Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. There are changes to this permit from the draft permit dated January 16, 2013: (1) At the request of Ms. Nadine Blackwell of United Water, effluent data supplied has been reviewed against the requirements for reducing sampling frequency for Exceptionally Performing Facilities. BOD, TSS and Ammonia - N all met the requirements, so monitoring frequencies for these three parameters has been reduced to 2/ Week for all flow regimes on Effluent Limitations and Monitoring Requirements Sheets A.(1), A,(2), and A.(3). Fecal Coliform did not meet the requirements, so monitoring frequency will remain the same as in your current permit. We did receive comments from the North Carolina Wildlife Resources Commission. They are concerned about chlorine and ammonia exposure to federal and state endangered James Spinymussel and Roanoke Logperch, federal species of concern and state endangered Green Floater, state threatened Bigeye Jumprock, state special concern Notched Rainbow and Riverweed Darter, and the state significantly rare Roanoke Hogsucker. They requested, and DWQ strongly agrees, that you should consider converting to an alternate disinfection agent, such as Ultra Violet light, to replace chlorine/ dechlorination. They also requested site -specific Water Quality Standards for ammonia -nitrogen. A review of your DMRs shows that you are doing a good job of controlling ammonia -nitrogen. We strongly encourage you to remain vigilant regarding ammonia -nitrogen control. The ammonia -nitrogen limits will be reevaluated at the next renewal. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this permit remains final and binding. This permit is not transferable except after notifying the Division of Water Quality. The Division may • modify and re -issue, or revoke this permit. QUARTERLY CHRONIC TOXICITY PERMIT LIMIT, ALL FLOW REGIMES The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 5% at 2.5 MGD flow regime, 6% at 3.0 MGD flow regime, and 9% at 4.5 MGD flow regime. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of March, June, September and December. These months signify the first month of each three month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted fmal effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Form submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Page 7 of 9 Permit NC0021873 - 4. A. (5.) EFFLUENT POLLUTANT SCAN The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years: 2014, 2015, and 2016. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicitytest each year, and must represent seasonal variation [i.e., do not sample in the same quarter every year]. Unless otherwise indicated, metals shall be analyzed as "total recoverable." The Permittee's 5-year NPDES permit expired May 31, 2012 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and monitoring conditions. Existing Treatment System: As a regional facility, Mayodan services 2,505 local residents plus industry, and receives industrial and domestic influent flow from the towns of Stoneville (1,118 residents) and Madison (2,423 residents). In 2002 the Town applied for expansion from 3.0 MGD to 4.5 MGD in order to add service to Stoneville and Madison. In 2007, as a result of loss of a major SIU, the Town applied for a flow reduction modification to the permit in order to downgrade to 2.5 MGD, thereby going from a Class IV to a Class III facility with corresponding relaxed limits and monitoring conditions. The average discharge for the period of 2010 through October 2012 is 0.946 MGD. Fact Sheet NPDES NC0021873 Renewal Page 1 Permittee's Renewal Application: The current permit expired on May 31, 2012. The Division received the Permittee's request to renew the permit (EPA Form 2A) on December 19, 2011. Regional Office Report: Winston-Salem Regional Office (W-SRO) inspector Aana Taylor -Smith conducted an annual facility inspection on April 17, 2013. The facility was found to be in good condition and well maintained. A couple of minor problems were identified: the sample tubing for the influent composite sampler needed to be replaced, and there was a screw loose on one of the secondary clarifier skimmer arms, causing it to be tilted. Both were corrected by the facility. Waste Load Allocation (WLA): The Division prepared the last WLA in 2007 for the receiving stream and developed effluent limits and monitoring requirements considering an in -stream waste concentration (IWC) of 4.91 % (2.5 MGD), 5.84 % (at 3.0 MGD), and 8.51 % (at 4.5 MGD). These IWCs have been rounded up to 5%, 6% and 9%, respectively for Whole Effluent Toxicity testing. The Division views the limits and monitoring requirements appropriate for renewal except as outlined below (see Renewal Summary). Existing Stream Conditions: The Permittee discharges to the Mayo River [Stream Index 22-30-(10)]; this segment is a Class C waterbody within the Roanoke River Basin. The Mayo River is not listed on North Carolina's 303d list of impaired waters (Final 2012). The Mayo River is classified as Good for benthic microinvertebrates near the NC -VA border and is classified as Good -Fair downstream of the discharge at the confluence with the Dan River. Pre-treatment: Mayodan has an approved Pretreatment Program under federal and state regulations (40CFR 403 and NC State 15A NCAC 2H.0900), and this program will continue with renewal. Mayodan is a regional WWTP serving the towns of Mayodan, Stoneville, and Madison. Mayodan regulates all Significant Industrial Users (SIUs) in its service area, currently totaling two SIUs: Unifi Sans, which produces spun nylon fiber, permitted flow is 0.0234 MGD; and Unifi 105, which produces textured and covered nylon fiber, permitted flow is 0.103 MGD. Neither is categorical. DMR Effluent Data Review: Mayodan's monthly Discharge Monitoring Reports (DMRs) appear regular, thorough, and complete. The Division compared effluent flow rates from January 2010 through March 2012. The Division also evaluated data for metals and toxicants during the same time period (see Reasonable Potential Analysis). Whole Effluent Toxicity: The permit has a requirement for a quarterly chronic toxicity test at 5 % at 2.5 MGD flow regime using ceriodaphnia. The Division reviewed Mayodan's quarterly Whole Effluent Toxicity records from January 2008 through December 2012 (20 quarterly tests). Mayodan passed all toxicity testing during this 5-year period. The Permittee also conducted second -species WET testing during the months of April 2011, July 2011, and September 2011. All test results were reported as "pass." Instream Monitoring: The current permit requires monitoring in -stream for pH, Temperature, D.O. and conductivity. A review of DMR data from 2010 through 2012 shows very little difference between upstream and downstream data. In general, pH downstream was 0.1 to 0.2 S.U. lower than upstream, Temperature downstream was within 1 degree C of upstream, D.O. downstream was within 0.1 to 0.2 mg/ L of upstream, and conductivity downstream was within 1 to 2 µmhos/ cm of the upstream value. All conductivity values upstream and down are in the 60 to 70 µmhos/ cm range. This is expected due to the large dilution in the Mayo River. At 2.5 MGD the IWC is 4.9%; at the 3 year average flow of 0.946 mgd and 7Q10 flow, IWC is 1.9%. Recommendation: Retain current in -stream monitoring program. Conductivity monitoring is maintained due to industrial contributions to the WWTP. Fact Sheet NPDES NC0021873 Renewal Page 2 PERMIT RENEWAL Chronic Reasonable Potential Analysis (RPA): In order to establish a list of Pollutants Of Concern (POCs), the Division examined the permit application, pretreatment data, DMRs (2010 through March 2012), and the Basin Plan. The Division conducted RPA for each proposed flow of 2.5 MGD, 3.0 MGD and 4.5 MGD, using 7Q10 dilution, to calculate a maximum predicted concentration for each POC (see attached RPA Summary sheets). Each maximum was then compared to the POC's freshwater Standard or allowable concentration (Tables 2, 3, and 4). If by this method, a POC showed reasonable potential (RP) to exceed its Standard or criteria, the Division included a permit limit as a Monthly Average to protect against chronic toxicity impacts. Acute RPA: Similar to the Chronic RPA, the Division compared each POC's maximum predicted concentration to the freshwater Final Acute Value ('/2 FAV) or EPA Criteria Maximum Concentration (CMC) to establish the potential for acute toxicity (Tables 2, 3, and 4). The acute RPA uses 1 Q 10 dilution. RENEWAL SUMMARY The following changes have been made from the current permit: • Add TRC footnote per permitting strategy. • Revise annual effluent parameter scan to 3 scans per permit cycle during specified years in accordance with revised EPA requirements. • Adjust ammonia limits to not higher than 35 mg/ L. • All monitoring requirements of the LTMP remain in place. • A mercury limit of 47 Ng/ L annual limit with Quarterly monitoring has been added to all flow sheets in keeping with the Statewide Mercury TMDL; the old weekly average mercury limit of 0. 14 µg/ L on the 4.5 MGD sheet was removed. See attached Mercury WQBEL/ TBEL Evaluation worksheets for each flow regime. • A Mercury Minimization Plan (MMP) has been added as Condition A.(7.) in accordance with the recent mercury TMDL implementation strategy. See attached NPDES Permitting for Mercury Implementation of 2012 Statewide Mercury TMDL. • Based on RPA at 2.5 MGD, Sheet A.(1): removed monitoring for lead, selenium, and zinc, based on RPA. Removed limits for Total Lead (Daily Max) and Total Selenium (Weekly Average and Daily Max), based on both acute and chronic standards RPA. Changed to Quarterly monitoring for copper and silver in accordance with our Permitting Strategy for metals. Add Quarterly monitoring for chromium. Add annual average limit and quarterly monitoring for mercury based on the recently approved Mercury TMDL and the Division's implementation strategy. Add Monthly average and Daily Maximum limits with monthly monitoring for chromium, and annual average limit with quarterly monitoring for mercury. • The facility requested reduction in monitoring frequency for BOD, TSS, Ammonia - Nitrogen and Fecal Coliform based on operating data and the recent Division Strategy for Exceptionally Performing Facilities. Data submitted were reviewed; BOD, TSS, and Ammonia -Nitrogen meet the criteria, fecal coliform does not. See attached work sheet DWQ Guidance Regarding the Reduction of Monitoring Frequencies in NPDES Permits for Exceptionally Performing Facilities (October 22, 2012). As a result, monitoring frequency for BOD, TSS and Ammonia -Nitrogen is reduced to 2 per week for all three flow regimes, as the current facility is rated and permitted for 4.5 MGD; no expansion or new construction is required to go up the flow regime limits pages. Fecal coliform monitoring remains at 3 per week for the 2.5 MGD flow regime, and daily for the 3.0 and 4.5 MGD regimes. DRAFT REVIEW COMMENTS NC Wildlife Resources Commission (WRC) did make comments on the draft renewal permit due to the presence of rare, threatened and endangered aquatic species, including mussels and fish. Specifically they requested that we encourage the permittee to consider switching disinfection to UV or Ozone instead of Chlorine, and that we investigate developing site specific limits for ammonia -nitrogen. In response, we did agree to add language to the permit issuance cover page discussing the WRC concerns and to strongly request the permittee to consider UV or other alternate to chlorination, and to keep working on controlling ammonia -nitrogen discharges. It was pointed out that the recent TRC analysis have all been below detect, and the facility has passed all WET tests since one failed test in April, 2000. The existing NH3-N data was reviewed and in -stream concentrations were calculated from DMR data using 7Q10 dilution and the Division's standard background ammonia-N concentration of 0.22 mg/ L. The results showed mostly background to slightly above background ammonia-N of 0.22 - 0.25 mg/ L, with one hit at 0.45 mg/ L in 2010. B. Mercury Minimization Plan (MMP). If an MMP is required (note change to Major Municipal > 2MGD), add the following Special Condition to the permit: A(x). Mercury Minimization Plan (MMP). The permittee shall develop and implement a mercury minimization plan during this permit term. The MMP shall be developed within 180 days of the NPDES Permit Effective Date, and shall be available for inspection on -site. A sample MMP was developed through a stakeholder review process and has been placed on the Division website for guidance (http://portal.ncdenr.org/web/wq/swp/ps/npdes, under Model Mercury Minimization Plan). The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. C. New/Expanding Dischargers- will be allowed as long as the overall aggregate point source load allocation is not exceeded. D. Special Situations- Additional site -specific information, such as fish tissue and water column data when available, will be considered in assigning limits and MMP requirements. Purpose In its efforts to reduce the regulatory burden upon permittees while maintaining adequate compliance oversight over point source discharges, DWQ has developed the following guidance for the reduction of monitoring frequencies in NPDES permits for specific target parameters. Standard minimum NPDES monitoring frequencies are established in 15A NCAC 2B .0508 for discharges from facilities with specific Standard Industrial Classification (SIC) categories. However, 2B .0508(b)(1) states: "If it is demonstrated to the satisfaction of the Director that any of the tests and measurements, sampling points, or frequency of sampling requirements, as required in this Rule for a particular SIC group, are not applicable to the discharge of a particular water pollution control facility, or if it can be demonstrated that the objectives of this Section can be achieved by other acceptable means then such requirements may be waived or modified to the extent that the Director determines to be appropriate." This document identifies criteria to be used by DWQ that satisfies the regulatory standard for the allowance of reduced monitoring frequencies for facilities included in SIC 4952. This guidance applies to facilities with outstanding NPDES program compliance histories, exhibiting effluent discharges that are excellent in both quality and consistency. Such performance will demonstrate that compliance for particular parameters can be adequately evaluated with less monitoring. Facilities demonstrating consistent, long-term treatment performance at levels far below effluent limitations (<50%) may be considered for a reduction in monitoring from existing permit frequencies to a 2/week minimum frequency for the parameters BODE, CBOD5 TSS, NH3-N and fecal coliform/enterococci (the "target parameters"). B. Approval Criteria Individual NPDES facilities shall submit a written request to modify their NPDES permit specifying which parameters are to be considered for reduced monitoring . Permit holders must include with their requests sufficient data, statistical analyses, and other information to support the justification for reduced monitoring. NPDES permit staff shall review the application and supporting information. Implementation Feed Fai After DWQ review and approval, the facility's NPDES permit will be reissued with reduced monitoring frequencies for qualified parameters. Additional NPDES permit requirements will include: • Eligible facilities may be granted a reduction from existing permit monitoring frequencies to a 2/week minimum frequency for the four target parameters. Reductions will be made for both effluent and influent sampling. • Where monitoring is reduced to twice per week, it must occur on any two non-consecutive days during the calendar week (Sunday through Saturday). • Required monitoring frequency reductions establish new permit minimums for monitoring. As always, facilities may monitor more often than required in the permit. • If a reportable event, as defined by the permit [e.g., Part 11 (E) (6 & 9)] occurs, any facility granted reduced monitoring frequencies will be encouraged to monitor on a daily basis until the episode is resolved. Monitoring frequency reduction from the minimum frequencies reductions established by the rules are based upon consistent, exceptional performance. DWQ may revoke on a case -by -case basis these reductions if the facility begins to perform in noncompliance with permit limits. I am attaching a spread sheet with the Effluent data for BOD, TSS, Ammonia, and Fecal Coliform. As you will note, the 3 year average is less than 50% of the permit limits for BOD, TSS, and Ammonia. I am also attaching graphs of the parameters compared to their limits. The weekly TSS was exceeded 2 times during the period and the weekly Fecal Coliform was exceeded 6 times during the period. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667e), North Carolina General Statutes (G.S. 113-131 et seq.), and North Carolina Administrative Code 15A NCAC 10I.0102. The Town of Mayodan has applied for a renewal of their NPDES permit to continue to operate an existing 4.5 MGD wastewater treatment facility. The facility has effluent limitations and monitoring requirements for 2.5, 3.0, and 4.5 MGD. The 7Q10 is 75 cfs, and the instream waste concentration ranges from 4.9% to 8.5%. Chlorine is used for disinfection, and effluent limitations for ammonia (NH3 as N) vary depending on the discharge amount and season. The monthly average ammonia limits range from 9.0 mg/L to 31.5 mg/L. The weekly average ammonia limits range from 27.0 mg/L to 35.0 mg/L. The wastewater treatment facility discharges to Mayo River, a tributary to Dan River in the Roanoke River Basin. There are records for the federal and state endangered James spinymussel (Pleurobema collina) and Roanoke logperch (Percina rex); the federal species of concern and state endangered green floater (Lasmigona subviridis); the state threatened bigeye jumprock (Moxostoma ariommum); the state special concern notched rainbow (Villosa constricta) and riverweed darter (Etheostoma podostemone); and the state significantly rare Roanoke hogsucker (Hypentelium roanokense) in Mayo River. Also the Significant Natural Heritage Area — Mayo River Aquatic Habitat — is located in this section of the Mayo River. Chlorine is acutely toxic and can form secondary compounds that are detrimental to aquatic life. Valenti (2006) concluded the impact of long term exposure to low doses of chlorine may impact juvenile mussels and reduce the chance of them being recruited to the reproducing population. Also, fish and mussel species are very sensitive to ammonia. Dwyer et al. (2005) found that Cape Fear shiners, a federal endangered fish species, had an IC25 of 8.8 mg/L for ammonia. Augspurger et al. (2003) found that ammonia concentrations which may be protective of freshwater mussels range from 0.3 to 1.0 mg/L total ammonia as N at pH 8. We reviewed EPA's Enforcement and Compliance History Online (ECHO) for this facility and it showed: • From July 2009 to June 2012 the total residual chlorine was measured at 0 µg/L. • From July 2009 to June 2012 the total ammonia nitrogen (as N) ranged from a minimum of 0 mg/L to a maximum of 24.1 mg/L. The average total ammonia nitrogen (as N) ranged from 0.15 mg/L to 14.35 mg/L. We recognize the discharge is relatively small, and is located near the confluence of Dan River. However, the Mayo River supports several federal and state listed species, and several listed species including the Roanoke logperch have been documented in Dan River. Therefore, it is imperative the facility operates effectively to prevent excessive discharge of pollutants, particularly chlorine and ammonia. Should the permit be renewed, we offer the following recommendations to minimize impacts to aquatic resources. 1. While it appears the facility is not discharging chlorine, we encourage the applicant to consider replacing chlorine disinfection systems with ultraviolet light or ozone systems to eliminate the potential for chlorine to be discharged. 2. Develop site -specific acute (short-term) and chronic (long-term) water quality standards for ammonia to protect rare and sensitive mussel species, particularly James spinymussel in Mayo River. The site specific standard should be developed using the process described in Appendix A of the Technical Support Document for Consideration of Federally -listed Threatened or Endangered Aquatic Species in Water Quality Management Planning for the Goose Creek Watershed. The stabilized sludge is then land applied either as a liquid directly from the digester or it may be dewatered on one of the 10 sand drying beds and then land applied. The Land Application Permit (WQ0002672), permits a total of 197.6 acres. Town of Mayodan NPDES Permit NC0021873 Present Operating Status The Town of Mayodan Wastewater Treatment Plant is a 3.0 MGD design capacity facility. The facility treats a combination of domestic and commercial wastewaters. The current treatment scheme includes a mechanical bar screen, grit removal system, activated sludge and secondary clarification. The treated effluent is disinfected by chlorination followed by a dechlorination through the use of Sulfur Dioxide. Following is a schematic of the existing wastewater treatment plant.
