Dear Mr. Lekson,
Pursuant to discussions held with Raleigh Bland and Josh Pelletier of your office on
September 26, 2006, attached is an application for a Corps of Engineers permit being submitted on
behalf of the non-profit Ryland Ruritan Club. This application is for after-the-fact work that has
been completed to restore the Brownrigg-Dillard's Mill Pond Dam at Indian Creek near NC State
Road 1226 in Chowan County.
As was described at the site to your field agents, Chowan County was approached by the
Ryland Ruritan Club and asked to sponsor a grant application to the NC DENR Division of Water
Resources to fund proposed restoration work. The Ruritan Club had already received a "Certificate
of Exemption" from the NC Division of Coastal Management after coordinating specific
comments and recommendations from both the US Fish and Wildlife Service and the NC Division
of Marine Fisheries. The Club's purpose was to restore the dam, raise the mill pond's water level
approximately twenty inches, and thereby create an enhanced amenity for public enjoyment.
Chowan County agreed to sponsor such a grant application and to serve as fiscal agent for the
awarded funds during the Club's actual project work.
As you can see from the additional included documentation which was also shared with
Mr. Bland and Mr. Pelletier, the Ryland Ruritan Club's Project Coordinator had, prior to
commencing restoration work, requested and received written and in-person input from the US
Fish Wildlife Service, the NC Division of Marine Fisheries, and the NC Division of Coastal
Management. Specifically, the US Fish and Wildlife Service supplied him with an actual
recommended design for a fish ladder. Although certainly not an excuse from the legal
requirement to seek all necessary permits whether local, state, or federal, the Ruritan Club's
Project Coordinator was under the logical impression based on all the cooperation he was getting
from these agencies, that no further permits were required. Also, the Ruritan Club's Project
Coordinator, Doug Hollowell, and Chowan County Manager Cliff Copeland, have both assured
me that at no time previous to this project have they ever been aware that any citizens, groups, or
local governments had any previous discussions with the Corps of Engineers about possible
activities at the site which might require a federal permit.
I acknowledge your letter dated September 28, 2006 advising of the duty to cease and
desist from further activities at this site which might constitute a violation of Section 301 of the
Clean Water Act, and which you copied to various other federal and state agencies as well as to
the US Attorney and the US Environmental Protection Agency as indicated below. I look, forward
to a response from your office as to the submitted permit application and am available at anytime

Brownri~~-Dillard's Millpond Dam Restoration Project Narrative
The Brownrigg-Dillard's Millpond is a reservoir of Indian Creek which is a
tributary of the Chowan River. The original dam was constructed in 1762 and harnessed
power for two millhouses on either end of the dam, housing a sawmill and a gristmill
respectively. Those structures were lost in the early 1900s. Since that time, corn has been
commercially ground into meal in an adjacent diesel-powered mill house. The portions of
the dam supporting the two original mill houses have long been lost. As a result, the level
of the original mill pond is approximately 4 ft. lower than when the dam was intact. The
project anticipates rehabilitating the dam, consistent with an already issued CAMA
permit, by installing engineered wooden and steel material in the vacant areas, along with
piping approved by the Wildlife Resources Commission and the U.S. Fish and Wildlife
Service. The earthen dam still in existence would remain. The surrounding area which is
currently privately owned would become a natural area and made subject to a
conservation easement granted by the private landowners to Chowan County, wherein
one condition would provide for the perpetual access and egress of the public to the dam
and to the waters of the millpond. The mouth of Indian Creek is approximately three
miles south of the NC Wildlife Resources boat ramp at Cannons ferry Road and Chowan
County's Cannons Ferry Riverwalk (canoe launch area) on the Chowan River, as well as
approximately six miles south of Chowan County's Holladay's Island camping platforms.
These amenities make the Brownrigg-Dillard's Millpond natural area an ideal location to
include on paddling trails. Paddlers would enjoy a 2.5 mile paddle up Indian Creek form
the Chowan River to the millpond where itinerant camping for paddlers would be
allowed in the natural azea.
Criteria for consideration for this water-based recreation site:
(1) Economic, social and environmental benefits to be provided: The completion of
this project would greatly enhance the cultural tourism industry of Chowan
County. It would complement the other attractions of the area and continue to
draw, naturalists, birders, paddlers, photographers, artists, campers, and fishermen
to the immediate azea.
(2) Regional benefits: The inclusion of this site into an already growing paddling
trails program will greatly enhance the economic impact on the Albemarle and
Roanoke-Chowan regions. Residential development in these two regions
continues to grow at a rapid pace. By preserving the millpond and surrounding
area as a natural area, these two regions benefit by claiming such an asset as an
attractive amenity for enhancing quality of life.
(3) Financial Resources of Chowan County: A political subdivision of the State,
Chowan County is solvent, enjoys superior financial ratings, and has taxing
authority to meet its operating expenses if necessary. Chowan County has a
proven track record in meeting all grant match obligations.

(4) Environmental impact of the project• This project will restore the biological
viability of a water body by raising the water to levels which enhance the
reproduction offish, mammals, and plant-life associated with such a body. The
establishment of a conservation easement over surrounding properties ensures that
no further development will occur on that portion of property surrounding the
millpond, thereby insuring that water quality will not be degraded by run-off at
least from that protected site.
(5) Direct benefit to State-owned lands: The establishment of this area as a natural
area with public access compliments the nearby Cannons Ferry Wildlife
Resources boat ramp. The environmental impact also positively enhances the
State's public waters of Indian Creek and the Chowan River.

DILLARD'S MILL POND RESTORATION
The Dillard's Mill dam was constructed in 1762 and has enriched the Chowan County
community and State in many ways. The dam once housed a sawmill and grist mill which
were generated from the releasing of water accumulated within the pond across wheels that
served as turbines. Over time both mills were lost to the elements which left breeches on
the north end (50 feet) and southern end (30 feet) of the existing dam. The dam will
provide statewide recreational use of its waters to boaters, hunters and fishermen. The
pond will also serve ecologically as a sediment accumulator for runoff from smaller
streams and fields upstream.
The Ryland Ruitan Club in Tyner, NC felt the dam and pond's restoration would create
recreational uses, pride to our community and a positive influence for our
children grandchildren's lives. Our Ruftan Club is small with limited financial resources to
underwrite the project's costs; however we can provide man power when necessary to
ensure the repairs completion date.
Our plan involves and/or includes the following:
1. CAMA -Repair permit dated 1/17/05 and extended 3/17/05 to 6/17/05. We
anticipate a further extension for ninety (90) days.
2. U.S. Fish and Wildlife Service -Assistance is repair design to dam and emergency
spillways.
3. Repairs Involving-
a. 64" x 43" x 40' elliptical pipe with baffles every ten feet to create a fish
ladder (a CAMA condition).
b~ Two 6' x 40' round pipe placed on each side of elliptical pipe with flash
board risers. Water depth control before advancing hurricanes would
prevent wash outs.
c. Emergency spillways on both ends of the dam of approximately 25' - 50'
for emergency situations.
d. Footbridges, steps and railings to make the dam accessible to all visitors,
including those handicapped or disabled.

e. Site staging area for accumulation of materials and equipment has been
completed. This involved land clearing, leveling and securing of dam fill
material adjacent to site.
f. Implementation and securing of dam is estimated to not exceed two weeks.
Footbridges, steps and railings will be installed by our club and estimated
_ completion time will mirror dam completion.
g. Rock to prevent washing on western side of pipe will be required; however,
exact tonnage is not known.

I appreciate and thank you for your time and courtesies extended to
me this morning on behalf of the Dillard's Mill Pond re+t effort, the
properly owners (Mr. Byrum and Mr. Lane) and the Ruitan Club.
We are eager to see this two hundred year old datrt ~ to it's
natural state with the many benefits it can provide to tit# Citizens of
Chowan County.
In accordance with our discussion, please note ~e fo~owing
descriptive comments regarding the Dillard's 1~1 Pond Project:
1. Description of Dam
An earthen dam conting approxicrtately 75 acres, where
Indian Creek headwatet'e accumulate in an area three
quarters of a mile long utd two huncked Yards across at its
widest point. Dumping [into Dillard's Creek at the Diflard's
Mill Dam, it's waters meander for two or three miles along
uninhabited shoreline before reaching the Arrowhead
community where it is one quarter of a mile from the
Chowan River.
The dam is approximately 600 feet in length, three to six
feet in width and fifteen feet in height (bottom of pond to
the top of the dam).

The southern most breach is approximately twenty-five (25') feet across and forty-five (45')
feet from the most southern point of the dam. A grist mill powered by the pond's water was
originally located on this site.
The northern most breach is approximately fifty (50') feet across and forty-five (45') feet
from the most northern point of the dam. A saw mill powered by the pond's water was
originally located on this site.
The water level throughout the pond is normally so low that navigation is not possible by
boat. The current water level at both breach points is six or seven feet. The desired water
level increase is not to exceed three feet above the existing water level. Any higher water
level could not be considered since the land owners still operate a business at the southern
fort of the dam.
2. Repair and Restoration Alternatives
Alternative 1:
Our repair effort involves sheet pilings (twenty-five feet long) to be driven parallel to each
breach but eight feet west of the dam. The sheet metal on each end will then be angled
back to the solid earthen dam at a point ten foot from each breach. A concrete spillway will
be poured across the sheet metal at the desired height. Ballast stone will then be placed
against the west side of the sheet piling to keep same in place and solid.
One overhead crane can accommodate the repair efforts and the landowners adjacent to the
northern breach have verbally agreed to allow access across their land.
Alternative 2:
Amore cost effective approach discussed with the Soil and Water Conservation Office has
been the construction of a V-shaped rock berm to create the desired height for both
breaches. The equipment requirements can be reduced as well as the construction period.
3. Benefits from Pond Restoration
Several landowners adjacent to the pond could benefit with the possibility of irrigation.
The recreational benefit and use for our county's citizens and their children would be
priceless.
Our creek and river would benefit decisively from sediment containment provided by the
pond's restoration.

The North Carolina Division of Marine Fisheries has reviewed the information
concerning the Dillard's Mitl Pond Project and submits the following comments.
Dillard's Creek is a documented spawningtazat on through numeroub spawningg
and alewife. The Division has documented the u ellow perch, catfishes-and other
area surveys. Resident species such as white perch, y
commercially and recreationally important species also utilize the area for spawning and
nursery:

spawning habitat for these species.

spawning areas. Mr. Mike Wicker, US Fish and Wildlife Service, Ecological Services in
Raleigh (919-856-4520, Ext. 22) has been involved with many fishway proposals. I
have talked with Mike, this morning and he is willing to work with the property owners
and the Ryland Ruritan Club on a fishway design. There are several different designs,
that are possible at a low cost.
Repairing the breaches in the dam, coupled with installation of a fishway, will
benefit not only the various species of fish, the habitat, water quality and the citizens of
the area. The Division supports this proposal with the installation of a fishway.
Since Dillard's Creek is a documented spawning and nursery area, this agency
would request an inwater construction moratorium, from February 15 through June 30.
This will ensure the environmental integrity of the area is protected during critical times
of usage by the previously mentioned species.

Met with Mike Wicker with the US Fish & Wildlife Service regarding a fish ladder proposal that
had been suggested by Mrs. Sarah Winslow with the Elizabeth City office as a possible
requirement before issuing our permit to repair Dillard Mill breaches. Mike was on time, in fact
he was a little early and we proceeded directly to the head waters of Indian Creek. I showed him
the bridge at Ballard's Bridge Church went directly to the pond and spent quite a bit of time
there. He suggested that in lieu of she~t piling or a rock weir that we might want to consider
using fill to go across the breeches and installing pipe. Some of that pipe would be oblique and
that the section up close to the mill where the grist mill used to be, that perhaps that would be
where the level of the pond would be maintained with 2 or 3 pipes, and perhaps having another
pipe that would be slightly below those where water would be flowing year round as a inlet and
outlet for fish coming up to spawn, which seems to be Mrs. Window's real issue. Mike also
suggested that the larger opening where the saw mill used to be behind Mr. Walter's house, that
that would be a good place to have an emergency release pipe, maybe 3 or 4 large or oblique
pipes there, and that level would be about a foot above the others so that in case of hurricanes or
unusual water shed, the dam would not be in jeopardy. One of the keys he talked about was the
fact that we needed to have a good survey with a land instrument, not necessarily using a GPS,
so that we make sure that these pipes were in it at desired levels and that no settling would occur.
We finished with lunch at Nixon's and he stated then that he would contact Mrs. Winslow
concerning our meeting and then he would call me with the results.
December 10, 2004 -
As of this morning I have not heard from Mike or Sarah, so I stopped by the CAMA office and
Frank Jennings was on the outside, he took me into Mrs. Window's office and her comments to
me was (1) that Mike had not called her and (2) she had not been in the office on regular a basis
(3) that she had dipped herring out of the mill pond, so she knew that they had been in there at
some point in time (4) that she wanted the s, specs, .openings, drawings of the proposal that
Mike and I talked about before she would ake any comments yea or neigh.

I spoke with Mike Wicker at approximately 4:45 P.M. on December 15, 2004. The j~
of our conversation was that:
(1) He has spoken with Sarah Winslow and that she would like for him to send
conceptual drawings to me, for me to include with a letter back to CAMA as to our final
position and from that they will then render a decision.
(2) Mike has thought more about the concept of pipe using baffles and he seems to think
that this may not be the best solution, that it may entail the pipes becoming clogged and
somebody having to go in to clean them out and that's not a good situation.
(3) He has thought more about using smaller pipes that would be sloped from the inside
portion of the dam to the outside towards the bridge that would be two or three feet in
diameter and having them slightly sloped so that water levels on both sides would be in
contact. He also thought that this would probably be a cheaper solution than the previous
because this black PVC pipe that you can buy is fairly inexpensive. He also felt that this
smaller pipe would create a situation where there would be six to ten inches of water that
would be flowing all the time, but would not have any detrimental effect to the overall
water level of the pond, as far as draining it down at a rapid rate. He mentioned that this
particular situation with the smaller pipe would require no maintenance on a regular basis
as he foresaw, and even some form of screening or piping could be put in place to keep
larger objects from flowing in and creating a problem.
(4) Mike is very receptive to assisting in this project and said that he would spend the
rest of the week and try to have a drawing to me sometime next week in order for me to
get a letter off to Frank Jennings and Sarah Winslow.

The crest of the fish weir culvert is designed to be six inches lower than than the

carries all the discharge. Elevation mistakes are the most common source of problem so
make sure you have them done correctly.
It is assumed that 3 four foot deep eliptical culverts will be used wth the middle culvert
having 9 fish weirs spaced at 10 foot invervals starting at the lake face of the culvert.
The downstream bottom end of the culvert is intended to be submerged in the stream and
will not have a weir (see x's in figure below). The two overflow culverts will have
single flashboard crests on the lake side end.

weir slots should be offset in the fish weir cu lvert. The slots on adjacent weirs should
be on opposite sides of the center line of the pipe so as not to develop a streaming flow
in the middle of the pipe.

Dear Mr. Jennings:
In accordance with Mrs. Sara E. Winslow's memorandum to you on November 16,
2004 concerning the design of a fishway/ladder for installation on the Dillard Mill
Project, Mr. Mike Wicker ,with the U.S. Fish and Wildlife Service, was noted as a
possible source for assisting in this effort. I did meet with Mr. Wicker on December
7, 2004 at the dam site, and we spent two hours discussing possibilities for resolving
the issues that Mrs. Winslow addressed. I have been in contact with Mr. Wicker
on many occasions, by telephone and email since that time, and he has delivered to
me copies of culvert designs with dimensions and elevations for use in the area that
Mrs. Winslow was concerned. In addition to this pipe, we discussed overflow
pipes on the northernmost breach that would be slightly higher in elevation than
the desired level of the pond to handle hurricanes and emergencies where large rises
in the water level could be handled by pipes of the same size and design.
Trusting that the enclosed information and drawings from Mr. Wicker will be
sufficient in resolving this latest issued raised, and that you will favor us with a

Dear Mr. Basnight:
The Ryland Ruitan Club in Chowan County has undertaken a project to repair and restore
the Dillard's Mill Pond dam located near Rocky Hock, NC. This dam is an earthen dani,
placed in service in 1752. The southern portion accommodated a grist mill while the
northern portion accommodated a saw mill historically. Thethe~Chowan Riverh have been

and state. The pond is approximately 75 acres and rectangular in shape. We have a permit
to repair from CAMA, direction in repair efforts from the U.S. Fish and wildlife, and

June 17, 2005. We anticipate a construction period of one week and costs not to exceed
fifty thousand ($50,000).
We enlist your support in locating funding sources for this project that requires small
monetary assistance but will reap immeasurable benefits to our community, county and

feast. It will provide the children with another means of 'good.

the undersigned property owner, request access and permission to construct driveway(s) or street(s) on public right-

agree to construct and maintain driveway(s) or street entrance(s) in absolute conformance with the current "Policy on
street and Driveway Access to North Carolina Highways" as adopted by the North Carolina Department of
ransportation.
agree that no signs or objects will be placed on or over the public right-of-way other than those approved by NCDOT.
agree that the driveway(s) or street(s) will be constructed as shown on the attached plans.
agree that that driveway(s) or street(s) as used in this agreement include any approach tapers, storage lanes or
;peed change lanes as deemed necessary.
agree that if any future improvements to the roadway become necessary, the portion of driveway(s) or street(s)
ocated on public right-of-way will be considered the property of the North Carolina Department of Transportation, and
will not be entitled to reimbursement or have any claim for present expenditures for driveway or street construction.
agree that this permit becomes void if construction of driveway(s) or street(s) is not completed within the time
specified by the "Policy on Street and Driveway Access to North Carolina Highways".
agree to pay a $50 construction inspection fee. Make checks payable to NCDOT. This fee will be reimbursed if
application is denied.
I agree to construct and maintain the driveway(s) or street(s) in a safe manner so as not to interfere with or endanger
the public travel.
I agree to provide during construction proper signs, signal lights, flaggers and other warning devices for the protection
of traffic in conformance with the current "Manual on Uniform Traffic Control Devices for Streets and Highways" and
Amendments or Supplements thereto. Information as to the above rules and regulations may be obtained from the
District Engineer.
I agree to indemnify and save harmless the North Carolina Department of Transportation from aif damages and claims
for damage that may arise by reason of this construction.
I agree that the North Carolina Department of Transportation will assume no responsibility for any damages that may
be caused to such facilities, within the highway right-of-way limits, in carrying out its construction.
I agree to provide a Performance and Indemnity Bond in the amount specified by the Division of Highways for any
construction proposed on the State Highway system.
The granting of this permit is subject to the regulatory powers of the NC Department of Transportation as provided by
