On behalf of KA Towerview Holdings, LLC, we are requesting a Buffer Authorization from the NC
DWR for 3,764 sq ft of permanent buffer impacts for the construction of a stormwater control
structure outfall/access easement and a sanitary sewer easement for the Preston Ridge
Subdivision project.
The Preston Ridge Subdivision project is located at 560 & 720 James Jackson Ave (35.801458°N;
-78.813821°W) in Cary, Wake County. The project area is approximately 28 acres and consists of
two parcels (PINs: 0754565491 & 0754468633) located adjacent to James Jackson Avenue and
bordered to the west by NW Cary Parkway. The project area is in the Neuse River basin and onsite
waters drain to Coles Branch. The Water Quality Classification for Coles Branch is C; NSW and
the Stream Index Number is: 27-33-3. The cataloging unit for the site is 03020201.
Proposed Project
The proposed project consists of a mixed density residential development containing multifamily,
single family, and townhome lots. Specifically, this request is for impacts to riparian buffers for
construction of an SCM outfall/easement, and a sanitary sewer easement on the eastern side
of the project area to serve the new Preston Ridge development. The proposed sanitary sewer will
tie into an existing sewer line to the east.
Project History
WithersRavenel conducted a wetland delineation for the subject property in October 2020. The
delineation identified two intermittent streams (Streams A & C) and one wetland (Wetland A)

The USACE issued a Preliminary JD (AID: SAW-2021-00192) on 4/12/2021 approving the
delineation. A copy of the USACE PJD has been provided as an attachment to this application.
NCDWR issued a Buffer Determination letter (RRO #20-394) for the subject property on
2/19/2021, which has been provided as an attachment to this application.
Proposed Impacts
The proposed buffer impacts are noted in the table below:

The proposed outfall (Impact B1) for SCM 3 will result in 1,300 sf of permanent Zone 1 impacts
and 1,126 sf of permanent Zone 2 Impact. The design of the outfall could not be aligned
perpendicularly through the buffer for multiple reasons. The SCM outfall alignment was
determined based on the existing topography. This alignment allows for daylighting of the outfall
pipe and the riprap channel to be constructed at a 0.5% grade to the stream while matching the
elevation of the stream banks. This prevents the need to excavate and destabilize the stream bank
for construction of the riprap outfall channel. The SCM outfall should not be aligned to cross the
buffers above the sanitary sewer easement because discharging above the sanitary sewer
easement during heavy rain events when the flow would be at high volume/velocity and
potentially overtopping the riprap channel risks potential erosion of the sewer easement. The
proposed stormwater outfall is clDeemed 0 Neuse River Riparian
Buffer Rules. Please note that SCM 3 will be an underground sand filter/detention SCM which
will provide 90% TN removal and therefore diffuse flow is not required.
The construction of the proposed gravity sewer line (Impact B2) will be located within a permanent
sanitary sewer easement and will result in 721 sf of permanent Zone 1 impacts and 617 sf of
permanent Zone 2 impacts. The en

corridor of less than 40 ft in width with a permanent maintenance corridor of 30 lf which is
0 Neuse River Riparian Buffer Rules.

Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that
minimized to only impacts necessary for construction of the new SCM and sanitary sewer
easement. There are no proposed wetland or stream impacts for the proposed impacts. The
proposed SCM outfall is designed to not cause erosion through the riparian buffer or cause erosion
to the receiving stream.
Access during construction will occur from uplands and will be restricted to only the project
corridor within the buffers as defined within the impact exhibits. Silt fencing will be installed
around all disturbed areas to prevent loss of sediment into adjacent watersand prevent accidental
disturbance to riparian buffers beyond the authorized impact areas.

Location description: The project site is approximately 26 acres located adjacent to James Jackson Ave, and bordered to the
west by NW Cary Parkway, near the town of Cary, Wake County, North Carolina.

There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404
of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The
waters, including wetlands have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate
and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map dated 12/11/2020. Therefore
this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory
mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection
measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any
way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an
appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may
request an approved JD, which is an appealable action, by contacting the Corps district for further instruction.
There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404
of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403).
However, since the waters, including wetlands have not been properly delineated, this preliminary jurisdiction determination
may not be used in the permit evaluation process. Without a verified wetland delineation, this preliminary determination is
merely an effective presumption of CWA/RHA jurisdiction over all of the waters, including wetlands at the project area, which
is not sufficiently accurate and reliable to support an enforceable permit decision. We recommend that you have the waters,
including wetlands on your project area/property delineated. As the Corps may not be able to accomplish this wetland
delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can be verified by the Corps.
B. Approved Determination
There are Navigable Waters of the United States within the above described project area/property subject to the permit
requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water Act
(CWA)(33 USC § 1344). Unless there is a change in law or our published regulations, this determination may be relied upon for
a period not to exceed five years from the date of this notification.

Corps Regulatory Official identified below on DATE. Unless there is a change in the law or our published regulations, this
determination may be relied upon for a period not to exceed five years from the date of this notification.
There are no waters of the U.S., to include wetlands, present on the above described project area/property which are subject to the
permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law or our published
regulations, this determination may be relied upon for a period not to exceed five years from the date of this notification.
The property is located in one of the 20 Coastal Counties subject to regulation under the Coastal Area Management Act (CAMA).
You should contact the Division of Coastal Management in Morehead City, NC, at (252) 808-2808 to determine their
requirements.
Placement of dredged or fill material within waters of the US, including wetlands, without a Department of the Army permit may
constitute a violation of Section 301 of the Clean Water Act (33 USC § 1311). Placement of dredged or fill material, construction or
placement of structures, or work within navigable waters of the United States without a Department of the Army permit may
constitute a violation of Sections 9 and/or 10 of the Rivers and Harbors Act (33 USC § 401 and/or 403). If you have any questions

individual permit (and all terms and conditions contained therein), or individual permit
denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an
administrative appeal, it
becomes appropriate to make an official determination whether
geographic jurisdiction exists over aquatic resources in the review area, or to provide an
official delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that
