This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994. We regret the delay in processing the City's application. Notice of the draft permit was published once in The Lexington Dispatch on June 5, 2001, and your June 29 letter was the only response to the draft permit during the 30-day public comment period. However, the Division has been unable to issue approximately 40 municipal permits due to programmatic issues raised by the EPA Region 4 staff. The issues specific to Lexington's permit have now been resolved. The final permit issued today includes the following changes from the draft permit: • Comment: Nitrogen Limits. The draft permit included effluent limitations for Total Nitrogen. An earlier wasteload allocation recommended these limits, but the nutrient strategy for High Rock Lake now focuses on Total Phosphorus as the limiting nutrient. Action: The nitrogen limits have been deleted from Condition A.(1.) of the permit (the "effluent sheet"), and the monitoring frequency has been reduced to monthly as in the previous permit. • Comment: Phosphorus Limits. The draft permit does not specify the effective date of the Total Phosphorus limits. To be consistent with the Yadkin -Pee Dee Basin -Wide Water Quality Management Plan (the Plan), the limits should take effect in 2004. Because the limits are seasonal mass limits, the effective date should coincide with the start of the summer or winter season (as defined in the permit) and prior to expiration of the new permit. The nutrient control strategy for the Abbotts Creek Arm of High Rock Lake calls for phosphorus limits for Lexington, Thomasville, and High Point. It sets individual mass limits for each of the three facilities. The collective limit represents the maximum acceptable load and is, in effect, a phosphorus cap on the point source discharges. The Division applauds the City's willingness to provide sewer to those facilities with failing treatment systems. However, an increase in Lexington's phosphorus limit would require a corresponding decrease in the limits for Thomasville and High Point. Action: No change in the permit. • Comment: Cyanide Monitoring. Cyanide was not detected in the plant's treated effluent during the most recent 13 quarters of monitoring. As a result, there appears to be no reasonable potential for the City's discharge to cause an exceedance of the water quality standards for cyanide. The City will continue to monitor the parameter under its pretreatment program's Long -Term Monitoring Plan. Action: The monitoring requirements for cyanide have been deleted from Condition A.(1.) of the permit. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699- 6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. The Division may require modification or revocation and reissuance of the permit. The Permittee shall be provisionally exempted from the instream monitoring requirements specified in paragraph (a) above, so long as the Permittee remains a party in good standing in an active instream monitoring Memorandum of Agreement signed with the Division. If the Permittee's participation in the MOA is terminated, the requirements in paragraph (a) shall be reinstated immediately and automatically. (c) Notification of Terminated Membership. If the Permittee's participation in the MOA is terminated for any reason, the Permittee shall notify the Division in writing within five (5) working days, unless the termination is initiated by the Division. TOTAL PHOSPHORUS MONITORING The Permittee shall calculate the seasonal mass loading of total phosphorus as the sum of monthly loadings, according to the following equations: (a) Monthly Mass Loading (lb/mo) = TP x Q x 8.34 where: TP = the average total phosphorus concentration (mg/L) of the composite samples collected during the month at each outfall Q = the total volume of wastewater discharged during the month at each outfall (MG/mo) 8.34 = conversion factor, from (mg/L X MG) to pounds (b) Seasonal Mass Loading (lb/season) = E (Monthly Mass Loadings) for the season The Permittee shall report the total phosphorus concentration for each sample and the monthly mass loading in the appropriate self -monitoring report and the seasonal mass loading of total phosphorus in the final self -monitoring report for the season. A. (4.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 56.0%. The permit holder shall perform at a minimum, quarterly monitoring using test. procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Permit NC0055786 Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (5.) NON -DETECTION REPORTING AND DETERMINATION OF COMPLIANCE When pursuant to this permit a pollutant analysis is conducted using an approved analytical protocol with the appropriate minimum detection level and a result of "non -detectable" or "below quantitation limit" is obtained, the Permittee shall record that result as reported. For the purpose of determining compliance with a permit limit for the pollutant, the numerical value of that individual analytical result shall be zero. The principle change is the addition of phosphorus limits in order to address eutrophication in Abbotts Creek and High Rock Lake. BACKGROUND Facility Overview The City of Lexington owns and operates a 5.5 MGD, activated sludge wastewater treatment plant. The plant consists of two influent pump stations, flow measurement and recording, mechanical bar screen, grit collection, two primary clarifiers, two trickling filters, six aeration basins, two secondary clarifiers, two polishing lagoons, chlorination, chlorine contact chamber, and outfall to Abbotts Creek. Sludge handling consists of four anaerobic digesters (two primaries, one secondary, and one storage) and drying beds. Sludge is dewatered using a belt filter press and then composted. Composted sludge is stored on drying beds. The treatment plant was modified in recent years to replace screw pumps at the influent lift station(s) with submersible pumps. The City administers an industrial pretreatment program to control the discharge of industrial and commercial wastes into its collection system and treatment works. Industrial sources include three Significant Industrial Users, one of which is a Categorical Industrial User. Permit History The City's NPDES Permit NC0055786 was last issued on April 26, 1994. Since that time, the permit has been modified as follows: • The limits for mercury and lead have been removed. 4 FACT SHEET - NPDES PERMIT City of Lexington Page 2 NPDES No. NC0055786 • The monitoring frequencies for cadmium, lead, nickel, and mercury have been changed from weekly to twice per month. • The toxicity test language was updated to a more recent version, November 1995. • The footnote pertaining to weekly monitoring of lead and mercury has been removed. • Instream monitoring requirements were waived; as part of a Memorandum of Understanding with Yadkin discharger, the Division waived the permit requirements, to be replaced by a monitoring program administered collectively by the dischargers. The permit was originally set to expire September 30, 1998. The Division administratively extended the permit to April 30, 1999, in order to align its renewal date with other permits in the river basin. The City submitted its application for renewal in February, 1998, and continues to operate under the existing permit. Water Quality The Lexington WWTP discharges treated municipal wastewater to Abbotts Creek, a Class WS-V and B water in the Yadkin -Pee Dee River basin. The Division rates Abbotts Creek as Support Threatened, due to impacts on water quality from both point and nonpoint sources in the drainage area. In 1993, the Division developed a field - calibrated QUAL2E model of Hamby Creek and Abbotts Creek below Thomasville. The model indicated that these streams have little capacity for oxygen -consuming wastes. Nutrients, particularly phosphorus, heavily impact the Abbotts Creek Arm of High Rock Lake. The Division updated its management strategy for the watershed in 1997 (Yadkin -Pee Dee River Basinwide Water Quality Management Plan, May 1998). It recommended that (1) no new dischargers of oxygen -consuming wastes be permitted in the watershed, (2) existing point source dischargers in this drainage must significantly reduce nutrient discharges, and (3) the dischargers must within one year conduct an operations optimization study for nutrient reduction. In a 9/23/97 memo from Steve Tedder to Preston Howard, the Division proposed a nutrient control strategy for the major dischargers into the Abbotts Creek Arm of High Rock Lake (Lexington, Thomasville, and High Point). The Division notified the City of this strategy when the permit was modified in 1998 and in several other discussions in recent years. Compliance History The City has a very good compliance record in the current permit term. Inspections by the Winston- Salem Regional Office indicate the facility is being operated consistently and effectively. The City's discharge monitoring reports indicate that violations of effluent limitations are infrequent at the most. Samples collected by the Region during its inspections have verified compliance with permit limits. The treatment plant passed all effluent toxicity tests for the years 1996-98 but failed three tests in 1999-2000, all in the late summer months. PROPOSED PERMIT REQUIREMENTS Most of the effluent limitations, monitoring requirements, and special conditions in the draft permit are the same as in the current permit. Table 1 summarizes the existing and proposed requirements and highlights the proposed changes. The table also notes the basis for these requirements. The most significant change is the addition of effluent limits for total phosphorus. The proposed limits are based on the Division's nutrient control strategy for the Abbotts Creek/ Hamby Creek drainage areas. The strategy calls for mass limits equivalent to a concentration of 0.5 mg/L TP at the FACT SHEET - NPDES PERMIT City of Lexington Page 3 NPDES No. NC0055786 5.5 MGD permitted flow, with seasons of 214 days (Apr -Oct) and 151 days (Nov -Mar). Total nitrogen will continue to be monitored but not limited. The limits and monitoring requirements for metals and cyanide are based on a reasonable potential analysis of 1997-2001 effluent data, which were collected by the City's pretreatment program under to its Long -Term Monitoring Plan (LIMP). The analysis indicates that no changes in limits and monitoring requirements are warranted at this time. However, the analysis was based on stream flow data from past Wasteload Allocations, which are higher than more recent flow estimates. It is the NPDES Unit's policy in this situation to continue using the original flow values until the Permittee requests a plant expansion or upgrade. Dilution calculations indicate that the City's discharge could cause an exceedance of North Carolina's water quality standard for chlorine (17 ug/L), using the revised flow estimates. As with metals, the original values will be used until plant modifications prompt a full analysis of the limits. The permit proposes monthly monitoring for phenolic compounds. Abbotts Creek is classified as a Water Supply water, for which the state has a water quality standard of 1.0 ug/L to protect aesthetics (taste and odor in the water and in tainted fish). At present, there are not enough data for Lexington's discharge to determine whether or not a limit is appropriate. Monitoring under the new permit will provide the data needed to conduct a reasonable potential analysis for phenols. The City's June 29 comment letter was the only response to the draft permit during the 30- day public comment period. The final permit includes the following changes from the draft permit: • Nitrogen Limits. The draft permit included effluent limitations for Total Nitrogen. An earlier wasteload allocation recommended these limits, but the nutrient strategy for High Rock Lake now focuses on Total Phosphorus as the limiting nutrient. Action: The nitrogen limits have been deleted from Condition A.(1.) of the permit (the "effluent sheet"), and the monitoring frequency has been reduced to monthly as in the previous permit. • Phosphorus Limits. The draft permit does not specify the effective date of the Total Phosphorus limits. To be consistent with the Yadkin Pee Dee Basin -Fide Water 0Quality Management Plan (the Plan), the limits should take effect in 2004. Because the limits are seasonal mass limits, the effective date should coincide with the start of the summer or winter season (as defined in the permit) and prior to expiration of the new permit. Action: Condition A.(1.) has been modified to specify that the effective date of the Total Phosphorus limits is April 1, 2004. • Phosphorus Limits: Credits. The nutrient control strategy for the Abbotts Creek Arm of High Rock Lake calls for phosphorus limits for Lexington, Thomasville, and High Point. It sets individual mass limits for each of the three facilities. The collective limit represents the maximum acceptable load and is, in effect, a phosphorus cap on the point source discharges. The Division applauds the City's willingness to provide sewer to those facilities with failing treatment systems. However, an increase in Lexington's phosphorus limit would require a corresponding decrease in the limits for Thomasville and High Point. Action: No change in the permit. • Cyanide Monitoring. Cyanide was not detected in the plant's treated effluent during the most recent 13 quarters of monitoring. As a result, there appears to be no reasonable potential for the City's discharge to cause an exceedance of the water quality standards for cyanide. The City will continue to monitor the parameter under its pretreatment program's Long -Term Monitoring Plan. Action: The monitoring requirements for cyanide have been deleted from Condition A.(1.) of the permit. EPA REVIEW OF DRAFT PERMIT Lexington was one of 40+ major NPDES permits delayed when EPA Region 4 raised concerns in July 2001 over the adequacy of North Carolina's application for municipal permits. The permit was released for issuance in January 2002 when it was pointed out that the City had used an approved form in applying for permit renewal. Phosphorous Limits: I would request that these be implemented in the next permitting cycle or be made enforceable at the expiration date of this permit when implemented - April 30, 2004. This will give the City necessary time to fund and construct the facilities necessary to comply with the proposed limits. In the period since the last issuance of this permit, our staff has made every effort to optimize the plant's operation to reduce phosphorous in its discharge. It is our staff s determination that this cannot be done effectively without construction. In good faith, I cannot justify to the Lexington City Council the need for an expenditure of this magnitude unless there is a mandated deadline. Implementing this time schedule would be consistent with the adopted Yadkin - Pee Dee Basin Wide Water Quality Management Plan. It would also be consistent with presentations made by various DENR modelers and planners to the Yadkin -Pee Dee River Basin Association, which indicated that these limits would be in effect in the 2004 permitting cycle. Phosphorous Mass Limits For and Increased Design Capacity: I would request a determination of the mass limits for phosphorous in our discharge if the plant's design capacity were to be increased from 5.5 to 6.0 mgd. Lexington is working with Davidson County to provide sewer to schools and areas with failing septic tanks and wishes credit for this work. It is our contention that the mass limits should be increased proportionately to the design flow increase (if made). We feel that an increase this small would still be consistent with the goals set forth in the adopted Yadkin -Pee Dee Basin Wide Water Quality Management Plan. This would preclude a penalty for correcting existing environmental problems in our basin. In case of capacity increases to respond to future development, we would expect the mass limit for phosphorous to not increase. Cyanide Monitoring: The City has been monitoring for this on a quarterly basis. All samples from 1997 showed levels below the detection limit for cyanide. Permit No. NC0055786 SPECIAL CONDITIONS continued 6 CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the `North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 56.0% (defined as treatment two in the procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of February, May, August, and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Because of the implementation of basin wide permitting, the permit renewal has been delayed until the middle of 1999. In our renewal application I requested that the limits and monitoring for mercury and lead be dropped upon renewal. Because of the delay in renewal, I am requesting that the limits for these metals be dropped from the permit. I do agree to continue monitoring these metals until the permit is renewed. Removed limits and changed the monitoring frequency from weekly to 2/month. Removed the following footnote pertaining to sampling of lead and mercury: "The permittee may choose to collect 5 samples for the week and base the number of analysis run on the outcome of the first sample. If the first sample is in compliance with the weekly average limit, then no more analyses need be run for that week. If the first sample is above the weekly average, then subsequent samples shall be analyzed and compliance with both the weekly average and daily maximum limits shall be required."
