Lenoir County Permit NC0003760 Return # 2228 Dear Mr. Vincent: The Division of Water Quality received the Application for Modification of INVISTA NPDES Permit # NC0003760. Review of the application by the Stormwater Permitting Unit indicated that there is a potential for contamination of stormwater by organic and inorganic pollutants. Mr. Ken Pickle of the Stormwater Permitting Unit suggested a monitoring plan for new stormwater outfalls as a condition of permit modification. During the conference call (05/20/2005) permittee's representatives and consultants were informed of the new requirements and made a decision to conduct stormwater sampling before the permit modification is made. Therefore, your application is being returned. Please resubmit your application after all information required by the Stormwater Permitting Unit is collected; any additional flow data and chemical composition data should be also included. Please make sure that all submitted forms are signed and dated, and terms that are used in your request are consistent in all the documents. Please refer to the subject permit application number when providing the requested information. Please submit three copies of all information to the address below. "•.". ;+err. n�a,�;".�c"�z Re: Status of Application for Modification NPDES Permit # NC0003760 4695 Highway 11 North Kinston, NC 28501 Dear Mr. Pickle, 5 J U N 1 0 2005 DENR - WATER QUALITY POINT SOURCE BRANCH We would like to thank you for taking time to discuss the status of the NPDES Application for Modification for the former INVISTA facility located in Kinston, NC. As discussed on our phone call on May 19th, INVISTA S.a r.l. (INVISTA) sold the Kinston facility to Unifi Kinston, LLC (Unifi) effective September 30, 2004, which now operates the facility. The real property is still owned by DuPont and leased to Unifi. INVISTA agreed to complete the NPDES permit application process and has retained the services of Conestoga -Rovers and Associates (CRA) to complete this task. The September 2004 application was submitted prior to the sale of the facility and therefore was submitted as a permit to be issued to INVISTA. However, as a result of the sale of the facility, the permit application now needs to be revised to reflect Unifi as the owner and resubmitted with certifications from its Responsible Official. In addition, Unifi has requested that INVISTA and CRA obtain additional stormwater monitoring data to be included with the revised application. It is our understanding from our call on May 19th that DENR is in agreement that this monitoring data should be collected and included for consideration in the permit modification. It is also our understanding that DENR acknowledges that this will result in a delay in submitting the revised application. Mr. Ken Pickle - NC DENR June 2, 2005 Page 2 It is our understanding that DENR will return the September 2004 Application for Modification and that the entire application will need to be resubmitted once revisions are made. INVISTA and CRA will continue to work with Unifi to complete the preparation of the revised application and to address the comments received from DENR. INVISTA will provide the revised application to Unifi for its certifications and for submittal to DENR. A revised application will be prepared and submitted to DENR as soon as practical to address the comments received from your office and to reflect the ownership change from INVISTA to Unifi.
