Enclosed please find the updated Certificate of Coverage page for the subject permit. This page should be inserted into your current permit and the old page discarded. This permit is issued . pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. Teer Co., which has been assigned Permit No. NCG020037. The particular site in question is the Pilcher Site (see map). Nello L. Teer Co. Larco Construction Division, has filed a Notice of Intent Requesting Coverage Under the Mining Activities General NPDES Permit NCG020000. Other: PART IV - EVALUATION AND RECOMMENDATIONS This staff report is for a renewal request for Permit No. NC0067890 (Pilcher Site) but to include a modification to the permit. The company submitted an application (NC0081582) in December 1991, for another sand dredging site on the Yadkin River. The new proposed site (Poindexter Site) is located upstream, but adjacent to the Pilcher Site. The company plans to continue to use the screening plant located on the Pilcher Site. A single dredge would work the Pilcher Site but the dredge could also be.moved to the Poindexter Site and the sand slurry pumped approximately 2500 feet to the Pilcher Site for screening and stockpiling. This plan of operation would be used provided sand production is adequate from these sites and the company's other sites. However, should the need arise, the permit should allow for both the Pilcher Site and the Poindexter Site to be operated at the same time. If and when that happens, both sites would screen and stockpile sand and both sites would have settling ponds. The discharge flow from a single site would never exceed the pumping rate (2100 gpm) of a single dredge. It is recommended that the existing permit NC0067890 be reissued, but modified to include the Poindexter Site located just upstream. The Pilcher Site would be Discharge 001 and the Poindexter Site Discharge 002.
