Dear Mr. Powers,
The Pretreatment staff of the Division of Water Resources at the Winston-Salem Regional Office
has reviewed the Pretreatment Annual Report (PAR) covering January through December 2021.
Our review indicates that the PAR is adequate and satisfies the requirements of 15A NCAC
2H .908(b) and the Comprehensive Guidance for North Carolina Pretreatment Programs.
However, in response to information submitted in your report, a Notice of Violation is issued
herein. Per the report, the Industrial User Permit (IUP) for Brakebush Brothers, Inc. was not
renewed prior to expiration on February 1, 2022. This lapse in legal authority constitutes a
violation of NPDES permit NC0021491 and 15A NCAC 02H .0916(c)(2).
It has been noted that remedial actions have already been taken in response to this violation; per
the PAR narrative, Brakebush Brothers, Inc. was placed in SNC for failing to submit a renewal
application within 180 days of the permit expiration date, and the renewal application has since
been submitted and received by the Division (acknowledged March 9, 2022). Thus, no further
action is required of you at this time.
