The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Surf City Community Park and Recreation Center on September 9, 2005. Staff
review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 050518 dated September 13, 2005, for the construction of the
subject project:
This permit shall be effective from the date of issuance until September 13, 2015, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements In this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until September 13, 2015, and
shall be subject to the following specified conditions and limitations:
L DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2.. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 94,090 square feet of
impervious area in a drainage area of 3.25 acres (the "High Density Tract"). The
remaining project area of 19.75 acres (the "Low Density Tract") must be
maintained at 25% built -upon area, as required by Section .1005 of the
stormwater rules.
3. The High Density Tract will be limited to the amount of built -upon area indicated
on page 3 of this permit, and per approved plans. There is no allotment for future
built -upon area.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted High Density Tract of this
project must be directed into the permitted stormwater control system.

7. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
8. The only runoff conveyance systems allowed within the Low Density Tract will be
vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V)
as defined in the stormwater rules and approved by the Division.
9. No piping is allowed in the Low Density Tract except that minimum amount
necessary to direct runoff beneath an impervious surface such as a road or to
provide access.
10. Unless specified elsewhere, permanent seeding requirements for the swales
must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.��
11. Roof drains in the Low Density Tract must terminate at least 30 �C
High Water line. Roof drains in the High Density Tract must be G
connected to the stormwater management system.
II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entire►
vegetated and operational for its intended use prior to the construction ly
built -upon surface. Projects in the Low Density Tract covered by this permit will
maintain a minimum 30 foot wide vegetative buffer between all impervious areas
and surface waters.

2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
a. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
b. The falling water from the.fountain must be centered in the pond, away
from the shoreline.
C. The maximum horsepower for a fountain in this pond is 3/4 horsepower.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.

10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
14. Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of
any built -upon surface.
15. The permittee shall at all times provide the operation and maintenance
necessary in the Low Density Tract to operate the permitted stormwater
management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
16. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit'does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
2. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system ar% provided, such as a vegetated shelf,
and a forebay.
15. The required system dimensions are provided per the approved plans.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.
II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 22.5 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads N/A feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.

stormwater review permit application. The 23-acre site is heavily wooded and includes an existing
wet pond, with a permanent pool surface area of over 2.6 acres, three feet of permanent pool depth,
a length -to -width ration to 2.5:1 and a 10-foot vegetated perimeter shelf. Attached are the
calculations for the existing pond, signed and sealed. These calculations include a full routing of
the existing pond, accounting for the new imperviousness surfaces. As you can see in the routing,
due to the large amount of volume in the existing pond, additional runoff from the new
imperviousness has little effect on existing conditions. The 25-year event is completely contained
within the existing pond. All other issues from your review have been addressed.

EDA PROJECT NUMBER 2004425, is the Surf City Community Park and Recreation
Center located in the Town of Surf City, North Carolina. The 23-acre site is heavily
wooded and includes a large, existing wet pond, with a permanent pool surface area of
over 2.6 acres, three feet of permanent pool depth, a length -to -width ratio to 2.5:1 and a
10-foot' vegetated perimeter shelf. In keeping with the NCDENR Stormwater
regulations, we are using the large pond to treat the storm run-off from the project. These
calculations include a full routing of the existing pond, accounting for the new
imperviousness surfaces. Per the routing, due to the large amount of volume in the
existing pond, additional runoff from the new imperviousness has little effect on existing
conditions. The 25 year event is completely contained within the existing pond.

WET DETENTION BASIN NARRATIVE
Surf City Community Park and Recreation Center
Surf City, Pender County, North Carolina
INTRODUCTION
The proposed project, the Surf City Community Park and Recreation Center, is located on J.H.
Batts Road approximately 1,700 feet to the west of NC 210, in Surf City, Pender County,
North Carolina (see vicinity map, Sheet CS). The proposed project is to be designed,
permitted, and constructed with grant funding for the Town of Surf City. The grant funding is
extremely time sensitive. Specifically, a significant portion of the grant funding must be
expended by October, 2005 or the funding will be forfeited. Due to the project's grant funding
tight time line requirements, we are requesting this project to be reviewed under the NC
DENR Express Permit Review process.
As seen on the attached site site plan, Sheet C-1, this project is located on a 23-acre parcel, in a
remote area of the Town. The project consists of a slab -on grade metal building to be used for
recreational purposes by the Town of Surf City. In addition, the project includes parking, a
20-foot access road, and utilities — water, sewer and electric. Currently, the majority of the site
is undeveloped. However, a portion of the site, where no development is proposed, is a closed
and capped, solid waste landfill, permit Number 7101.
DESIGN INTENT
The 23-acre site is heavily wooded and includes a large existing wet pond, with a permanent
pool surface area of over 2.6 acres. The existing pond has a three-foot permanent pool depth, a
length -to -width ration to 2.5:1 and a 10-foot vegetated perimeter shelf. There are no existing
or proposed discrete stormwater collection structures. The existing pond will be used to
provide stormwater management and will contain the entire first 1" of rainfall.
As detailed in the attached Wet Detention Basin Supplement,
1. Runoff from the unimproved areas of the project will be allowed to drain through
vegetated areas into the existing surface drainage channels.
2. New areas of impervious areas will drain via overland relief through heavily vegetated
areas to the pond.
3. The pond will contain the first 1" of run-off.
4. The pond allows the first 1" event to pass through the three corrugated metal pipes,
with an emergency spillway to pass the 100 year event.
5. The downstream receiving channel is very large. Its banks are also heavily vegetated.
The outfall structure contains 4'x3' Cl A riprap.

DESIGN CRIFTERIA
The proposed project includes 6.9 acres of disturbed area and 2.16 ac of impervious area.
According to the DWQ Table 1.1 of the NC DENR Best Management Practices, the pond will
provide removal of over 85% total dissolved solids, with an actual SA/DA ratio of 0.79,
greater than the required 0.59.
The design criteria for runoff control volume is the first 1" of run-off volume. Utilizing
rational method, an impervious area of 2.16 acres, the design rainfall volume is 59,000 gal.
With inlet control, the pond controls the design rainfall volume at elevation 25.4. The
permanent pool/wet storage provided is 236,733 cu ft and temporary pool volume of 359,704
cu ft. The provided storage far exceeds the requirements. The draw down of the temporary
pool of the design run-off is two days.
Regarding the required items in the checklist, there is NO discrete stormwater collection
system in the proposed project and all run-off enters the pond via overland relief, along the
entire perimeter of the pond. Under these conditions, a forebay would not provide the benefits
normally provided by a forebay. All sediment will be deposited in a uniform manner along the
entire perimeter and will have to be removed accordingly, when the ponds volume is reduced
25%.
The ponds outlet includes two 24-inch and one 36-inch corrugated metal pipes, with trash rack
and a mechanism to drain the pond for maintenance.
The pond has three feet of permanent pool depth, a length -to -width ratio to 2.5:1 and a 10-foot
vegetated perimeter shelf.
The entire perimeter of the pond above the permanent pool has established vegetated cover.
The pond is not within an easement, as the owner is the Town of Surf City and there are no
access issues.
Erosion and Sedimentation control plan is provided for reference and has been submitted
under separate cover. Per the plan, the basin will not serve as a sediment basin during
construction. All erosion and sediment controls, including sediment traps at the site entrance
have been identified. A sequence of events has been established and limits of disturbance are
identified to be flagged and honored during construction.

Regarding receiving waters and wetlands, per the report, the project includes no stream
reaches to the Class SA HQW of Topsail Sound. Additionally, the Wilmington District,
USACE has determined there are no jurisdictional wetlands on the property, Action ID
200500145 (Attached).
Currently, the majority of the site is undeveloped. The remaining portion of the site, where no
development is proposed, is a closed and capped, solid waste landfill, permit Number 7101.
Regarding stormwater, 23-acre site is heavily wooded and includes a pond, approximately 250
feet by 450 feet. Of the 23 acres, the proposed project includes 6.9 acres of disturbed area and
2.16 ac of built -upon area. As 9.4% of the total 23 acres of the site will be built -upon and
there are NO DISCRETE stormwater collection systems, we will treat the stormwater with the
low -density option. The design honors the original drainage divides and stormwater, which
will be treated with, vegetated conveyance, including overland flow, existing channels, and
two large 100 and 200 vegetated buffers
Regarding the erosion and sediment, an Erosion and Sedimentation control plan will be
submitted. The proposed plan is explicit in detail. All erosion and sediment controls are
identified, a sequence of events has been established and limits of disturbance are identified to
be flagged and honored during construction.

An agency meeting was conducted on October 13, 2UU4 to discuss jurisdictional area issues at the
proposed Town of Surf City recreational area, as well as additional agency considerations. The meeting
provided a forum for input by the various interested parties and entities. The Town of Surf City property
is a former county landfill site, which is currently under consideration as a recreational area for the town.
Major topics of discussion during the meeting are summarized below.
Jurisdictional Area Issues
Lillette Granade (USACE) reviewed the jurisdictional area delineation. Lillette removed depressional
wet areas on top of the landfill cap due to the landfill elevation being approximately 12 to 15 feet above
the original ground elevation. These areas formed as the result of poor grading leaving small depressions
which trap/pond water. In addition, the on -site pond and ditches exiting the pond (parallel to the eastern
property boundary) were removed since these were originally dug within upland areas. The two
remaining wetland areas are considered isolated by Lillette since they are not connected to jurisdictional
surface waters. Therefore, there are no areas on -site which are under jurisdiction of the U.S. Army Corps
of Engineers (see attached, updated Figure 3).
CAMA Issues
James Gregson (NCDCM) reviewed the proposed recreational site location and indicated that the site will
not be under jurisdiction of the N.C. Division of Coastal Management due to its distance from tidal
waters. However, Coastal Area Management Act consistency issues may apply.
Waste Management Issues
John Crowder (NCDWM) and Cheryl Marks (NCDWM) reviewed the old landfill site and indicated that
the site is not technically a brownfield site; however, it will be handled as if it is. The site previously
served as a landfill for Pender County and was permitted as such under permit number 7101 or 7102
(John and Cheryl were unsure which number). The site was recently sold to the Town of Surf City. John
and Cheryl stated that prior to converting the old landfill to a recreational area certain issues must be
investigated further to make certain that the site is safe for reuse. The two main issues are methane and
groundwater; generally methane travels with the groundwater. A site assessment plan must be submitted
to and reviewed by the N.C. Division of Waste Management prior to proceeding with alternative uses of.
the property. Cheryl Marks will be the contact person for fiuher coordination. Cheryl indicated that
these issues generally do not stop site development.
Isolated Wetland Issues
Consultation with the N.C. Division of Water Quality will be necessary prior to any impacts to isolated
wetlands.

An agency meeting was conducted on October 13, 2004 to discuss jurisdictional area issues at the
proposed Town of Surf City recreational area, as well as additional agency considerations. The meeting
provided a forum for input by the various interested parties and entities. The Town of Surf City property
is a former county landfill site, which is currently under consideration as a recreational area for the town
Major topics of discussion during the meeting are summarized below.
Jurisdictional Area Issues
Lillette Granade (USACE) reviewed the jurisdictional area delineation. Lillette removed depressional
wet areas on. top of the landfill cap due to the landfill elevation being approximately 12 to 15 feet above
the original ground elevation. These areas formed as the result of poor grading leaving small depressions
which trap/pond water. In addition, the on -site pond and ditches exiting the pond (parallel to the eastern
property boundary) were removed since these were originally dug within upland areas. The two
remaining wetland areas are considered isolated by Lillette since they are not connected to jurisdictional
surface waters. Therefore, there are no areas on -site which are under jurisdiction of the U.S. Army Corps
of Engineers (see attached, updated Figure 3).
CAMA Issues
James Gregson (NCDCM) reviewed the proposed recreational site location and indicated that the site will
not be under jurisdiction of the N.C. Division of Coastal Management due to its distance from tidal
waters. However, Coastal Area Management Act consistency issues may apply.
Waste Management Issues
John Crowder CNCD'W i) and Cheryl Marks CNCDW-rAi) reviewed the old landfiil site and indicated that
the site is not technically a brownfield site; however, it will be handled as if it is. The site previously
served as a landfill for Pender County and was permitted as such under permit number 7101 or 7102
