Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.) The permit authorizes the City of Lexington to discharge up to 6.5 MGD of municipal wastewater from the Lexington Regional WWTP to Abbotts Creek, a class WS-V and B water in the Yadkin -Pee Dee River Basin. The permit includes discharge limitations and/or monitoring for flow, BOD5, ammonia nitrogen, total suspended solids (TSS), dissolved oxygen, total phosphorus, and chronic toxicity, in addition to several metals. The final permit contains the following modifications from your current permit: • The inclusion of Section A.(2). which contains effluent limitations and monitoring requirements for the expansion flow of 6.5 MGD. Please note the changes to monthly average and weekly average limits for ammonia nitrogen, and the daily maximum limits for total mercury and phenols. The reduced ammonia nitrogen limits are given based on current Division guidance for expanding major municipal dischargers. The more stringent limits are for the protection of the receiving stream against ammonia toxicity and oxygen consuming waste. • The inclusion of Section A.(6). for the chronic toxicity permit limitation of 60% at the expansion flow of 6.5 MGD. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. The Permittee shall be provisionally exempted from the instream monitoring requirements specified in paragraph (a) above, so long as the Permittee remains a party in good standing in an active instream monitoring Memorandum of Agreement signed with the Division. If the Permittee's participation in the MOA is terminated, the requirements in paragraph (a) shall be reinstated immediately and automatically. (c) Notification of Terminated Membership. If the Permittee's participation in the MOA is terminated for any reason, the Permittee shall notify the Division in writing within five (5) working days, unless the termination is initiated by the Division. Permit NC0055786 A. (4.) TOTAL PHOSPHORUS MONITORING The Permittee shall calculate the seasonal mass loading of total phosphorus as the sum of monthly loadings, according to the following equations: (a) Monthly Mass Loading (lb/mo) = TP x Q x 8.34 where: TP = the average total phosphorus concentration (mg/L) of the composite samples collected during the month at each outfall Q = the total volume of wastewater discharged during the month at each outfall (MG/mo) 8.34 = conversion factor, from (mg/L X MG) to pounds Seasonal Mass Loading (lb/season) = E (Monthly Mass Loadings) for the season (b) The Permittee shall report the total phosphorus concentration for each sample and the monthly mass loading in the appropriate self -monitoring report and the seasonal mass loading of total phosphorus in the final self -monitoring report for the season. A. (5.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 56.0%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodapbnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Permit NC0055786 Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (6.) NON -DETECTION REPORTING AND DETERMINATION OF COMPLIANCE When pursuant to this permit a pollutant analysis is conducted using an approved analytical protocol with the appropriate minimum detection level and a result of "non -detectable" or "below quantitation limit" is obtained, the Permittee shall record that result as reported. For the purpose of determining compliance with a permit limit for the pollutant, the numerical value of that individual analytical result shall be zero. Permit NC0055786 A. (8.) EFFLUENT POLLUTANT SCAN The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table (using a sufficiently sensitive detection level in accordance with 40 CFR Part 136). Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total recoverable." The current permit was very recently issued in June 18, 2004 after review and approval by DWQ and EPA Region IV. The facility is currently requesting expansion of its existing WWTP from 5.5 MGD to 6.5 MGD. The city has performed a hydraulic analysis of the plant's treatment units and indicates that the plant could handle additional hydraulic loading with modifications to the existing #2 manhole and influent pumps. Process upgrades proposed for the 6.5 MGD expansion include Biological Nutrient Removal, biosolids dewatering, solids contact reactor, and a chemical feed (typically alum) system. Because of the very recent renewal of this permit, the expansion review only: 1) updated the monthly average and weekly average ammonia limits, 2) inserted the expansion flow of 6.5 MGD into the 2004 reasonable potential analysis and updated permit limits for mercury and phenols, 3) updated chronic toxicity limits at the expansion flow of 6.5 MGD. The previous factsheet submitted with the June 18, 2004 permit is attached. Bowden in Aquatic Toxicity Unit: Lexington had a problem in the summer of 2003 with meeting the Whole Effluent Toxicity limit and a civil penalty was assessed. Reasons for the problems were provided in the City's request for remission of the penalty. The City did a very good job in documenting toxicity problems and increased their testing frequency above what was required by DWQ. The eight NOVs that Permit NC0055786 occurred in 2003 were because the City had increased the testing to try to track toxicity reduction and to meet the AQ TOY policy (for monthly testing after a failure). The 2003 NOVs were 3 occurrences in June, 3 in July, and 2 in August. Lexington determined that the toxicity problems were caused by elevated flows during that quarter. Rainfall washed a lot of inert matter into the plant. There were times when the operators turned off the air to the aeration basin. The suspended solids concentration began to washout and they began wasting excess mixed liquor. The City is now back in compliance. They have raised several manholes and gotten rid of the I & I problems. Because the manholes were very low, they had hydraulic overloading. There are no problems now, and Lexington has been compliant since November 2003. The plant went through the wet weather season of 2004 without problems. In 2003, DWQ reviewed Cu and Zn effluent data and there was no reasonable potential to exceed action levels. There were 28 data points and 96% of the values were below detection (27 of 28). COMPLIANCE HISTORY Previous problems with toxicity limit violations have been corrected and the facility has been compliant since November 2003. All tox tests in 2004 have been passed. In 2003 eight Notices of Violation (NOV) were issued for violating toxicity and BOD limits. In 2002 only one NOV was issued for violating toxicity limit. In 2001 two NOVs were issued for violating toxicity limit. In 2000 two NOVs were issued for violating toxicity limit . REASONABLE POTENTIAL ANALYSIS The following parameters are monitored through the permit issued June 2004: Cd, Pb, Hg, Ni, Phenols, Cr, Cu, Zn, and Ag. The following parameters are monitored quarterly through the pretreatment program: As, Cd, Cr, Cu, Pb, Hg, Mo, Ni, Se, Zn, CN. Also, attached is a check for $860 to cover this application for a major permit modification. The city is requesting that the permitted flow be increased from 5.5 to 6.5 MGD. We anticipate that there will be no increase in the present discharge limits for BOD and Total Phosphorous. In 2002, the city retained the services of J.N. Pease Associates to perform a hydraulic analysis of the plant's treatment units (see attached). The analyses showed that the plant could handle the additional hydraulic loading with modifications to the existing #2 manhole and influent pumps. Present construction of BNR facilities at the plant will bypass the #2 manhole. In the heavy rainfall events last year, we were able to sustain influent flows in excess of 14 MGD with the existing pumps while having our largest influent pump out of service. We have however, retained impellors for the influent submersible pumps rated to handle the proposed maximum flows. It is our understanding that two requests for speculative limits have been submitted; one from our consultant and one from HDR on behalf of Davidson County. Over the past couple of years, HDR has been the consulting engineer to Davidson County in a wastewater master plan project that was closely coordinated with the City of Lexington. During the development of that project, we submitted a couple of letters to your organization requesting speculative limits for an expanded City of Lexington WWTP, and a couple of proposed new Davidson County WWTPs. Due to low staff levels and high backlog of work at DENR, those speculative limits request were never acted upon. Davidson County and the City of Lexington completed their wastewater master plan project and now have an agreement for future wastewater service. Thus, the speculative limits requests that were submitted are no longer needed. I learned last week that these letters, from two years ago now, are potentially 'holding up' some efforts that the City of Lexington has underway. We would like to officially withdraw the previous request for speculative limits that were submitted, thereby 'freeing up' your efforts to work with the City of Lexington.
