April, Once again, I appreciate you taking the time out of your day for our meeting earlier and all your help! In regards to your Request for more information email below: 1.) As mentioned in the meeting, the PCN application requires the average stream width to be rounded to the nearest single digit. In this instance for Impact 1 (road crossing) 653 SF/140 LF of permanent stream impact, the average stream crossing width is 4.6 ft. 4.6 ft x 140 LF = 644 SF. Impact 2 (road crossing) 207 SF/57 LF of permanent stream impact, the average stream crossing width is 3.6 ft. 3.6 ft x 57 LF = 205.2 SF. With the survey data we have as well as the calculations (not rounded) for the square footage of impacts we have are 644 SF + 205.2 SF = 849.2 SF/43,560 = 0.019 acres. 2.) Already received concurrence from USFWS. Please let me know if you need anything else. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29 (https://saw-reg.usace.army.mil/NWP2021/NWP29.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Cumulative permanent stream impacts for this project appear to exceed the 0.02-acre threshold per NWP 29 Regional Condition 3.2, and therefore compensatory mitigation would be required. My calculation indicates that 0.0213 acre of streambed would be loss because of the proposed impacts. Please verify if this is correct. Should the proposed impacts exceed the 0.02-acre threshold, please submit a compensatory mitigation plan. The mitigation rule generally prescribes purchasing stream credits first through a mitigation bank with stream credits available in this 8-digit HUC, or second through the NC Division of Mitigation Services; please provide a mitigation acceptance letter from your proposed compensatory mitigation provider. Typically, compensatory mitigation is required at a 2:1 credit to impact ratio unless otherwise justified based on evaluation of aquatic function. 2) Given the proximity of this project to known populations of several threatened/endangered mussel species, as well as potentially suitable habitat for these species occurring the project action area, we will initiate informal consultation with the US Fish and Wildlife Service (USFWS).
