Box 610 Oakboro, North Carolina 28129 Subject: NPDES Permit Issuance Permit NC0043532 Oakboro WWTP Stanly County Dear Mayor Little: In accordance with the application for discharge permit received, the Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The final permit authorizes the Town of Oakboro to discharge wastewater from the Oakboro WWTP to the Rocky River (outfall 002) and Long Creek (as emergency backup only to outfall 001), class C waters in the Yadkin -Pee Dee River Basin. The permit includes discharge limitations/or monitoring for flow, BOD5, ammonia nitrogen, total suspended solids (TSS), dissolved oxygen, total residual chlorine, fecal coliform, copper and zinc. The Rocky River is not listed on the current North Carolina 303(d) list for impaired streams. However, it may be listed as an impaired stream on the draft 2008 303 (d) list. That listing will indicate that the stream does not meet all water quality standards. If the limitations in the current permits for facilities discharging to Rocky River do not result in improved water quality, removal of discharges to the Rocky River may be necessary for the health of the stream. Although the Division believes land clearing and stormwater runoff are the main causes of degradation to the Rocky River, we will continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a direct cause of stream degradation, the Division will recommend removal of your facility's discharge. Part III of your permit requires you to "continually evaluate all wastewater disposal alternatives and pursue the most environmentally sound alternative of the reasonably cost effective alternatives" to surface water discharge. Effective March 1, 2008, the Division received EPA approval to allow a 50 ug/1 TRC compliance level. This change is due to analytical difficulties with TRC measurements. Facilities will still be required to report actual results on their monthly discharge monitoring report (DMR) submittals, but for compliance purposes, all TRC values below 50 ug/1 will be treated as zero. Additional information has been added to a footnote regarding this change on the effluent limitations page. The following modifications are included in the final permit. • The effluent limit for total lead (at outfall 001 - Long Creek) has been removed from the permit. The results of an analysis on submitted data indicated that there would be no reasonable potential to exceed the stream's water quality standard. There will be no monitoring requirement for lead in the permit. • Quarterly monitoring for total zinc has been added to the permit. An analysis on submitted data indicated a reasonable potential that the water quality action level standard for zinc could be violated in the receiving stream. Quarterly monitoring allows minimal sampling but will provide enough data for evaluation at the next permit renewal. • There has been some modification of the treatment plant components on the supplement to permit cover sheet. Please review this description for correctness. • Please note that there have been minor language changes and the addition of a new paragraph regarding data submittal in special conditions A.3. and A.4. Chronic Toxicity permit limits. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) @ Rocky River The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 4.6%. The permit holder shall perform at a minimum, quarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. Outfall 001 has been properly characterized as being within sub - basin 03-07-13. • Expiration date changed to January 31, 2014. • Remove lead limit/ monitoring requirements for outfall 001 - Long Creek due to lack of reasonable potential to exceed instream standards. Lead data from 2006 and 2008 (2 datapoints) both were nondetectable. RPA showed no reasonable potential to exceed standard. • Add quarterly monitoring requirements for total zinc at Rocky River discharge location (Outfall 002) and Long Creek discharge location due to reasonable potential to exceed instream action level standards. Zinc data from 2006 and 2008 (2 datapoints) both were detectable. Total of two standby generators (dual) NPDES Permit Fact Sheet — 10/20/09 Town of Oakboro WWTP Page 2 NC0043532 2.0 Summary The Town of Oakboro has requested renewal of the existing permit While the facility is currently permitted for 0.9 MGD, past upgrades were completed which allow the facility to accommodate a design flow of 1.2 MGD. Oakboro is now a regional facility, serving the Town of Oakboro, Town of Stanfield and City of Locust. Oakboro's pretreatment program has been inactive since 2001, and none of its tributary communities have pretreatment programs. Upon recent completion of its expansion, the Oakboro WWTP now has two outfall. lines (001 and 002) deriving from the same treatment process. Line 001 to Long Creek is an emergency outfall that would only be used if the pump station to Rocky River fails (outfall 002). The outfalls cannot be used concurrently. The valve that controls outfall 001 is kept secured to avoid accidental discharge to Long Creek. Neither Long Creek nor the Rocky River are listed on the NC 2006 303 (d) list. However the draft 2008 303(d) list has the Rocky River in subbasin 030714 impaired for turbidity. Potential sources are land clearing and stormwater runoff. There are approximately 29 miles of impaired stream. From the 2004 factsheet: The Town of Oakboro is a member of the Yadkin Pee -Dee River Basin Association and is therefore not required to perform instrearn monitoring. There are YPDRBA monitoring stations both upstream and downstream of the Long Creek outfall and a DWQ ambient monitoring station approximately 10 miles downstream of the Rocky River discharge. A 1994 WLA recommends downstream monitoring approximately 1.7 miles downstream (at the end of SR 1659) for DO, fecal, temperature, and conductivity, however this may not be necessanj due to the low IWC (4.6% on Rocky River) Note: In 1993, a QUAL2E model was performed on Rocky River and Mallard Creek to assist with the management of wastewater discharge issued in the upper watershed of the Rocky River. It was recommended that no new or expanded discharges be permitted in the study area unless an evaluation of engineering alternative shows that it is the environmentally sound alterative. If new or expanded discharges are permitted, they will receive BAT technology limits in the watersheds above the confluence of Mallard Creek and the Rocky River, due to severely limited assimilative capacity. Any new or expanding discharge in the lower watersheds of the Rocky River should receive a total BODu(CBOD + NBOD) limit of 32 mg/L or less, equivalent to 10 rng/L BOD5 and 4 nzg/L NH3 for typical domestic discharges. This level of treatment will protect the DO standard as well as preventing any one discharge from exhausting 100% of the available assimilative capacity of the river. 3.0 Compliance Summary WET Testing Results Oakboro performs quarterly WET testing. Currently, tests are conducted at an effluent concentration of 4.6% to represent the 0.9 MGD discharge to Rocky River. From January 2005 to July 2009, the facility has passed all 18 toxicity tests. It is recommended that chronic toxicity testing continue in the renewed permit. The permit also contains a chronic toxicity testing requirement of 30% at the Long Creek outfall if discharge occurs from outfall. This condition will also remain in the permit. Correspondence File Review There were no recurrent problems or deficiencies noted in the correspondence files. From the period of January 2004 to August 2009, there were some permit limit violations. In 2007 and 2009, there were NOVs for BOD, with civil penalties paid. There were also NOVs for ammonia nitrogen issued in 2006. Overall, the Oakboro WWTP has been well operated, however because NPDES Permit Fact Sheet — 10/20/09 Town of Oakboro WWTP Page 3 NC0043532 inadequate plant description and some equipment not being operational, the past two compliance evaluation reports have rated the plant as "not compliant". Reasonable Potential Analysis A RPA were performed primarily for copper using DMR data from January 2006 through August 2009. Although data was minimum (2 datapoints), RPA was also done for lead, zinc, cadmium, chromium, nickel and mercury. There was data reported for magnesium, however due to lack of NC state standard or federal criteria, there was no RPA done on this data. Analyses were completed for both Rocky River and Long Creek. Since both outfalls receive effluent from the same waste -stream, the same DMR data was used for analyses at both locations. Results of the RPAs are as follows: • Monitoring data showed reasonable potential for the discharge to exceed the copper water quality standard. Since copper is an action level parameter the permittee will not receive a limit unless it fails WET tests and copper is identified as the cause. The twice - monthly monitoring requirement will remain in the permit for both the Long Creek and Rocky River outfalls.. • Monitoring data showed no reasonable potential for the discharge to exceed the lead, cadmium, chromium, nickel and mercury water quality standards in either Rocky River or Long Creek. Although data was minimal (two datapoints for each parameter), will recommend no monitoring for any of the above parameters. Based on the RPA results will recommend removal of lead limit at the Long Creek outfall 001. • The monitoring data did show reasonable potential for the discharge to exceed the zinc action level standard on Rocky River and Long Creek. Common and abundant indicator taxa such as Caenis , Argia , Helisoma , Physella and two species of leeches suggest that low DO may be a stressor in this reach. Intolerant taxa found in 2006 include Psephenus herricki (TV=2.4), Leucrocuta (TV=2.4), Stenonema lenati (TV= 2.3) and Pyralidae (TV=2). Thousands of the snail, Amnicola, covered the rocks. Data Analysis Albemarle's WWTP is located above this site and its discharge makes up much of the flow. The water had a red tinge in 2006 as has been noted in prior sampling. The rating at this location has increased from Fair in 1983 to Good in 2006. However, over the past 10 years, the biotic Index has remained fairly stable, with changes in the number of EPT taxa making the slight increase in bioclassification from Good -Fair to Good. PART IV - EVALUATION AND RECOMMENDATIONS The Town of Oakboro is requesting the renewal of the subject NPDES permit. There have been no changes to the existing WWT facility or the permit since the permit was last renewed. The Town continues to use the outfall to the Rocky River (outfall 002) as its primary discharge point and outfall 001 (Long Creek) will be retained as a back up. The Town continues to receive municipal wastewater from the Towns of Stanfield and Locust. Excessive I/I flow from a main segment of the Town's sewer collection system has resulted in numerous SSOs in recent months. The Town is attempting to alleviate future SSOs by installing a parallel line that will enable the Town to receive the additional flow, however, changes may be necessary at the WWTP that will allow the plant to process the additional wastewater without compromising treatment efficiency and effluent compliance. The conversion of an existing (but currently unused) aeration basin into an EQ basin is one option that the Town may choose to explore.
