Review and Credit Release Request
Good afternoon,
The below reference bank Sponsor has submitted an Annual Monitoring Report for NCIRT review,
and is requesting a release of credits. The Annual Monitoring Report has been posted to the RIBITS
Cyber Repository for the bank site (see link and instructions provided below). If you are unable to
access the document or prefer to have a hard copy mailed to you, please let me know as soon as
possible, and I will arrange to get you a copy of the report.
This review will follow the process outline for Credit Release Approval in the 2008 Mitigation Rule
(Section 332.8(o)(9)), which requires an IRT review period of 15 calendar days from the date of this
email notification. Please provide any comments by 5 PM on the 15-day comment deadline shown
below. Comments provided after the 15-day comment deadline may not be considered. If you
would like to request a site visit prior to submitting comments, please notify me as soon as possible
but prior to the 15-day comment due date. If a site visit is required, the due date for IRT comments
will be extended to 15 days after the date of site visit. Once I have received a request for a site visit,
I will coordinate with the IRT and Sponsor to arrange for the on -site meeting; however, please note
that due to workload it may take a month or longer to arrange the meeting. Within 30 days of the
conclusion of the IRT review period (comment deadline), a copy of all comments will be provided to
the bank Sponsor and the IRT along with District Engineer's intent to approve or disapprove this
credit release.

Dear Mr. Medric:
This correspondence is in reference to the RES Cape Fear 02 Umbrella Mitigation
Bank, Dairyland Site located in Alamance County, North Carolina. The site includes
unnamed tributaries that flow to the Haw River in the Cape Fear River Basin, Cataloging
Unit (03030002). The purpose of this letter is to transmit comments provided by the NC
Interagency Review Team (NCIRT) during the review of the monitoring report (see
attached) and to confirm the Year 3 credit release for this mitigation site.
Pursuant to the site's Umbrella Mitigation Banking Instrument and the site -specific
Mitigation Plan, the following mitigation credits shall be available for sale provided the
annual monitoring report demonstrates interim performance standards are being met:
• 10% of the total enhancement and/or restoration Stream Mitigation Units (SMUs)
associated with year 3 annual monitoring (350.2 Warm Water SMUs)
Based on a review of the monitoring data provided for the stream restoration on the
site, and also by a review of the site conducted on January 12, 2022 and follow-up
information that was provided subsequent to the field review by letter dated March 25,
2022, we confirm that you have satisfied the above requirements, and 350.2 Warm Water
SMUs are now available for sale. To date, 2,256.2 SMUs (60% of the total SMUs) have
been released for sale.
Please review the comments provided by the NCIRT during their review of the
monitoring report. While it is not necessary to provide a response to specific comments
at this time, please be sure to address the issues raised in future monitoring report
submittals.

SUBJECT: Action ID # SAW-2016-01258, NCIRT Review Comments on the RES Cape
Fear 02 Umbrella Mitigation Bank, Dairyland Year 3 Monitoring Report
Casey Haywood, USACE:
1. UT2 had areas dense with pine stems. Small areas of erosion along channel.
Piping structure near xs10 & 11. Rip rap looking channel.
2. Veg plot 8 appeared to have a large number of planted stems and the plot is not
representative of the surrounding veg. Recommended a transect in this area.
3. A small side channel coming out of a culvert had some headcuts that may need
to be watched. Small area of open water also in this area.
4. Tearthumb vines could be choking out some of the veg. Some privet needs
treating.
5. HB2- Beaver small dam below XS4 & XS5. Also has an area with dense pine that
needs to be thinned. Near veg plot 4 an area of erosion was coming off the field
into the easement and should be managed.
6. There were several areas of encroachment, and the entire easement should be
remarked. Road that was mowed needs to be replanted. RES will need to send
in a report with photos and other documentation before credit can be released
showing the problem is resolved. The landowner is a repeat offender. Bridge at
the UT2/HB2 confluence will need to be looked at closer to determine if it is an
encroachment.

1. Following an on -site review of the project, additional information was provided to
document actions taken to address the concerns noted above in this memo by
letter dated March 25th. Based on this additional information, the requested
credits can be released.
