 7 'V2 feet). "The sludge blanket
of the chlorine contact chamber was measured as two feet of the total chamber depth of four feet. Please note that earlier in
the same week,. the sludge blanket of the clarifier was three feet, and the sludge depth ofl the chlorine contact chamber was
two inches. This event was attributed to a local industry dumping a large volume of cooling water into the municipal
collection system. Based. on previous conversations with Town staff, it is not the first time that a local industry has
discharged large quantities of cooling water into the collection system. This is considered a serious matter, and the Town
should have already addressed the issue. Based- on this occurence, the Town is considered to be in violation of Part III A. 2.
and Part III A. 2. d. of Biscoe's WWTP NPDES permit, which are under the Requirements for Control of Pollutants
Attributable to Industrial Users. The permit states in part that "Under no circumstances shall the permittee allow
introduction of the following wastes in the waste treatment system:" ... " Wastewaters at a flow rate ... which will cause an
inhibition or disruption of the POTW, its treatment processes, operation, or sludge use and disposal".
Please be advised that the local industry may qualify for a cooling water discharge permit. This may be a solution
or alternative to the acceptance of large quantities of cooling water into the POTW collection and treatment system.
Please provide to this office the actions that the Town has taken and actions thaflthe Town will take to correct this
matter on or before December 15, 2001. If you have any questions or comments concerning this matter, please do hot
