1) The degree and extent of harm to the natural resources of the State, to the public health, or to private
property resulting from the violation;
Discharging effluent exceeding permit limits for ammonia nitrogen, BOD, ammonia nitrogen, and TRC causes water
quality standard violation. Discharging effluent not meeting minimum DO and discharging below pH 6.0 is harmful to
water quality. Not monitoring for total suspended solids, TN, and Flow increases risks to public health.
2) The duration and gravity of the violation;
Daily permit limit for TRC was exceeded for the following days: 09.01.2021, 09.02.2021, 09.03.2021, 09.07.2021,
09.08.2021, 09.09.2021, 09.10.2021, 09.11.2021, 09.13.2021, 09.14.2021, 09.15.2021, 09.16.2021, 09.17.2021,
09.18.2021, 09.20.2021, 09.21.2021, 09.22.2021, 09.23.2021, 09.24.2021, 09.25.2021, 09.26.2021, 09.27.2021,
09.28.2021, 09.29.2021, and 09.30.2021. Daily permit limit for ammonia nitrogen was exceeded by 122% on 09.01.2021,
by 237% on 09.08.2021, by 335% on 09.15.2021, by 223% on 09.22.2021, and by 96% on 09.28.2021. Monthly permit
limit for ammonia nitrogen was exceeded by 1413%. Minimum daily DO was not met for the following days: 09.01.2021,
09.04.2021, 09.08.2021, 09.09.2021, 09.15.2021, 09.16.2021, 09.17.2021, 09.18.2021, 09.20.2021, 09.21.2021,
09.22.2021, 09.23.2021, 09.24.2021, 09.25.2021, 09.26.2021, 09.27.2021, 09.28.2021, 09.29.2021, and 09.30.2021. Daily
minimum pH was not met for the following days: 09.28.2021, 09.29.2021, and 09.30.2021. The following were not
monitored: Flow was not monitored on 09.24.2021, Total flow, Total Nitrogen concentration and quantity, and TSS was
not monitored on 09.25.2021.
3) The effect on ground or surface water quantity or quality or on air quality;
Discharging effluent exceeding permit limits for ammonia nitrogen, BOD, ammonia nitrogen, and TRC causes water
quality standard violation. Discharging effluent not meeting minimum DO and discharging below pH 6.0 is harmful to

4) The cost of rectifying the damage;
The costs of rectifying the damage is not given.
5) The amount of money saved by noncompliance;
It is believed that no money was saved by the noncompliance.
6) Whether the violation was committed willfully or intentionally;
It does not appear that the violations were committed willfully or intentionally.
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority;
There have been 12 enforcement cases against the violator within the past 12 months.

This letter transmits a Notice of Violation and assessment of civil penalty in the amount of $10,886.57 ($ 1 0,850.00 civil
penalty + $36.57 enforcement costs) against Jones Estates Pace LLC.
This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report
(DMR) submitted by Jones Estates Pace LLC for the month of September 2021. This review has shown the subject
facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No.
NC0064246. The violations, which occurred in September 2021, are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that Jones Estates Pace LLC violated the terms, conditions or
requirements of NPDES WW Permit No. NC0064246 and G.S. 143-215.1(a)(6) in the manner and extent shown in
Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2), a civil penalty may be assessed
against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a).

Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the
Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources, I, Scott

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and
Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are:

Management Commission has regulatory authority; and
The cost to the State of the enforcement procedures.
Within thirty (30) days of receipt of this notice, you must do one of the following:
(1) Submit payment of the penalty, OR
(2) Submit a written request for remission, OR
(3) Submit a written request for an administrative hearing
Option I: Submit payment of the penalty:
Payment should be made directly to the order of the Department of Environmental Quality (do not include waiver
form). Payment of the penalty will not foreclose further enforcement action for any continuing or new violation(s).

Option 2: Submit a written request for remission or mitigation including a detailed justification for such
request:
Please be aware that a request for remission is limited to consideration of the five factors listed below as they may
relate to the reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper
procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in
the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing,
such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and
agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you
believe the civil penalty should be remitted, and submit it to the Division of Water Resources at the address listed below.
In determining whether a remission request will be approved, the following factors shall be considered:
(1) whether one or more of the civil penalty assessment factors in NCGS 143B-282.1(b) was wrongfully
applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous violations; or
(5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions.
Please note that all evidence presented in support of your request for remission must be submitted in writing. The
Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of
your remission request. The response will provide details regarding the case status, directions for payment, and
provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider information that was not part of the
original remission request considered by the Director. Therefore, it is very important that you prepare a complete and
thorough statement in support of your request for remission.
In order to request remission, you must complete and submit the enclosed "Request for Remission of Civil Penalties,
Waiver of Right to an Administrative Hearing, and Stipulation of Facts" form within thirty (30) days of receipt of this
notice. The Division of Water Resources also requests that you complete and submit the enclosed "Justification for
Remission Request."

Option 3: File a petition for an administrative hearing with the Office of Administrative Hearings:
If you wish to contest any statement in the attached assessment document, you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the petition with
the Office of Administrative Hearings within thirty (30) days of receipt of this notice. A petition is considered filed
when it is received in the Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., except for official state
holidays. The petition may be filed by facsimile (fax) or electronic mail by an attached file (with restrictions) - provided
the signed original, one (1) copy and a filing fee (if a filing fee is required by NCGS §150B-23.2) is received in the
Office of Administrative Hearings within seven (7) business days following the faxed or electronic transmission. You
should contact the Office of Administrative Hearings with all questions regarding the filing fee and/or the details of the
fling process.

1 was very concerned in the beginning of the summer that we would not be able to maintain DO. Only half the diffusers are working in a basin that is carrying double the load;
furthermore, the one working diffuser line has a hole the size of a dime rusted in it and bypasses air badly. Also, i still do not trust my Flow meter. It is certified to July of 2021.

Outfall 001- Effluent Comments:
The chlorine problem continues unabated, upstream: 16l Oug/L, Effluent: 672ug/L, and Downstream: 1387ug/L during a 2 1/2" rain event on 10-8-21 that restored an enormous
flow to the stream and the Plant. The Plant has never had a problem with MI that i have observed before but it currently does seem to. 1 keep getting snapping turtles in the EQ
that are very small and look to have come from the Influent pipe (emulsified grease coated).
Im taking a Free Chlorine residual with a HACH DR1900 with Pillow Packs, i need to switch to Total Chlorine. The day we tested 2 manholes Eddie Morgan, Greg Applekamp,
and Mike Carter, Mike recommended that we use the sample to zero the meter instead of DI water, this was 9-24-2012. We get <490ug/L chlorine when the test is performed in
this manner. The sample cam be strained and sit for 10 minutes and is then clear. Sometimes it stays a green tint. This is the way Jennifer Doll jennifer.doll@johnstonnc.com

taught me to do the test. 1 went back to her way. She is a 4 Laboratory Manager. Later I was able to get direction from beth.swanson@ncdenr.gov that verified Jennifer had
trained me correctly and we could also use the sample to zero the meter as well. I've alerted Beth that 1 can only do my testing currently in mg/L now. Mitch said i could convert
it for now to ug/L for the DMR so that's what I'm doing. I only got a building 2 weeks ago.
I've started started running Chlorine Residual at Pace Labs. On the 15th mine were Eff I884ug/L and Inf 1136ug/L. Pace, in the Lab in Ashville on the 29th reports Eff260ug/L
and <490ug/L on the Influent.
9-28-2021 Effluent Chlorine Residual is ND on 10-12-2021 @ 24ug/L Report Limit in Ashville at Pace Labs. My test results on 9-28-2021 were 497ug/L Effluent and Influent
1810ug/L.
Please note,l do not have a certified Field Lab, I am only a grade 4 operator. 1 am working towards a Certified Field Lab but in adversity.
Pace Labs Chlorine Residual Effluent is ND @ 24ug/L Report Limit and Influent @ I2ug/L Residual Report Limit, 1 emailed Lindsey, my contact there this morning 11-2-2021
and asked about the Report Limit? The Permit is 17ug/L for effluent Obviously every fool got a toilet and will flush whatever they Like, but a constant drinking water chlorine
residual of drinking water and an pH8+ is difficult to work with only half the system ever having been online since February 7th at least.
(here is no way that the flows reported are correct. Every Engineer that has looked at it agrees. 1 believe it is consistent, so im waiting on and Engineer to check my estimate that
t is off by a factor of 10 at least, then i can go back and revise the reports.
Mitch asked me to convert the mg/L to ug/L so i have, double check my math, lol. i just moved the decimal because i believe that is correct. I'm going to switch to the ug/L
.vhen i can get some ventilation or just do it outside.

Statute (G.S.)143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a dvil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permlt issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any information provided on the submitted Monitoring
Report(s). You will then be notified of any dvIl penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a dvil penalty assessment may be
prepared.

Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. if the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
Jones Estates Pace, LLC
is hereby authorized to discharge wastewater from a facility located at the
Pace Mobile Home Park WWTP
15026 Buffalo Road
Clayton
Johnston County
to receiving waters designated as and unnamed tributary to Buffalo Creek in sub -basin 03-
04-06 of the Neuse River Basin in accordance with effluent limitations, monitoring
requirements, and other conditions set forth in Parts I, II, III, and IV hereof.
This permit modification is effective February 23, 2021.
This permit and authorization to discharge shall expire at midnight on April 30, 2023.
If the permittee intends to continue to discharge at the facility beyond the term of thispermit, a renewal
application must be submitted no later than November 1, 2022 (180 days before the expiration of this
permit).

Total Kjeldahl Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively.

Staff from the Raleigh Regional Office (RRO) performed a review of the September and October
2021 Discharge Monitoring Reports (DMRs) for Pace Mobile Horne Park. They found numerous
limit violations for BOD, TRC, Ammonia Nitrogen, Fecal Coliform, DO, and pH, along with
multiple monitoring violations for BOD, Flow, Total Nitrogen, TSS, TKN, Nitrite plus Nitrate,
and Total Phosphorous.
RRO issued John Estates Pace LLC a NOV-NOI in November 2021 for the September 2021
violations and a NOV-NOI in January 2022 for the October 2021 violations. Staff notes that
these violations may be attributed to the facility only running one of their two treatment trains.
The owner has retained an engineer and is working to get the second train back into operation.
RRO met with the owner representative to discuss the issues at the plant and the possibility of an
SOC, but DWR has not received an application to date.
Case LM-2022-0022 for September 2021 violations will be assessed for $10,850.00, not
including enforcement costs.
Case LM-2022-0023 for October 2021 violations will be assessed for $11,750.00, not including
enforcement costs.
The penalty amounts for these two cases have been multiplied by a factor of 2.0 due to the
multiple prior enforcements this facility has received within the past year.

Just a quick heads up that we have developed two fast -track penalty cases against Pace MHP that will exceed $10K each
for DMR limit/monitoring violations that occurred in September and October 2021. This is a continuation of self -
monitoring violations, which may be attributed to the facility only running 1 of their 2 treatment trains. The owner has
retained an engineer and is working to get the second permitted train back into operation. Because of the number of
prior assessments, the penalties in the subject cases include a 2.0 multiplication factor. The region met with the owner
representative to discuss the issues at the plant. The possibility of an SOC was discussed, but to date we have not
received an application.
Proposed civil penalties, excluding enforcement costs
• LM-2022-0022: $10,850
• LM-2022-0023: $11,750
If there are any issues with this office moving forward with the assessments, please let me know. I would like to issue
the assessments by next Friday, May 6th so we can begin work on a potential settlement agreement with the
permittee. Please let me know if more time is needed for the review.
