No road along proposed -L- line North Carolina Department of Transportation Highway Stormwater Program STORMWATER MANAGEMENT PLAN FOR NCDOT PROJECTS Project Type: 1573 Mail Service Center Address: General Project Information HL-003336249.4033 Address: 3/2/2022 17,000 Suburban residential Surface Water Body (1): UT to Crabtree Creek NCDWR Stream Index No.:27-33-(1) NCDWR Surface Water Classification for Water Body This is a new location roadway project that was designed to minimize impacts to water quality as much as practicable. 2:1 side slopes with guardrail were used to reduce the length of jurisdictional stream impacts to UT to Crabtree creek. 2:1 side slopes were also used in the footprint of the wetland to minimize impacts. The roadway grade was also lowered as much as possible to maintain clearance from a Duke transmission line and still provide an adequate level of service for the roadway. Streams along UT to Crabtree Creek are subject to Neuse River Buffer Rules. Approaching drainage was design to minimize impact to adjacent riparian buffers by avoiding deep ditches for stormwater conveyance that would require clearing of buffers. In its place, storm drainage systems were connected to the 8'x7' RCBC to aid in energy dissipation prior to outfalling to UT to Crabtree Creek. Temporary diversion channels were utilized on the east side of the 78 inch RCP to minimize impacts of Wetland A. Phase II impacts were based on slope stakes +25'. Due to the new location nature of the project, excessive outside easement areas were minimized as construction access through the corridor will be possible. Yes No Permit Type: usace Project Description: REVISED (May 2021): Updated, final Area of Potential Effects was provided for comments and review to ensure full coverage and consideration. There are new, relatively small extensions and expansions along previously reviewed APE, mostly along existing roadways and easements. The same factors and conclusions apply for the additional area with regards to archaeological review. Mapping has been updated with this newly submitted form. REVISED: This archaeological review has been updated to include a proposed second phase of the Aviation Blvd Extension project. Updated mapping and discussion are incorporated into this document to reflect a revised, longer APE. Note, a portion of the additional area has been surveyed for a separate archaeological study. The new portion of the APE is about 4000 feet (combined with the original for about 6200 feet). This continues new location extension from Church Street which crosses over a railroad and NC 54 before tapering back to Airport Blvd within 2000 feet northeast of of NC 54. The width varies up to 700 feet to accommodate two or more alternatives. Close to a half of the new APE is urban, developed for commercial use, while the other half includes rolling wooded and pasture landforms. Federal involvement is assumed through permitting; therefore Section 106 of the National Historic Preservation Act applies. Additional comments for the added APE are italicized below. NCDOT proposes to extend Airport Boulevard (SR 3126) from Garden Square Lane to Church Street (SR 1637). Town Hall Drive and Church Street would also be enhanced with minor widening. Federal funding is expected through FHwA and USACE permitting is anticipated. Preliminary design plans were available at the time of this review. This Area of Potential Effects (APE) is shown below (See Figures 1 and 2). This new location project length is about 2200 feet (approximately 0.41 miles). The study APE is about 200 feet in width. This is a federally funded and permitted project and thus falls under Section 106 of the National Historic Preservation Act for purposes of archaeological review. SUMMARY OF CULTURAL RESOURCES REVIEW Brief description of review activities, results of review, and conclusions: Approximately 4000 feet of additional APE has been added to this review, generally east of the original review. Half of the added APE is urbanized with modern gas stations, parking, graded lots and commercial parcels present along with normal utilities. The remaining area is undeveloped, with some land used for agricultural pursuits namely an open pastured hillside for cattle (Figure 1, revised). Various historic maps and aerials were reexamined, paying closer attention to this new area of consideration. No notable features were mapped or seen on the maps and images. The property has been under constant agricultural use during the span of aerial photography, spanning 60-70 years back. Note, the western portion of the expanded APE includes a farm pond. This pond is visible in 1950s aerial photography but not on earlier twentieth century mapping until the Cary 1973 USGS map. Generally, the result of terrain modification and frequently bulldozing that reduces the integrity of any archaeological sites that might otherwise be present, the immediate surroundings of the pond are not considered high probability. Soil types in the expanded APE are designated urban (~60%) or Carbonton-Brickhaven complex of varying slopes (~30%), Creedmoor-Greenlevel soils (~5) or the frequently flooded Chewacla or Wahadkee soils (~5%). Of these soils, the elevated, somewhat level hilltop within the Carbonton-Brickhaven complex may hold the most potential for the presence of archaeological sites. This larger landform has small drainages along its perimeter, an attractive location for camps or farmhouses. As former and current agricultural lands which can be seen in aerials dating back into the 1950s, the hill is likely to be eroded which would diminish the quality of information a site might yield. In contrast, the Urban soils characteristically contain modified, disturbed soils because of grading, terrain modification, and constructing roads, parking lots, infrastructure, commercial buildings, and residences. Present within the APE especially along the developed roads, these modified locations are less likely to contain intact, significant archaeological sites. The sloped and wet soils, due to the less desirable topography and drainage, are also unlikely to have archaeological sites present because of less frequent and continual use that would result in significant, intact archaeological remains. Note, there was unintentional overlap with the original review between the Programmatic Agreement and the Office of State Archaeology (ER 20-0811). OSA concluded after examining nearby known resources and results of archaeological surveys, soils comparison, aerial photography and a physical walk-over that no archaeological survey was warranted, noting the conditions and a scatter of small sites that were not determined eligible for listing on the NRHP. That review only applies to the original half of the project, called Phase I. Phase II covering the current study area east of Church Street. A sewage easement runs parallel through the new APE and appears was subjected to environmental review. The exact ER number and data could not be obtained, though the resulting review did not apparently result in the discovery of any archaeological resources. Another portion of the current APE was included in a 2001 archaeological survey conducted by Legacy Research Associates, Inc., on behalf of Celestica Development. The report documents three archaeological sites, 31Wa1486, 31Wa1487 and 31Wa1488**, of which 31Wa1487 is mapped on the higher probability landform overlapping into the current APE (ER 01-9702, Bib # 4783). The hilltop was subjected to subsurface testing which yielded cultural material in 13 positive shovel test pits out of 23 excavated. The Native American site included quartz and rhyolite debitage and a small number of ceramic sherds. The report recommends 31Wa1487 as not eligible for the National Register of Historic Places, noting the low density and eroded conditions. The NC Office of State Archaeology concurred with the recommendations for this site. The portion of proposed roadway to be developed is curently wooded or recently cleared and largely undeveloped according to USGS mapping (Cary) (Figure 1) and modern aerial photography (Figure 2). Parcels to either side of the proposed route have been developed especially in the past two decades and aerial photography from 2002 shows the western half was cleared and graded during construction of neighborhoods. Areas that have been stripped or recontoured are less likely to contain intact archaeological sites. Since the road doesn't yet exist, the length could not be viewed, though certain locations had virtual views of the project from adjacent neighborhoods. Wake County GIS mapping shows the APE already contains a defined ROW which is 100 feet across. Project notes suggest that a wider impact than the current ROW may be required to accommodate proposed multi-use paths or for slope cuts and fill. Historic maps were examined to determine if any late historic structures, roads or other notations were present to help establish the a context of the recent past, especially farms, industry, land and transportation features which might offer hints to the presence of archaeological sites. The 1914 Soils Map of Wake County (MC.099.1914b) depicts only Church Street (SR 1637) as being in existence with no other roads, buildings or other features mapped at the time. This lack of representation on an otherwise detailed and accurate map decreases expectations for late nineteenth or turn of the 20th century archaeological sites. The Office of State Archaeology research was examined to review archaeological mapping and to reference any known archaeological surveys. Several environmental reviews cross the APE though few, if any, were recommended for archaeological survey. Those include three NCDOT project in close vicinity to the current undertaking, PA 17-07-0002, PA 17-07-0004 and PA 18-12-0028. Northeast of the project, three archaeological sites have been identified, one historic site, 31Wa1483, and two Native American sites 31Wa1486 and 31Wa1487. Those sites were not listed as been eligible for inclusion on the National Register of Historic Places (NRHP). According to USGS mapping, other GIS sources and NCDOT cemetery data maintained by Paul Mohler, no other cemeteries are recorded within the APE. The Civil War Battle of Morrisville Station occurred southeast of the project area centered around the train station about one mile southeast. The fighting on April 13, 1865 involved attempts to stop a train which did retreat to some safety though the Union Army then occupied the town. Little of the battle in known to remain though some earthworks and a occassional shell have been reported in the past two decades. The current APE is outside of the battle landscape. Soil mapping of the project APE shows that about a third of the terrain is Chewacla and Wehadkee soils, noted as frequently flooded and not well drained. This is the western portion of the APE associated with Kit Creek and tributaries. The remainder is listed as urban land. Neither soil type is especially promising for containing intact, signficant archaeological sites. Brief Explanation of why the available information provides a reliable basis for reasonably predicting that there are no unidentified historic properties in the APE: 6/3/2021 Minor revisions to the APE have been incorporated into this form. Considerations and factors remain the same for these new, adjacent expansions. Mapping has been updated. Please note that aerial mapping from approximately 2008 shows major earthmoving and grading as part of modern development at the western end of the project. This is in addition to the c. 2002 clearing noted elsewhere in this form. The conclusion and recommendation remains the same for this review. An archaeological review of additional APE for this project revealed similar conditions to the original examination (which was inadvertently also considered by OSA staff which concluded that no survey was warranted). For the current expansion, there are ER reviews from OSA in the immediate vicinity, at least two of which overlap the current APE. For one of those earlier reviews on an unrelated project, an archaeological survey was recommended, and subsurface testing occurred on the eroded, but higher probability hilltop at the edge of a pasture. As a result, site 31Wa1487 was documented partially within the current APE. The Native American lithic and ceramic site was found to have an eroded context and determined not to be eligible for listing on the NRHP. OSA staff concurred with the finding. As the only landform with increased probability for archaeological sites has already been considered and subjected to subsurface testing of an archaeological site found to be present but not eligible for the NRHP, no further archaeological survey is warranted. Other portions of the APE are low probability as noted above, being modified and graded for modern development, sloped, or poorly drained. A response was noted to be dated January 13, 2020. We recommend updating this information, as necessary. Much of the APE has been modified by modern development, especially the construction of installation of residential developments. The probability for intact soils is low, as would be undisturbed, significant archaeological sites. There are no known, recorded archaeological sites presents. There are no NRHP archaeological sites present. It is unlikely that significant, intact archaeological remains would be present and impacted by the project. For archaeological review, this state funded undertaking should be considered compliant with Section 106. Please note that Wake County has been identified as an area of interest to the Catawba Indian Nation. It is recommended that you contact each federal agency involved with this project to determine their Section 106 Tribal Consultation requirements. We note that you may have already done so and received comments from the Catawaba Indian Nation on a letter dated January 13, 2020. All other properties within the APE over fifty years of age are unremarkable and do not warrant further evaluation. There are no National Register listed or eligible properties and no survey is required. If design plans change, additional review will be required. The Capital Area Metropolitan Planning Organization (CAMPO) has awarded construction funds for Phase 1 of this project to the Town of Morrisville using Locally Administered Projects Program (LAPP) funding in Federal Fiscal Year 2022. The Town has entered into an agreement with NCDOT Division 5 to manage the project’s planning and design. It is anticipated that Phase 1 right-of-way acquisition will occur in Federal Fiscal Year 2022, with construction letting occurring before September 2022. Phase 2 is currently unfunded for right-of-way acquisition and construction. The project is being developed with federal funds under the National Environmental Policy Act (NEPA.) The project is included in the NCDOT 2020-2029 State Transportation Improvement Program (STIP) as Project No. HL-0033. B. Description of Need and Purpose: The 2019 Town of Morrisville Comprehensive Transportation Plan identifies Airport Boulevard as one of the Town’s strategic corridors, noting its importance in helping to support and manage the Town’s rapid growth. The need for the project arises from the current convoluted traffic patterns necessary to travel between key locations in Morrisville. Key locations include schools, government offices, and businesses along Town Hall Drive, which is another of the Town’s strategic corridors, and along Church Street. Key locations in Morrisville also include the commercial and office developments on the existing segment of Airport Boulevard northwest of Chapel Hill Road. The Town of Morrisville has also identified existing capacity concerns about several intersections on Davis Drive, including the Morrisville-Carpenter Road intersection. The purpose of the proposed action is to improve overall, multi-modal traffic mobility on the Town of Morrisville’s roadway network and to enhance roadway connectivity between Davis Drive and Chapel Hill Road. The proposed action begins and ends at established roadways and will improve the local roadway network independently of any future projects, providing an alternative route between Davis Drive and Chapel Hill Road. The proposed action also completes a missing link in the Airport Boulevard corridor, which improves connectivity to employment centers in Research Triangle Park (RTP) as well as to I-40 and Raleigh-Durham International Airport (RDU). Secondary benefits of the project would include addressing the Town’s capacity concerns about existing intersections on Davis Drive and fulfilling the Town’s multimodal policy recommendations. The proposed design for the project is consistent with the 2019 Town of Morrisville Comprehensive Transportation Plan. The project’s Purpose and Need Technical Memorandum, 36249.4033_PandN Tech Memo, dated April 2020, can be located here C. Categorical Exclusion Action Classification: Type III D. Proposed Improvements: The existing segment of Airport Boulevard between Davis Drive and Garden Square Lane is a four-lane curb and gutter facility with a raised grass median and five-foot sidewalks on each side, and a posted speed of 45 mph. The current Phase 1, as shown on Figure 2, proposes to extend Airport Boulevard from Garden Square Lane to Church Street with a similar typical section. In lieu of the sidewalks on each side, the Phase 1 utilizes a ten-foot wide multi-use use path on the south side, a five-foot sidewalk on the opposite side, along with a five-foot utility strip on each side. There will also be a dedicated pedestrian crosswalk where the Indian Creek Greenway crosses the new segment of Airport Boulevard. The new location portion of the Indian Creek Greenway will be constructed prior to closing the existing trail, with access to the trail maintained during construction. The improvements along Town Hall Drive and Church Street, consist of the additions of turn lanes to accommodate Airport Boulevard. These improvements also include replacement of existing sidewalks disturbed due to the widening. No additional widening along Town Hall Drive and Church Street other than the addition of turn lanes are included in this project. Phase 2, which extends Airport Boulevard from end of Phase 1 at Church Street to Chapel Hill Road (NC 54) currently is unfunded. Phase 2 has two alternatives as shown on Figure 3, both would cross over the North Carolina Railroad, with a grade separation. Each of the two alternatives do have connections back to Chapel Hill Road. The existing segment of Airport Boulevard between Chapel Hill Road and Aviation Parkway is a five-lane facility with a center turn lane, curb and gutter, sidewalks, and a posted speed of 45 mph. E. Special Project Information: Airport Boulevard is a major thoroughfare with two existing segments in the Morrisville area—one from Davis Drive (SR 1613) to Garden Square Lane and another from Chapel Hill Road (NC 54) to Aviation Parkway (SR 1002) in the vicinity of the Raleigh Durham International Airport. The existing segment from Chapel Hill Road to Aviation Parkway includes an interchange with I-40. The CAMPO 2045 Metropolitan Transportation Plan identifies the extension of Airport Boulevard from Garden Square Lane to Chapel Hill Road (NC 54) as a 2035 horizon year project, identifying the future facility as a minor thoroughfare. The project is being developed using a Complete Streets concept, including a sidewalk, a multi-use path, and a dedicated pedestrian crosswalk where the Indian Creek Greenway crosses the new segment of Airport Boulevard. Alternatives Due to the constraints created by existing development on either side of the proposed path for Phase 1, one alignment was studied for Phase 1 of the project (See Figure 2), while two alternatives were examined for Phase 2 (See Figure 3). The first of these would align directly with the existing location of Airport Boulevard and include a bridge spanning the existing rail line and Chapel Hill Road, requiring construction of a loop from Airport Boulevard to Chapel Hill Road. The second alternative would also require a bridge across the rail line and Chapel Hill Road but would be shifted slightly to the east of the existing location of Airport Boulevard. During final design of Phase 2, the railroad grade separation shall be designed to accommodate a four-track layout with a twenty four foot- three inch (24’-3”) vertical clearance. Based on current cost projections, the total anticipated cost for Phase 1 of the project is $8,600,000. This includes $8,000,000 in construction costs, $540,000 in right-of-way costs, and $60,000 in utility relocation costs. Due to the additional jurisdictional and business relocations impacts produced by Phase II Alternative 2, as shown in Tables 2 and 3, the department recommends Alternative 1 be selected as the Preferred Alternative for Phase II. Jurisdictional Features and Agency Coordination A Natural Resources Technical Report (NRTR) was completed for Phase I of the project in July 2021 and another NRTR was completed for Phase II in September 2020. For most of these species, suitable habitat is not present in the project study area, so the Biological Conclusion was No Effect. Field surveys for Michaux’s sumac, for which the study area contains suitable habitat, were completed, but no specimens were located, resulting in a Biological Conclusion of No Effect. The Biological Conclusion for the Northern long- eared bat is May Affect, Likely to Adversely Affect under a programmatic biological opinion established by the US Fish and Wildlife Service (USFWS), Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT in eastern North Carolina. The project will not affect the bald eagle and no Eagle Act permit will be required. Table 1 identifies the Endangered Species Act Protected Species for Wake County. Although not currently listed by USFSW in Wake County, we also include the northern long-eared bat as discussed in NRTR for Phase 1, July 2021. Table 1. Several stream segments are located in the project area; none of them are High Quality Waters (HQW), Outstanding Resource Waters (ORW), or water supply watershed WS-I or WS-II waters. The stream segments in Phase II are tributaries to a portion of Crabtree Creek that is on the North Carolina 2018 Final 303(d) list of impaired waters. Streamside riparian zones within the study area are protected under the provisions of the Neuse Buffer Rules administered by NC Division of Water Resources (NCDWR). All but one of the stream segments in the project area, as identified in the Phase I NRTR corridor, are subject to buffer rule protection. Four jurisdictional wetlands were identified in the Phase I area and seven jurisdictional wetlands were identified in the Phase II corridor area. The Jurisdictional Determination (April 27, 2021) for Phase II of the project identified five wetlands in the project corridor area. NCDOT has coordinated with the U.S. Army Corps of Engineers (USACE) and NC Department of Environmental Quality (NCDEQ) Division of Water Resources (DWR) throughout the planning phase of this project. In lieu of holding an in-person scoping meeting, NCDOT distributed project information to and solicited input from resource and regulatory agency representatives. This scoping information was distributed to the agencies in March 2020. NCDOT completed Merger Pre-Screening with USACE and determined that the project does not need to follow the NEPA/404 Merger Process. However, in order to meet USEPA’s requirement of holding a coordination meeting 30 days before a Section 404 permit application is submitted, a Merger 4B/4C-equivalent pre-application meeting will be held. The NRTR for Phase I of the project can be accessed here and the NRTR for Phase II of the project can be accessed here. The USACE has been provided information on anticipated jurisdictional impacts for Phase I and Phase II. The agency indicated that the stream crossings on Phase I are separate crossings and the project can likely be permitted using Nationwide Permits. Direct, Indirect, and Cumulative Community Effects Notable community features of the project area include two schools; one of the schools, Sterling Montessori Academy, includes a soccer field and playground adjacent to the project corridor and the other school, Cedar Fork Elementary School, is also used as a local community center. None of these uses will be affected by the project. The Indian Creek Greenway, a public greenway trail, crosses the project corridor; the project will include development of a dedicated pedestrian crosswalk where the trail crosses the corridor. While minority populations are present in the project area, no notably adverse community impacts are anticipated with this project; thus, impacts to minority and low- income populations do not appear to be disproportionately high and adverse. Benefits and burdens resulting from the project are anticipated to be equitably distributed throughout the community. No disparate impacts are anticipated under Title VI and related statutes. The project has a low-to-moderate potential to influence growth and development. While the project will create a new roadway connection and reduce travel times, the small scale of the project and the fact that the vicinity of the project is relatively built out suggests that the ability of the project to stimulate growth and development will be limited. Common topics addressed by public comments included: · Questions about the long-range planning process and the project’s status with respect to the Town of Morrisville 2019 Transportation Plan and the CAMPO 2045 Metropolitan Transportation Plan. · The need for the project and for widening other roadways in the area. · The desire to see funding for construction of both phases of the project. · Concerns about the planned posted speed limit (45 mph) for the project. · Safety concerns regarding pedestrians, particularly children walking to school and recreational sites. · A desire for bike lanes to be included on both sides of the project. NCDOT and the Town will consider all feasible options to make sure the project would be safe for all users. One such option may include lowering the speed limit during school’s commuting hours. Traffic Noise Analysis A Traffic Noise Analysis (TNR) was completed for both Phase I and Phase II of the project. The report, Traffic Noise Analysis, Lochner, dated July 2021, can be located here. Traffic Noise Impacts The maximum number of receptors in each project alternative predicted to be impacted by future traffic noise is shown in the table below. The table includes those receptors expected to experience traffic noise impacts by either approaching or exceeding the FHWA Noise Abatement Criteria or by a substantial increase in exterior noise levels as defined in the NCDOT Traffic Noise Policy. Noise barriers include two basic types: earthen berms and noise walls. These structures act to diffract, absorb, and reflect highway traffic noise. This project will maintain uncontrolled right of way access, meaning that most noise- sensitive land uses will have direct access connections to the proposed project, and most intersections will adjoin the project at grade. The traffic noise analysis for this project confirmed that the physical breaks in potential noise barriers that would occur due to the uncontrolled right of way access would prohibit any noise barrier from providing the minimum required traffic noise level reductions at predicted traffic noise impacts, as defined by the noise abatement measure feasibility criteria of the NCDOT Traffic Noise Policy. Therefore, noise abatement would not be feasible. Based on this preliminary study, traffic noise abatement is not recommended, and no noise abatement measures are proposed. This evaluation completes the highway traffic noise requirements of Title 23 CFR Part 772. No additional noise analysis will be performed for this project unless warranted by a substantial change in the project’s design concept or scope. In accordance with NCDOT Traffic Noise Policy, the Federal/State governments are not responsible for providing noise abatement measures for new development for which building permits are issued after the Date of Public Knowledge. The Date of Public Knowledge of the proposed highway project will be the approval date of the Type III Categorical Exclusion Checklist. NCDOT strongly advocates the planning, design and construction of noise-compatible development and encourages its practice among planners, building officials, developers, and others. GeoEnvironmental Phase I Report A GeoEnvironmental Phase I Report was completed in August 2021, the findings of which include four (4) sites of concern within the project’s study area. Each of these are in the Phase II portion of the project and all are located near NC 54 (Chapel Hill Road) and/or existing portion of Airport Boulevard. Once Final Right of Way plans are complete, a review will be completed to determine if a Phase II investigation and Right of Way recommendations are necessary. Additional Documentation as Required from Section F Question 1 – Protected Species The US Fish and Wildlife Service has revised the previous programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 22 counties, but may potentially occur in 8 additional counties within Divisions 1-8. NCDOT, FHWA, and USACE have agreed to two conservation measures which will avoid/minimize mortality of NLEBs. These conservation measures only apply to the 30 current known/potential counties shown on Figure 2 of the PBO at this time. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO will ensure compliance with Section 7 of the Endangered Species Act for ten years (effective through December 31, 2030) for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Wake County , where HL-0033 is located. Question 28 – Noise Based on the preliminary Traffic Noise Analysis, traffic noise abatement measures are unlikely for this project in accordance with 23 CFR 772 and the NCDOT Traffic Noise Policy (October 2016). It is recommended that all reasonable efforts be made to minimize exposure of noise-sensitive areas to construction noise impacts. Unless there are changes to the project design which were not evaluated during this environmental study, further study of traffic noise impacts and potential abatement measures is not recommended. This feature is bounded by 1 red polygon (indicated as AJD Review Area) (see attached map). The specific waters that were reviewed under the Preliminary JD (PJD) are as follows: Surface water features TA, TC- Eph and OWB; wetlands WA and WB. These 5 aquatic features are also shown on the attached map and include all potential waters not reviewed under the AJD. The project areas for these waters are bounded by 3 separate purple polygons (indicated as PJD Review Area), (See attached map). Indicate Which of the Following Apply: A. Preliminary Determination X There are waters, including wetlands, on the above described project area, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). Therefore, this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further instruction. The April 27, 2021 AJD was conducted under the Navigable Water Protection Rule (NWPR). x The Environmental Protection Agency and U.S. Army Corps of Engineers (“the agencies”) are in receipt of the U.S. District Court for the District of Arizona’s August 30, 2021, order vacating and remanding the Navigable Waters Protection Rule in the case of Pascua Yaqui Tribe v. U.S. Environmental Protection Agency. AJD Review Area Ep hemeral Portion of TC AJD Revie w Area AJD Revie w Area OWB Airport Boulevard Technical Memorandum Purpose and Need – October 2020 1 Technical Memorandum PURPOSE AND NEED Extension of Airport Boulevard (SR 3126) From Garden Square Lane to Chapel Hill Road (NC 54) STIP Project No. TBD, WBS No. 36249.4033 Town of Morrisville, NC October 2020 PROPOSED ACTION The North Carolina Department of Transportation (NCDOT), in cooperation with the Federal Highway Administration (FHWA), proposes to extend Airport Boulevard from its existing terminus at Garden Square Lane to its existing terminus at Chapel Hill Road (NC 54), a distance of approximately 0.8 miles. Construction of the project will complete the current missing link of this route. As shown in Figure 1, the project study area is located in the vicinity of the Town of Morrisville. For right-of-way acquisition and construction, the project is divided into two phases, although an environmental study is being completed for the entire length of the project. Phase 1 of the project is from Garden Square Lane to Church Street (SR 1637) and Phase 2 of the project is from Church Street to Chapel Hill Road. The Town of Morrisville has submitted this Phase 1 of the project, to the Capital Area Metropolitan Planning Organization for Locally Administered Projects Program (LAPP) funding in State Fiscal Year 2022. The Town has entered into an agreement with NCDOT for Division 5 to manage the project. The project is being developed with federal funds under the National Environmental Policy Act (NEPA.) ROADWAY CHARACTERISTICS Airport Boulevard is a major thoroughfare with two existing segments in the Morrisville area—one from Davis Drive (SR 1613) to Garden Square Lane and another from Chapel Hill Road (NC 54) to Aviation Parkway (SR 1002) in the vicinity of the Raleigh Durham International Airport. The existing segment from Chapel Hill Road to Aviation Parkway includes an interchange with I-40. The existing segment of Airport Boulevard between Davis Drive and Garden Square Lane is a four- lane curb and gutter facility with a raised grass median and a shared bicycle lane, and a posted speed of 45 mph. The current project proposes to extend Airport Boulevard from Garden Square Lane to Chapel Hill Road with the same typical section. The project typical section would provide a multi-use use path on one side, a sidewalk on the opposite side, and a five-foot utility strip on each side. The existing segment between Chapel Hill Road and Aviation Parkway is a five-lane facility with a center turn lane, curb and gutter, sidewalks, and a posted speed of 45 mph. Airport Boulevard Technical Memorandum Purpose and Need – October 2020 2 Land uses in the project area southwest of Chapel Hill Road include mainly low- and medium- density suburban residential developments, schools, and small commercial businesses. Northwest of Chapel Hill Road, land uses are characterized by commercial and office developments. THE NEED FOR THE PROJECT The 2019 Town of Morrisville Comprehensive Transportation Plan identifies Airport Boulevard as one of the Town’s strategic corridors, noting its importance in helping to support and manage the Town’s rapid growth. The need for the project arises from the current convoluted traffic patterns necessary to travel between key locations in Morrisville. Key locations include schools, government offices, and businesses along Town Hall Drive, which is another of the Town’s strategic corridors, and along Church Street. Key locations in Morrisville also include the commercial and office developments on the existing segment of Airport Boulevard northwest of Chapel Hill Road. The Town of Morrisville has also identified existing capacity concerns about several intersections on Davis Drive, including the Morrisville-Carpenter Road intersection. The existing convoluted traffic patterns described above also contribute to this concern. The Town’s Comprehensive Transportation Plan also includes a recommended policy of prioritizing “the construction of greenway connections between existing facilities and adjacent neighborhoods.” The Plan also notes that all roadway projects in the Town should “adhere to complete streets concepts”, adding that “the Town should continually strive to close gaps in the pedestrian network.” The Indian Creek Greenway crosses the project corridor between Garden Square Lane and Town Hall Drive, creating the opportunity for Airport Boulevard to connect to the Town’s greenway network. PURPOSE OF PROPOSED ACTION The purpose of the proposed action is to improve overall, multi-modal traffic mobility on the Town of Morrisville’s roadway network and to enhance roadway connectivity between Davis Drive and Chapel Hill Road. The proposed action begins and ends at established roadways and will improve the local roadway network independently of any future projects, providing an alternative route between Davis Drive and Chapel Hill Road. The proposed action also completes a missing link in the Airport Boulevard corridor, which improves connectivity to employment centers in RTP as well as to I-40 and RDU Airport. Secondary benefits of the project would include addressing the Town’s capacity concerns about existing intersections on Davis Drive and fulfilling the Town’s multimodal policy recommendations.
