TERMINATION OF OPTION
AND ASSIGNMENT OF CONTRACT
FRANKLIN COUNTY
THIS TERMINATION OF OPTION AND ASSIGNMENT OF CONTRACT ("Agreement"),
made and entered into this the 9" day of February, 2022, by and between TOMMY E. TWITTY, whose
address is Post Office Box 747, Louisburg, North Carolina 27549, hereinafter referred to as "Assignor"

and CHARLES W. FLOYD and wife, SUE J. FLOYD, whose address is 2.52-3 NC Hwy 98 West,
Louisburg, North Carolina 27549, hereinafter referred to as "Assignee".
WITNESSETH:
Assignor, for and in consideration of the sum of Ten Dollars ($10.00) and other valuable
consideration, the receipt of which is hereby acknowledged, does hereby assign, transfer and convey unto
said Assignee, their successors and assigns, all right, title and interest of said Assignor in and to that Real
Estate Purchase Contract dated May 10, 2021 (the "Contract"), including, without limitation, the Earnest
Money Deposit, by and between Assignor, as "Seller", and Boddie-Noell Enterprises, Inc., a North
Carolina corporation, as "Purchaser", for the purchase and sale of that property located at the corner of
South Mail Street and Warren Avenue, Bunn, Franklin County, North Carolina, and more fully described
in Contract (the "Property"), but subject to the terms and conditions set forth in said Contract.
Assignee by its execution of this Agreement hereto affixed, agrees to accept this Assignment and
to comply with all of the terms and conditions of the Contract, to the extent provided therein; and
Assignee agrees to notify Purchaser of this Assignment.
Assignor and Assignee, by their execution of this Agreement, hereby terminate the Option to
Purchase and Offer to Purchase and Contact entered into April 3, 2021 by them, and any amendments
thereto, with respect to the Property.
IN WITNESS WHEREOF, Assignor and Assignee have caused this Assignment to be executed
as of the date and year first above written.
