The Town was accepted into the Association on April 12, 2002. Because the Association as a whole must meet a nutrient load, or cap. individual nutrient limits are not imposed on facilities that are part of the Association. This permit modification eliminates the individual nutrient limits for total phosphorus and total nitrogen. A revised cap based on Scotland Neck's acceptance into the Association will be forwarded to Mr. Malcolm Green at a later date. Please contact Rich Gannon, Environmental Engineer, Nonpoint Source Planning Unit, at (919) 733 - 5083, ext. 356, should you have questions regarding the nutrient cap for the Association. Please fmd enclosed the revised permit pages (Effluent Limitations, Footnotes, Condition A. (3.)). The revised pages should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143- 215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL (Continued) Footnotes: 1. Sample locations: Upstream at least 50 feet, Downstream at least 900 feet. Stream samples shall be grab samples and shall be collected 3/Week during June - September and 1 /Week during the remaining months of the year 2. The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15% of the respective influent value (85% removal). 3. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/1. 4. Residual chlorine should be monitored/limited if chlorine is used as a disinfectant or elsewhere in the process. 5. See Special Condition A. (3.) regarding nutrients. Nutrient limits have been removed based on Scotland Neck's acceptance into the Tar Pamlico Basin Association on April 12, 2002. 6. Chronic Toxicity (Ceriodaphnia dubia) P/F at 90%: February, May, August, and November [see Special Condition A. (2)1. 7. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. There shall be no discharge of floating solids or visible foam in other than trace amounts. NUTRIENT SPECIAL CONDITION Limits on total phosphorus and total nitrogen have not been included at this time because the facility is participating in the nonpoint source trading option outlined in the Tar Pamlico NSW Implementation Strategy Phase II, which was adopted December 8, 1994. If compliance with any element of this strategy, or subsequent approved revisions to the strategy is not maintained, the Division reserves the right to reopen this permit to include nutrient limits. If requirements other than those listed in this permit are adopted as part of a future revision to the strategy, the Division reserves the right to reopen this permit to include these requirements. Specifically, we request that the Total Nitrogen limit of 6.0 mg/land the Total Phosphorus limitation of 1.0 mg/1 be deleted from our Permit. We are making this request as a result of becoming a member of the Tar Pamlico Basin Association on April 12, 2002. A copy of a letter from Mr. Malcom Green, Chairman, of the Basin Association, indicating the Town's acceptance, is attached. The Town has agreed to and will comply with all the conditions of membership. At the next regularly scheduled meeting, the Town Board will adopt a resolution committing the Town to continue to fund and operate the Scotland Neck Wastewater Treatment Plant in a proactive, environmentally effective manner to maximize nutrient removal. I will provide you with a copy of this resolution, upon adoption by the Board. Further, the Board has negotiated a repayment schedule to pay all accumulated back dues to the Basin Association. The accumulated dues are in excess of $35,000.00. This is a significant sum of money to the Town, and demonstrates our commitment to nutrient reduction at our WWTP. I attended the Tar Pam Association meeting 2/21. Scotland Neck made a presentation to the Association, along with their consultant, C.D. Malone, about their efforts at improving the plant and future plans and their desire to get into the Association as soon as possible. They have received some grant money for fixing some problems and the Mayor touted how they knew this was a very important issue now. Paul Blount indicated that he didn't think it was going to be a problem for them to get in, he just wanted to touch base with other members that weren't present before accepting them. An issue Paul raised was that it took DWQ so long to get them nos. on the revised cap after Robersonville decided they needed to join and they (although I can't really recall this very well) didn't let them in the association until after they received the revised numbers. C.D. asked what I needed from them before I could revise the permit and take out the nutrient limits. I told them that I would need a copy of a letter from the Association accepting them into the Association and then a request for a permit mod. from Scotland Neck. Paul said, I think, that they would go ahead and get them in the Association before they got the revised cap nos. from Rich since Scotland Neck is such a small discharger anyway. Nancy Jackson told me today that they still haven't received anything from the Association but she will touch base with Paul again. Anyway...long and short of it is I did hear that the Association is willing to accept them now (without yet receiving the revised nos.). Don't know if that helps you Ken, but Nancy wanted to make sure I relayed this info. to you. Again, we can't change the permit until the Association accepts them in writing. Scotland Neck I'm sure will have to make a commitment to pay Association dues prior to them being accepted. Rich - has the Association requested that you look at revising the cap with Scotland Neck included? Upon attaining membership, the Town will in writing, formally request of the Division that Total Nitrogen and Total Phosphorous monitoring and limits be removed from the subject permit. At receipt of that formal notification, the Division will remove Total Nitrogen and Total Phosphorous from the subject permit. If at any time the membership is cancelled, withdrawn, or not kept current, Total Nitrogen and Total Phosphorous will immediately be reinstated as limits in the subject permit." The Town of Scotland Neck has made application to become a member of the Tar-Pamilco Basin Association and we are hoping to be accepted at their September meeting. That paragraph has been corrected below (with the correction in bold type). The permit, along with the limits presented in the permit, are correct. As stated in the cover letter to the draft permit, nutrient limits for total phosphorus and total nitrogen have been included in this permit due to the nutrient impacts in the Tar Pamlico River Basin. Scotland Neck did not choose to become a member of the Tar Pamlico Nutrient Trading Association and is therefore subject to effluent nutrient limits. The effluent limits of 1 mg/1 and 6 mg/1 for total phosphorus and total nitrogen, respectively, are based on a monthly average [refer to Special Condition A.(3.) of the permit].
