We recently had a discussion with our regional offices about this, and I forgot to circle back after that. The conclusion was that normally the Tiers and benchmark exceedance count starts back over at the new renewal of the General Permit. This means the permittee should sample quarterly (new schedule for most permits) and follow tier responses as needed. The count of exceedances starts over at the new permit effective date, so consecutive exceedances won't happen until at least two quarters in. We do understand some sites may be headed for the same pattern and will have to engage the regional office again. The exception is when Tier relief from more frequent monitoring is granted very close to the end of a permit cycle (within the last six months). Then the Region's letter should address it specifically and extend the relief from monthly monitoring into the new permit cycle if they deem it appropriate. It is the opposite scenario that I remembered persisting into the next permit. Our permits have language that explain a permittee should continue monthly monitoring if in Tier 2 or 3 already when the new permit starts. I don't think the text does addresses the situation when tier relief from monthly monitoring has been granted previously. I hope this helps clarify things. Thank you for reaching back out to me. We are stretched a little thin these days! I believe the Tier relief was meant to persist at renewal as long as the circumstances haven't changed, but I'll need to look into it further. Good Afternoon, My name is Madison Paul and I am the Environmental Engineer in charge of Stormwater at Wolfspeed's two facilities in NC (4600 Silicon Dr., Durham & 3028 E. Cornwallis Dr. RTP) Currently, these two facilities have exemption for Copper and Zinc when it comes to our stormwater sampling (see attached letters). They were issued to us back in 2014/2015. Could you help out with clarifying the language in the letter about when/if this exemption has an expiration date? If the exemption does have an expiration, could we process a request to renew the exemption? Based on our sampling over time, we are still experiencing higher levels of Cu and Zn at our sampling points. Our operations have changed, however, we do not have any processes that produce any dusts/exhausts of Cu or Zn that could impact our stormwater outfalls.
