Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 931105 Modification, dated September 14, 1998, for the construction of the project. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. No piping shall be allowed in a curb outlet system swale. v 5. A portion of this project proposes a curb outlet system, located between Lots 3 & 4, 36 and 37, and beside 40. Each designated curb outlet swale shown on the approved plan is required to be 100' long with side slopes no steeper than 5:1 (H: V), have a longitudinal slope no steeper than 5 % , carry the flow from a 10 year storm in a non -erosive manner, and have a dense vegetated cover, per Section .1008 (g) of the stormwater rules. Other vegetated conveyances must have a minimum side slope of 3:1. 6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 7. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The stormwater management system, including ponds, swales, and curb outlet system, shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 2. --During construction, erosion -shall be kept:to a --minimum and any eroded areas of the'system will be repaired immediately. n State Stormwater Management Systems Permit No. SW8 931105 Modification 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 7. Records of maintenance activities must be kept and made availablc upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 8. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Section I, Part 2. The recorded statements must follow the form: a. "The maximum built -upon area per lot is as follows: Lots 1-19 @5,775 ft2; Lots 20-40 @4,900 ftz; Lots 41-65, 89-100, 116-120, and 137-141 @3,200 ft2; and Lots 66-88, 101-115, 121-136, and 142-150 @3,500 ft2, inclusive of that portion of the right-of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including open wood decking or the water surface of swimming pools. '1'his shall become voidable unless the facilities are constructed in accordance with the conditions 6 permit, the approved plans and specifications, and other supporting data. v 1L Prior to transfer of ownership, the pond must be inspected by DWQ personnel, and determined to be in compliance with all permit conditions. Records of maintenance activities will be required. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Perminee, a "Name/Ownership Change Form" must be submitted to the Division of Water Quality accompanied by appropriate documentation from the parties involved, such as a copy of the deed of trust. Other supporting materials, such as a signed Operation and Maintenance plan in the case of engineered systems, will also be required. The project must be in good standing with DWQ. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 6. Permittee grants permission to staff of the DWQ to access the property for the purposes of inspecting the stormwater facilities during normal business hours. The collection system will be inspected monthly by the owner to identify malfunctioning catch basins and drainage pipes. The collection system will be kept relatively clear of debris and sediment. The stormwater system shall be kept in good working order. Any malfunctioning component shall be repaired/replaced per approved plans as necessary to assure proper operation of the system. 3. The treatment facilities consist of two (2) stormwater ponds with outlet control. 2r x e curb cuf Lef These facilities will be inspected twice a year by the owner to determine the mean depth of Sew the ponds and identify any malfunctions. The mean depth of Pond No.1 (existing pond) under normal conditions, shall be 7.5 feet. The owner will remove the sediment from the pond if the mean depth is determined to be less than 5.2 feet and will correct malfunctions when necessary. The mean depth of Pond No.2 (new pond) under normal conditions shall be 4.0 feet. Any debris observed on the orifice and outlet structures will be removed. Eroded areas will be repaired and reseeded immediately after a rainfall event. 5. A permanent stand of grass shall be maintained at all times. Mowing during the growing season will be done as needed, otherwise, the grass height will not exceed 6" 6. The grass swells shall be inspected twice a year by the owner to determine if sediment has accumulated in the swale and to determine if any erosion has occurred. Mowing will be accomplished as needed according to the season. Grass height will not exceed 6" at any time. Swales will be inspected monthly or after every runoff rainfall event for sediment build-up, erosion and trash accumulation. Accumulated sediment and *rash tkrill be removed as necessary. Swales will be reseeded or sodded following sediment removal. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed based on the monthly inspections. The initial check for $225.00 and this one now brings the total to $385.00. 2) The number of drainage basins on page 2 of 4 of the application has been changed to 3. 3) The ponds and swales are located in drainage easements that will be recorded once platted. 4) The 14.9 acres of off -site area draining into the existing pond is still correct. 5) The impervious number totals for No. 6 of Section III have been corrected. The corrected sheet is attached to this letter. -6) A copy of the recorded deed restrictions for lots 1-19 is provided. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: `f 1. The fee for modifications to detention ponds is $385.00. Please submit an additional $160.00. 2 2. The modification must address all aspects of the project. This project was previously approved as a low density subdivision with a collection system, which required a detention pond. Now, a part of the subdivision is proposed as low density with a curb outlet system, a part is high density with a pond, and a part remains as low density with a collection system. Each of these BMP's must be included on the application, resulting in three drainage basins, not two. V13. Locate the ponds and curb outlet swales in recorded access/drainage easements. v% 4. Encl.: As noted above. cc: Greenbriar South Partnership STORMWATER NARRATIVE Stormwater management for the Greenbriar South Project will consist of utilizing the existing detention pond, constructing one additional detention pond, and utilizing 100-foot long grass swales at three locations. Each of the two ponds is sized to achieve a 90% reduction in Total Suspended Solids. The existing detention pond has a 52.07 acre drainage area. There are 37.17 acres of on - site runoff being directed to the pond and 14.9 acres of off -site runoff being directed to the pond. Note the previous permit No. 931105 included the 14.9 acres of offsite drainage entering the pond. See sheet C-18 for the on -site drainage area for the existing pond. Stormwater being directed to this pond will be collected via curb & gutter and a piped system before it either enters the large ditch on'the south side of the property or the pond directly. The large ditch on the south side of the property conveys stormwater runoff to the existing pond. The new pond has a drainage area of 8.87 acres. See sheet C-18 for the on -site drainage area for Pond No. 2. Stormwater being directed to this pond will be collected via curb & gutter and a piped system. There are three locations where grass swales are being used to treat stormwater runoff in areas considered "low density". The subdivision meets low density from a built -upon standpoint, they just wanted a collection system, so they put in the pond. That should have a bearing in how we make this decision. From your 3/10/98 email - -Yes, the 8 lots can meet low density by themselves. I can't remember if an extensive collection system is used for this runoff. I think only catch basins and a little bit of pipe into the swale are all. -Yes, the pond is sized for the entire drainage area, including some offsite residential areas. There are the usual problems with stabilization, but, the pond is in and functioning. -Yes the engineer sent in the PE Certification on 1-20-98. 1 think that not enough weight is afforded by the engineer to the review needed to certify a project. Certain engineers take it more seriously than others. Perhaps a checklist of required items is needed? A copy of the recorded deed restrictions has not been submitted yet. -The same developer would get the permit. Since the subdivision is low density with a collection system, I think simply noting in the permit that there are 8 uncollected lots would be OK, but a modification to the permit is required. -1 think that there needs to be an automatic fine for failing to build in accordance with the approved plan and subsequently not submitting for a modification for approval before building the modification, based on the severity of the offense. Overbuilding the impervious area and undersizing or not constructing of the stormwater treatment device should receive the stiffest fines.. I think I can handle this one from here, now that I know it is low density. From my last meeting with Mark Hargrove, they will propose to increase the density to the pond. Apparently, those big lots aren't selling as well. I think we can split out the old, low density portion of the project from the revised, higher density part. Does this sound OK to you? If they are going to make changes then they need to come back to us and modify the permit. I guess the questions I have on this one are: • Will the eight lot areas meet low density by itself? • Is there any problem with the pond? Is it sized appropriately for the remaining area? • Did the engineer previously send in the engineer's certification? If they did then they obviously didn't review anything because this one ended up being a lot different than the approved project. • Who would we propose issuing the approval to for the low density portion or are we just planning to modify the original permit to include both the low and high density portions? This may be another area where we need to look at potential enforcement on people that don't built in accordance with the approved plans. Well, the developers had a problem with the grading of 8 of the lots and the road in front of those lots, and created a low area that could not be collected to the pond. The developer put in a 5:1 swale to treat the runoff. I only found this out about a week ago because the developer wants to revise the remaining subdivision area. Since that 8 lot area cannot be collected to the pond, is it possible to permit it as a low density area within a high density subdivision? I don't like doing it, but I see no reasonable alternative, since rerouting the drainage will cost the developer about $25,000. I told the engineer I didn't like being the one to come up with a solution to a problem I didn't create. I find it very difficult to have this situation trrust on me. I mean, they modified the system and didn't file any revisions with our Office, in direct conflict with the Certification. My gut reaction is, it's not my fault your engineer messed up and I don't care how much it costs, fix it the way it was approved, but I know that may be perceived as unreasonable. My fear is that if we permit this, we'll start to see other projects like this because the developer feels that it costs too much to construct the project so that all the BUA is directed to the pond, as required. If they don't like the way we require it to be built, they will just build it the way they want to and then come back later with a sob story about why they couldn't build it as approved, and we'll have to accomodate them. I find this very unfair. The engineer is going to the County TRC next Thursday, the 12th. If I could have your opinion on this by then, I would appreciate it.
