Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.) The following modifications have been made to the permit: • The deletion of instream monitoring for fecal coliform and conductivity based on new Division of Water Quality (DWQ) procedure. Effluent monitoring for conductivity will also be deleted. • Effluent monitoring for MBAS will be deleted. Reasonable potential analysis indicated that the allowable concentration of 6950 ug/l would not be exceeded. The following condition is included in the permit: Limits on total phosphorus and total nitrogen have not been included at this time because the facility is participation in the nonpoint source trading option outlined in the Tar Pamlico NSW implementation Strategy Phase II, which was adopted December 8, 1994. If compliance with any element of this strategy, or subsequent approved revisions to the strategy is not maintained, the Division reserves the right to reopen this permit to include nutrient limits. If requirements other than those listed in this NPDES permit are adopted as part of a future revision to the strategy, the Division reserves the right to reopen this permit to include these requirements. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. Permit No. NC0025402 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 7.0%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August, and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pap/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of. the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. The facility is a 1.0 MGD extended aeration plant. The receiving stream is Fishing Creek with a s7Q10 = 20 cfs, w7Q10 = 53.5 cfs and QA = 526 cfs. The stream class is C NSW. Fishing Creek (030304) is not on the final draft 2000 303(d) list. (Fishing Creek in Tar01 is listed on the 303d list.) In June 1998, DWQ received an engineering certification indicating an expansion from 0.5 MGD and a relocation of the outfall to Fishing Creek. Enfield relocated to Fishing Creek from a low flow stream (Beech Branch), where the previous IWC was 88%. The IWC at Fishing Creek is 7%. Existing effluent limits are 15/3/5 (summer) and 30/6/5 (winter). Fecal coliform at 200/100m1 and chlorine at 28 ug/1 are also limited. There is monthly monitoring of TN and TP, twice per month monitoring of MBAS, and a quarterly Chronic toxicity P/F test at 7% in Feb May Aug and Nov. Application lists one contributor of industrial waste, Safelite Glass Corp. Because this discharger is located in the Tar Pamlico River Basin, which has the NSW classification, there are rules and recommendations to reduce nutrient loads to the estuary from both point and nonpoint sources of pollution. In 1998, there were two violations of flow (January and February), three violations of NH3 (April -June), and two violations of fecal coliform. From April 1998 to March 1999, avg. Qw = 0.523 MGD, approximately 52% of design capacity. During this same time frame, averages for BODS =6.14 mg/1, TSS = 8.7 mg/1, NH3= 1.9 mg/1, TN = 8.7 mg/1 and TP=1.2 mg/1. In 1997, there was one violation each of flow, BOD5, TSS, and two violations of pH. From April 1997 to March 1998, avg. Qw = 0.571 MGD, approximately 57% of design capacity. Recommendations: • Renewal of existing limits of 15/3/5 (summer) and 30/6/5 (winter), with fecal limit of 200/ 100m1 and Cl limit of 28 ug/1. • Instream monitoring for dissolved oxygen and temperature will be continued. • Instream monitoring for fecal coliform will be deleted and effluent and instream monitoring for conductivity will be deleted. • Effluent monitoring for MBAS will be deleted. Reasonable potential analysis for data in 1999 and early 2000 indicated that the allowable concentration of 6950 ug/1 would not be exceeded. • To be inserted in the permit: For Association members: Limits on total phosphorus and total nitrogen have not been included at this time because the facility is participating in the nonpoint source trading option outlined in the Tar Pamlico NSW implementation strategy Phase II, which was adopted December 8, 1994. If compliance with any element of this strategy, or subsequent approved revisions to the strategy is not maintained, the Division reserves the right to reopen this permit to include nutrient limits. If requirements other than those listed in this NPDES permit are adopted as part of a future revision to the strategy, the Division reserves the right to reopen this permit to include these requirements. Mr. Lynch called our office and indicated that the Town experienced a delay in acquiring correct statistical analyses from its certified biological laboratory for the month of March 1999. Specifically, the Town's instream waste concentration decreased from 88% to 7% due to plant upgrade and although a multiple concentration toxicity test was conducted during March, the Town's biological contract laboratory incorrectly assumed 88% to be the correct permit limitation. Mr. Lynch faxed the requested AT-3 test form to our office which reflects compliance with a 7% permit limit for March. Mr. Lynch also inquired about correct toxicity testing months. Review of file information indicates that a permit modification was issued to the Town on October 30, 1997, which modified the Town's toxicity testing months from March, June, September, and December (MJSD) to February, May, August, and November (FMAN). The Town has continued to test for toxicity according to the MJSD schedule. Mr. Lynch was instructed to: conduct a toxicity test during June 1999, notify the Town's biological laboratory that testing months should be j* modified to FMAN, and begin toxicity testing per the FMAN schedule after June 1999. The Town was informed that the March and April 1999 Discharge Monitoring Reports were not received by the Division until June 1, 1999. Likewise, the office did not receive the March 1999 toxicity self -monitoring data until June10.
