Dear Mr. Harris:
Reference the Department of the Army (DA) permit issued to the North Carolina
Department of Transportation (NCDOT) on December 23, 2019, and subsequently
modified on February 11, 2020, June 11, 2020, and October 1, 2020. The permit
authorizes the discharge of fill material into waters of the United States, for construction
of the 1-40 improvements, TIPs 1-5111 and 1-4739, from 1-440/US 64 in Raleigh, to SR
1010 (Cleveland Road) in Clayton, Wake and Johnston Counties, North Carolina.
Also, please reference your January 21, 2022, request/letter, submitting a
modification request for the following permit sites/impacts:
Site 1: two (2) 42" pipes will not be replaced.
• 13 linear feet decrease in permanent stream impacts
• 14 linear feet decrease in temporary stream impacts
Site 44: flow will be left in temporary diversion channel for stability.
• 11 linear feet increase of permanent channel bed/bank stabilization
• 11 linear feet decrease of temporary stream impacts
• 0.01 acre increase mechanized land clearing
Site 47 and 48: Based on field conditions, pipe placement adjusted, larger
permanent drainage easement (PDE) required, installation of berm.
• (Site 47) 35 linear feet increase of permanent stream impact (channel
bed/bank stabilization)
• (Site 47) 24 linear feet decrease of permanent bank stabilization
• (Site 47) 11 linear feet decrease of temporary stream impacts
• (Site 48) 69 linear feet increase permanent stream impacts (pipe)
• (Site 48) 51 linear feet decrease of temporary stream impacts

The Corps has completed the evaluation of your request and has determined that
it is appropriate and reasonable, and a public notice is not required for this modification.
Furthermore, we have determined the proposed project modifications described above
are not contrary to the public interest and are consistent with the 404 (B) (1) Guidelines
and therefore, the DA permit is hereby modified. The authorized work shall be
completed in accordance with the attached revised permit drawings sheets 3,7, 9, 10,
91 and 92 of 125 revised on November 11, 2021, and the Wetland and Surface Water
Impact Summary Sheets 120, 124 and 125 of 125 revised on July 13, 2021, December
14, 2021, and November 19, 2021, respectively. As there are an additional 102 linear
feet of permanent stream impacts, compensatory mitigation is required at a 2:1 ratio for
the permanent stream impacts associated with this modification. Compensatory
mitigation must be completed as indicated in Special Condition 14 of your permit. An
additional Mitigation Responsibility Transfer Form is attached to this modification.
Special Condition 1 is modified as follows:
1. Work Limits: All work authorized by this permit shall be performed in strict
compliance with the original and revised permit drawings (original submitted on May 7,
2019, and mod drawings last revised on December 12, 2019, May 28, 2020, July 2020,
August 2020 and January 2022), which are a part of this permit. The Permittee shall
ensure that the construction design plans for this project do not deviate from the permit
plans attached to this authorization. Any modification to the attached permit plans must
be approved by the U.S. Army Corps of Engineers (Corps) prior to any active
construction in waters or wetlands.
All other conditions of the original permit and previous modifications remain
applicable, and the expiration date is unchanged.
This approved modification should be attached to the original permit and will be
utilized for future compliance reviews of the project. If you have questions, please
