Dear Mr. Wilson:
In accordance with the application for discharge permit, the Division is forwarding
herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated May 9, 1994.
The Division received your comments dated November 17, submitted on behalf of the
county, regarding the increased nutrient sampling requirement. The Division has modified the
weekly testing requirement for total nitrogen and total phosphorus. The increased monitoring
shall not commence until July 2001 to allow the county time to budget the weekly frequency. This
monitoring is necessary due to the continued concerns of nutrient loading to the Tar Pamlico River
Basin. Should the county find consistent minimal results for total nitrogen or total phosphorus,
the Division may modify the requirement at the next permit renewal. The county may also wish to
discuss the weekly monitoring requirement during the next negotiated agreement between the
Division and the Tar Pamlico Association in 2004.
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the office of Administrative Hearings, Mail Service Center 6714, Raleigh, North Carolina
27699-6714. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or
any other federal or local governmental permit.

Warren County Wastewater Treatment Plant
Off US Highway 401
Southwest of Warrenton
Warren County
to receiving waters designated as Fishing Creek in the Tar -Pamlico River Basin
in accordance with the discharge limitations, monitoring requirements, and other conditions set forth in
Parts I, II, III. and IV hereof.
This permit shall become effective February 1, 2001.
This permit and the authorization to discharge shall expire at midnight on October 31, 2004.

Notes:
• Upstream at least 100 feet. Downstream at NCSR 1600. Stream samples shall be grab
samples and shall be collected 3/Week during June -September and 1/Week during the
remaining months of the year.
The monthly average effluent BOD5 and Total Suspended Solids concentrations shall not
exceed 15% of the respective influent value (85% removal).
2 The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
3 The daily average dissolved oxygen effluent concentration shall not be less than 5.0 mg/1.
4 See Special Condition A.(3.) regarding nutrients. Note that weekly monitoring for total
nitrogen and total phosphorus shall commence during the month of July 2001.
5 Chronic Toxicity (Ceriodaphnia) P/F at 76% March, June, September, and December; see
Supplement to Effluent Limitations and Monitoring Requirements, Special Condition A (2).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A (2). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 76%.
The permit holder shall perform at a minimum, auarterlti monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998. or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions. The tests will be performed during the months of
March, June, September, and December. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV
below the permit limit, then multiple -concentration testing shall be performed at a minimum, in
each of the two following months as described in "North Carolina Phase II Chronic Whole
Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment." collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed. using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete. accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required.
monitoring will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

A. (3.) NUTRIENT LIMITS SPECIAL CONDITION
Limits on total phosphorus and total nitrogen have not been included at this time because the
facility is participating in the nonpoint source trading option outlined in the Tar Pamlico NSW
Implementation Strategy Phase II, which was adopted December 8, 1994. If compliance with any
element of this strategy, or subsequent approved revisions to the strategy is not maintained, the
Division reserves the right to reopen this permit to include nutrient limits. If requirements other
than those listed in this NADES permit are adopted as part of a future revision to the strategy, the
Division reserves the right to reopen this permit to include these requirements.

You know, the Agreement is explicit that weekly monitoring is required, but
you can save up your samples and analyze monthly. But it also says we can
authorize less frequent monitoring where the discharger shows that it is
"adequate to characterize facility loadings". I recall seeing old
correspondence in the files that gave me the idea this was a hot issue in
the early days. Also, at one point I was looking at hard copies of DMR's
for something and found facilities routinely giving values for N and P only
twice a month, you know, where they report parameters each day on the
form. My suggestion would be to talk to Paul Blount first, then Ron Elks
if need be for a historical perspective. It may be that we acquiesced to
biweekly for all, or for the little guys only. Best I can tell you on
that.

this letter is in response to the recent draft NPDES permit received by my office
11-17-00 .
After careful review of the draft permit ,I must say I was pleased with the
divisions decision to eliminate the cadmium, lead, and MBAS from the proposed permit,
however I was not as pleased with the divisions decision to change my now monthly total
nitrogen, total phosphorus to the proposed weekly.
I understand the divisions concern to have more data on these parameters ,but its
my job to try to keep us within our set budget .Other than toxicity, TN is the most
expensive analysis that we have to run, and to go from a cost of $ 450/yr to $1872 /yr is a
little extreme to me . I am therefore submitting the request to have our TN monitoring
frequency reviewed again with the hope that the division will adjust the frequency to no
more than 2/month. As for the total phos. after a years review of the phos. data I found 1,
that we average on a regular yearly basis <1.0 mg/1 , I just don't see the justification for)
increasing phos. monitoring at all,we are already currently spending $ 172.00/yr and your
proposed changes would increase that $ 576 we don't have any high industrial flows that
would contribute large quantities of phos. to our incoming waste so again I urge you to
reconsider this change.
In closing I would like to add ,I appreciate any attention you would show to my
above mentioned concerns and hope that if you have any questions regarding this letter

I noticed a couple of major permits last week (I inherited these and
last week was the drop dead date to get them noticed/issued by the end
of the year). Anyway, my apologies for not being able to get these to
you prior to notice (got them on Monday and noticed on Wednesday, so I
didn't have a chance).
I've enclosed copies of the permits and fact sheets. Please pass to
appropriate staff and have them call or e-mail me if there are any
glaring errors. Thanks for your help. Tom, I didn't have any headworks
info. for these facilities so I'd like to get that and make any changes
as necessary.

SUMMARY
The Town of Warrenton operates a 2 MGD facility for Warren County. The discharge is Fishing
Creek, which is classified as C-NSW.
As part of the Tar Pamlico Basin Association, no nutrient limits have been added to this
renewal, but monitoring for TP and TN has been increased to weekly. Also, special condition
language relating to potential nutrient limits has been added to the permit.
This creek is not listed on the state's 303d list (but the Tar -Pamlico basin does have a nutrient
management strategy).
TOXICITY TESTING:
Current Requirement: Chronic P/F ® 76% (also recommended with renewal)
Warren County has experienced some failures in 1999, followed by passes.
COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS
A review of the Town's compliance printout indicates no monthly limit excursions in the
previous 2 years. The facility is averaging - 0.53 MGD effluent flow and is under BOD5 and
NH3-N limits.
TOXICANT PARAMETERS
A reasonable potential analysis (RPA) was conducted for toxicants currently monitored in the
permit [Cadmium, copper, lead, and MBAS).
Cyanide, lead, and MBASwi11 be eliminated with this permit cycle due to the lack of reasonable
potential to exceed the WQ standard. Cyanide values were reported below detect level, as was
MBAS (below DL or below the allowable level). Lead was below the allowable level.
Copper will be continued as a quarterly monitoring requirement and Zinc has been added due
to their ubiquitous nature and EPAs. [Further pretreatment information may necessitate a
reduction in monitoring].

INSTREAM MONITORING:
Warrenton is performing its own instream monitoring and is not part of a monitoring coalition
at this time. DO values appeared at or below 5 mg/1 for the previous 2 years.
PROPOSED CHANGES:
Warrenton is part of the Tar Pamlico Nutrient Trading Association and will not
receive nutrient limits with this renewal. Monitoring for TP and TN has been
increased to weekly, to coincide with the Association's requirement.
Toxicant parameters modified as stated previously.
Chronic toxicity language incorporates the new enforcement policy language.

Sludge Handling Plan
The sludge generated at the plant is wasted to aerobic digesters, where it is aerated until it is
suitable for land application. The sludge is then hauled away by Granville Farms of Oxford NC
and applied to land.
Vector Attraction
sludge residuals are raised to 12 or higher by the addition of lime and remains at 12 or higher for
2 hours and then at 11.5 or higher for an additional 22 hrs.
PSRP
the psrp consist of the agitating of residuals with air to maintain aerobic conditions of a mean
cell residence time between 40 days at 20 degrees Celsius and 65 days at 15 degrees Celsius
before being land applied.
