ThepurposeofeachBankParcelis: A. Torestore,enhance,andpreserveriparianvegetationadjacenttostreamsandagricultural ditcheswiththeintenttoimprovewaterquality,reducenutrientloads,enhanceflood restorewildlifehabitatalongunnamedtributariesandditcheswithinthe attenuationand NeuseRiverBasin. B. Toconvertagriculturallanduses,includinglandsoriginallyassociatedwiththelandapplication ofwastefromacertifiedanimalfeedingoperation,withinriparianareasadjacenttostreams, ephemeralsand/oragriculturalditchesintoadenseanddiverse,hardwoodvegetatedstatewith theintenttosignificantlyreducenutrientloadingsassociatedwithagriculturalpracticesinto streamsandditches. C. ToprovidebuffermitigationandnutrientoffsetsandsellanyresultingRiparianBufferCredits and/orNutrientOffsetCreditstothirdpartiesinspecificareaswithintheNeuseRiverBasinfor development(bothexistingandproposed)ortooffsetNPDESpermittedwastewaternutrient sourcesrequiringsuchmitigationoroffset. II. LOCATIONANDGEOGRAPHICSERVICEAREA A. TheGeographicServiceAreaΛͻD{!ͼΜisthedesignatedareawhereinaBankcanreasonablybe expectedtosellRiparianBufferCreditsand/orNutrientOffsetCreditsforimpactsdueto developmentactivities. B. TheGSAfortheseBankParcelsislimitedtotheUnitedStatesGeologicalSurveyΛͻ…{D{ͼΜ8digit HydrologicUnitCodeΛͻI…/ͼΜ03020201oftheNeuseRiverBasin,excludingtheFallsLake Watershed. C. SaleortransferofRiparianBufferCreditsshallbelimitedtothe8digitHUC03020201inthe NeuseRiverBasin,excludingtheFallsLakeWatershed,unlessotherwiseauthorizedbytheDWR ordelegatedlocalgovernmentinaccordancewith15ANCAC02B.0295. D. AUTHORITIES A. Projectseligibleforutilizationofthecreditsarethoserequiringauthorizationunderthe requirementsofAttachmentAandanynewapprovedNorthCarolinaΛͻ{ƷğƷĻͼΜstatutesandrules fortheNeuseNutrientSensitiveWatersManagementStrategy. C. ThesellingofcreditsgeneratedfromtheBankParcelapprovedunderthisInstrumentshallbe consistentwithapprovedStatestatutesandrulesfortheNeuseNutrientSensitiveWaters ManagementStrategy. D. BuffermitigationandnutrientreductionactivitiesproposedunderthisInstrumentand correspondingBankParcelDevelopmentPackages(BPDPs)togenerateRiparianBufferCredits andNutrientOffsetCreditsshallbeconsistentwithStatestatutesandrulesfortheNeuseNutrient SensitiveWatersManagementStrategythatareinplaceatthetimeacompleteBPDPissubmitted toDWR. IV. ESTABLISHMENTOFBANKPARCELS A. Inaccordancewith15ANCAC02B.0295and15ANCAC02B.0703,DWRhasprovidedaͻ{źƷĻ Viability\[ĻƷƷĻƩͼfortheBankParcelsproposedunderthisInstrument.TheSiteViabilityLetteris notanapprovalofthesitetogenerateRiparianBufferCreditsandNutrientOffsetCredits,butis a ƦƩĻƌźƒźƓğƩǤ reviewoftheBankParcelthatdetailsandconfirmsexistinglanduseconditions, definestheripariansites(Preservation,orRestoration),andidentifiesfeatures(streams,ditches, ponds,etc.)thatmeetgeneralcriteriatobesuitabletogenerateRiparianBufferCreditsand 3 NutrientOffsetCredits.Table2.0belowoutlineswhenaSiteViabilityLetterwasissuedbyDWR fortheBankParcelsproposedunderthisInstrument: Table2.0ΑSiteViabilityLetterDetails ViabilityLetter NCDWRSiteViabilityLetter BankParcel ExpirationDate EvaluationReceived CoxPondApril15,2021May19,2021May19,2023 h͸.ĻƩƩǤRoadJuly7,2021July31,2021July31,2023 LittleRiverWeaverJune8,2021August26,2021August26,2023 B. AvalidSiteViabilityLetterisrequiredpriortosubmittalofeachBPDP.SiteViabilityLetterswill eitherexpireonthedateslistedinthetableaboveoruponsubmittalofanindividualAsBuilt ReporttotheDWR,whichevercomesfirst.IfaSiteViabilityLetterexpirespriortosubmittalofa completeBPDPasdescribedinSectionVtoDWR,thentheSponsormustsubmitaformalrequest toDWRforanewSiteViabilityLetterforthatBankParcel. C. TheBankParcelsproposedforinclusionunderthisInstrumentshalleachrequireaBPDPbe submittedto,andapproved,bytheDWRpriortouseoftheindividualBankParcelsforbuffer mitigationandnutrientoffsetpurpose,sorthesaleortransferofanyassociatedcredits.The contentsoftheBPDPareprovidedinSectionV. D. BPDPssubmittedunderthisinstrumentwillbeplacedonpublicnoticeandmadeavailablefor publiccommentingfor15calendardays. E. Ingeneral,RiparianBufferCreditmaybeachievedontheseBankParcelsthroughrestoration ofDWRriparianbuffersastheyaredefinedin15ANCAC02B.0714,andotherriparianareas asallowedper15ANCAC02B.0295(n)and(o)whereapplicable.RiparianBufferCreditsare onlyattainableifthewidthoftheriparianareasareatleast20feetfromtopsofbanksalong viablestreamsandatleast30feetfromtopsofbanksalongviableditcheswhenmeasuring perpendicularandlandwardfromfeatures.Riparianbuffercreditsareattainabletoa maximumof200feetfromtopsofbanksofstreamsandamaximumof50feetfromtopsof banksofviableditches.TheviabilityoffeaturestogenerateRiparianBufferCreditisprovided intheSiteViabilityLettersfortheBankParcelsandreferencedinTable2.0ofthisInstrument. F. TheBankParcelsareintendedtoprovideNeuseRiparianBufferMitigationasfollows: 1. PlantinghardwoodtreesonaRestorationSiteasdefinedin15ANCAC02B.0295(b) adjacenttoviablestreamsandditches 2. Performingminorbankstabilizationandgradingwherebankstabilityiscompromised andwhereerosionalrills,sinkholesandgulliesareobserved. 3. MaintainingaPreservationSite,asdefinedin15ANCAC02B.0295(b)byplacinga conservationeasementaroundriparianareasalongstreamsasallowedper15NCAC02B .0295(o). 4 4. Diffusedflowwillbemaintainedonsite.TheBufferInterpretation/Clarification Memo#2008019maybeappliedwheremaintenanceofdiffuseflowonsiteis unattainable G. NutrientOffsetCreditonthesetwo(2)BankParcelsmaybeachievedthroughrestorationofthe riparianareasadjacenttoviablestreamsandviableditcheswhereagriculturewasdeterminedby DWRtobethepredominantlanduse.NutrientOffsetCreditsareonlyattainableifthewidthof therestoredriparianareasareatleastfifty(50)feetasmeasuredperpendicularandlandward fromtopsofbanksalongviablestreamsandviableditches.OntheBankParcels,thewidthofthe riparianrestorationareawillbeginatthetopofbankortherootedherbaceousvegetationand extendslandwardaminimumof50feetandamaximumof200feetonallsidesofviablefeatures. Aconservationeasementwillbesecuredtoincludethetopsofallstreamchannelandditchbanks andwillextendoutamaximumof200feet.Theviabilityoffeaturestogeneratenutrientoffset creditisprovidedintheSiteViabilityLettersfortheBankParcelsandreferencedinTable2.0 ofthisInstrument. H. TheBankParcelsareexpectedtoprovideNutrientOffsetCreditsasfollows: 1. Convertingagriculturallanduses,includinglandcurrentlyorpreviouslyusedforthe applicationofwastefromacertifiedanimalfeedingoperation,withinriparianareasto nonagriculturallandusesbyplacingaperpetualconservationeasementaround riparianareasalongstreamsandviableditchesinaccordancewith15ANCAC02B .0703(g). 2. PlantinghardwoodtreesonaRestorationSiteasdefinedin15ANCAC02B.0295(b) adjacenttoviablestreamsandviableditcheswhereagriculturehasbeendeterminedby DWRtobethepredominantlanduse. I.ThetotalareaofriparianrestorationactivitiesontheCoxPondBankParcelisexpectedtobe approximately22.3acres,19.48acresontheh͸.ĻƩƩǤRoadBankParcel,and38acresontheLittle RiverWeaverBankParcel. V. PRECONSTRUCTIONDOCUMENTATION BankParcelDevelopmentPackage A. EachBPDPsubmittedunderthisInstrumentshallbesubmittedtoDWRforreviewandmustbe approvedbyDWRpriortoanyconstructionontheBankParcel.EachBPDPmustdescribeany changesthathaveoccurredtothesitebetweenthedateoftheSiteViabilityLetterandthedate theBPDPissubmittedtoDWR.TheBPDPshallincludedetailedinformationconsistentwiththe sectionsbelowconcerning;1)sitelocation(8digitHUCisrequired);2)existingconditionswith currentphotos;3)proposedbuffermitigationandnutrientoffsetactivitiesincludingadetailed vegetationplan;4)monitoringandmaintenanceplans;5)financialassurances;6)AProjectCredit Table(seeAttachmentC)showingassociatedbuffer/nutrientcreditcalculations,whichshall includecreditgeneration,servicearea,andaccountingasappropriateforeachregulatory authority;7)streambufferdeterminationletterfromDWR;8)SiteViabilityLetterfromDWR;9) serviceareafigureforeachmitigationtypeproposedunderthisInstrument,and10)allpertinent informationincludingbutnotlimitedtopermitting,bankstabilization,culvertremoval, 5 installationofanyutilitiesindirectlyordirectlyaffectingtheBankParcel,endangeredor threatenedspecies,presenceofhistoricalsitesandanEnvironmentalDataResources(EDR) reporttoevaluateenvironmentalriskassociatedwiththelandproposedfortheBank. B. TheSponsorwillobtainallapplicablefederal,stateandlocaldocumentation, permits,or authorizationsneededtoconstructandmaintaintheBankParcel.ThisInstrumentdoesnot qualifyas,orsubstitutefor,suchdocumentation,permit,orauthorization. C. Anyrestorationactivitiesorproposedconstructionwithinthestreamchannels,riparianbuffers andotherriparianareasontheBankParceltoproduceRiparianBufferCreditand/orNutrient OffsetCreditmustbeapprovedbyDWRinwritingpriortoimplementation.Thefailureofthe Sponsortocomplywiththisrequirementmayresultinarevisedorreducedcreditrelease schedule. D. RequestsfordeviationfromtheapprovedBPDPmustbesubmittedtoDWRinwriting.Written approvalfromtheDWRmustbereceivedpriortoimplementinganydeviationfromtheapproved BPDP. PropertyDisposition&LongTermManagement E. Priortothereleaseofanycredits,theSponsorshallrecordpermanentconservationeasements attheCountyRegisterofDeed'sofficethatissufficienttoensureprotection,operation,and maintenanceofrestoredriparianbuffersandotherriparianareasforthedurationspecifiedinthe approvedBPDPs. F. Theformoftheconservationeasementshallbeconsistentwiththestandardsemployedbythe StateofNorthCarolinaintheprotectionofrestoredriparianbuffersandriparianareasandshall beapprovedbytheDWRpriortothereleaseofanycredits. G. TheSponsorshallnotgrantadditionaleasements,rightofways,oranyotherpropertyinterestin ortotheprojectareas,withoutpriorapprovalfromtheDWR. H. TheSponsoragreestoassigntheconservationeasementanditsinterestsinperpetuitytoa qualifiedholderunderNCGeneralStatuteΛͻD{ͻΜ12134etseq.and170(h)oftheInternal RevenueCodepriortothesubmittaloftheYear4MonitoringReport.Theholdershallbealand trustorstewardshipprogramthatwillholdandenforcetheconservationeasementandthe interestsinperpetuity.TheSponsorshallchoosealandtrustorstewardshipprogramthatis accreditedbytheLandTrustAccreditationCommissionand/orhasbeenapprovedbyDWRprior totheendofthefourthyearmonitoringperiod.Alandtrustmustbecertifiedunder501(c)(3)of theInternalRevenueCode. I. IntheeventtheSponsorisalsotheowneroftheunderlyingfeeinterestinthepropertythe conveyanceoftheconservationeasementtoalandtrustorstewardshipfundmustbearranged attheoutsetoftheapprovedBPDP 6 FinancialAssurancesforBankParcelDevelopment J. FollowingapprovalofeachBPDP,theSponsorshallprovidePerformance/MaintenanceBonds fromasuretycompanythatisratednolessthananͻ!ͻasratedbyA.M.Best,toconstructthe sitesaccordingtotheapprovedBPDP.Itisthe{ƦƚƓƭƚƩ͸ƭresponsibilitytoconfirmthatthesurety company isratednolessthananͻ!ͼwitheachannualbondrenewal. K. TheamountofthePerformanceBondshallbe100%oftheestimatedcostforimplementationof theriparianrestorationandotherrelatedactivitiesfortheconstructionoftheBankParcelas describedintheapprovedBPDP.Nobondshallbelessthan$150,000.00tocoverconstruction costs. L. Alternatively,inlieuofpostingaPerformanceBond,theSponsormayelecttoconstructtheBank Parcel/spriortothefirstcreditrelease. M. OnceDWRhasreleasedallcreditsforcompletionofallitemslistedbelow,thentheBankSponsor willbereleasedfromitsperformanceobligationsundertheperformancebondrequiredinItemJ andKofthissection: 1. InstrumentandBPDPApprovedbyDWR,ConservationEasementRecorded,Financial AssurancePosted; 2. Allmitigationactivitiesincludingriparianearthwork,PlantingandInstallationof MonitoringDevicesCompleted;easementboundariesadequatelymarked,andall applicablepermitsobtained; obtained 3. AsBuiltReportasdescribedinSectionVIhasbeenreceivedbyDWR;ğƓķ 4. DWRhassubmittedawrittenapprovaloftheAsBuiltReport N. Tocomplywiththissection,DWRmustbetheObligeeonallperformancebonds. VI. POSTCONSTRUCTIONDOCUMENTATION AsBuiltReport A. TheSponsoragreestoperformallnecessarywork,inaccordancewiththeprovisionsofthis InstrumentandcorrespondingBPDP,toestablish,maintain,andmonitorNeuseRiparianBuffers orotherriparianareasuntilItemsB(1)and(2)ofSectionXhavebeensatisfied. B. Within30calendardaysaftercompletingtheestablishmentofthebuffermitigationandnutrient offsetareas,theSponsorwillsubmitwrittennotificationtoDWRdocumentingthatallbuffer mitigationandnutrientoffsetactivitieshavebeencompleted.Failuretosubmitwritten notificationwithin30daysmayresultinamodifiedcreditreleasescheduleoradelayinthe issuanceofcreditreleases.Notificationshallincludeallthefollowing: 1. ShortsummaryofactivitiescompletedasrequiredpertheapprovedBPDP; 2. Figuresrepresentingallriparianrestorationandriparianpreservationactivitieswhere applicable; 7 3. Figuresrepresentinglocationofallmonitoringplotsinstalled; 4. Detailedplantingplanincludingtypeofspeciesplanted,densityofspeciesplanted,and anymodificationstotheplantingplanfromwhatwasapprovedintheBPDP; 5. Descriptionofhowtheconservationeasementboundariesweremarked;and 6. Anymajorchanges totheconservationeasementboundaryortotheamountofRiparian BufferCreditsand/orNutrientOffsetCreditsfromwhatwasproposedintheapproved BPDP. C. TheSponsorwillsubmitanasbuiltplanandreportforeachBankParcelseparatelyafter completingtheestablishmentofthebuffermitigationandnutrientoffsetareas.EachAsBuiltwill besubmittedtoDWRandwilldescribeanydeviationfromtheapprovedBPDPandwilldocument allthefollowing: 1. Riparianrestorationand/orpreservationplantingdetailsandotherconstructionactivities thatwererequiredintheBPDP,confirmationthatallboundarymarkersareinstalled, invasivespeciescontrol,monitoringdevicelocations,vegetationplotlocations,andphoto pointlocations. 2. BoundarySurveyoftheconservationeasementarea,signedandsealedbyalicensed surveyor,includinganinventoryofthefinalareasforRiparianBufferCreditsandNutrient OffsetCreditsinbothsquarefeetandacres. 3. Asbuiltmapofthebuffermitigationandnutrientoffsetareasshowingwhereriparian activitieswereperformedandanydeviationstotheBankParcelfromwhatwasapproved intheBPDP. 4. AerialmapoftheBankParcelshowingtheproposedareasforNutrientOffsetCreditsand RiparianBufferCreditsthatwasincludedintheapprovedBPDP. FinancialAssuranceforBankParcelMonitoringandMaintenance D. AftercompletionoftheriparianactivitiesandconstructionactivitiesoneachBankParcel,a separatePerformance/MaintenanceBondwillbesecuredfor100%oftheestimatedcostto implementthemonitoringandmaintenanceplanasdescribedintheapprovedBPDPandAsBuilt ReportfortheBankParcel.TheBondmustbefromasuretycompanythatisratednolessthan anͻ!'asratedbyA.M.Best,anditistheSponsor'sresponsibilitytoconfirmthesuretycompany isstillratednolessthananͻ!ͻwitheachannualbondrenewals. E. EachPerformance/MaintenanceBondshallbesecuredeachyearforaminimumoffiveyears, anduntilDWRhasreleasedallRiparianBufferCreditsandNutrientOffsetCreditstotheBank Sponsor.UponDWRapproval,thebondmaybeloweredeachyearbasedontheadjustedcostto completethemonitoring.Nobondshallbelessthan$100,000tocovermonitoringand maintenancecostsinitially. F. OnceDWRhasreleased100%ofallcreditsforcompletionofallBankParcelmilestonesdescribed inTable3ofSectionVIIIorinthecorrespondingBPDP,theBankSponsorwillbereleasedfromits performanceobligationsundertheperformancebondrequiredinDandEinthissection. 8 G. Tocomplywiththissection,DWRmustbetheObligeeonallperformancebonds. MonitoringandMaintenanceReports H. TheSponsorshallmonitoreachBankParcelasdescribedintheBPDPuntilsuchtimeasDWR determinesthattheperformancestandardsdescribedbelowhavebeenmet.Themonitoring periodshallbeaminimumoffiveconsecutiveyearsforeachBankParcel. I. PerformanceStandardsforVegetation:Nativehardwoodtreesornativehardwoodtreeandshrub speciesshouldbeplantedatadensitysufficienttoprovide260stemsperacreafterfiveyears.A minimumoffour(4)nativehardwoodtreesorfour(4)nativehardwoodtreeandshrubspecies mustbeplanted.Noonespeciesshallbegreaterthan50%oftheplantedstems.Alistofspecies forplantingwillbedetailedintheBPDPforapproval.Nativehardwoodtreevolunteerspecies maybeincludedtomeetperformancestandardsasdeterminedbytheDWR. J. A"stem"meansawoodyseedling,sapling,shrubortree,nolessthan10centimetersinheight andshallapply,ontheBankParcels,totheminimumheightthataplantedtreeorshrub shallbeatinitialplanting.Volunteerstemsthatarelessthan10centimetersshallnotbe quantifiedandincludedintheannualvegetationdataincludedwiththemonitoring reports. K. Iftheperformancestandardsofthevegetationarenotmet,supplementalplantingsmaybe required.Supplementalplantingswillbeutilizeduntiltherequireddensitieshavebeenachieved andmaintainedforfiveyears.BankParcelmaintenance,suchasensuringdiffusedflow,managing invasivespecies,andpestcontrolwillbeincludedintheBPDP. L. MonitoringReportsforRiparianBufferCredit&NutrientOffsetCredit:Reportingcriteriaofthe vegetationshallbebasedontheCarolinaVegetationSurvey(CVS)EEPProtocolforRecording VegetationLevel2PlotSamplingonlyversion4.0oranyupdatedversionsofthisprotocolinplace atthedateofacceptanceofeachBPDP.TheSponsorshallsubmittotheDWRanannual monitoringreportforeachBankParcelnolaterthanDecember31ofeachyearforaminimumof fiveconsecutiveyearsafterthefirstfullgrowingseasonforeachBankParcelunderthis instrument.VegetationdatashallnotbecollectedpriortolateAugustofeachyear.Thisreport willdescribetheconditionsoftheBankParcel,includinganevaluationoftheperformance standardsofthevegetationcontainedwithintheapprovedBPDP.Reportsshallcontainthe following: 1. AU.S.GeologicalSurveymapshowinglocationoftheBankParcel; 2. AdetailednarrativewithsupportingphotossummarizingtheconditionoftheBankParcel alongwithanymaintenanceorremediationperformedthatyear;and 3. Amap,survey,orotherfiguresshowinglocationsofsamplingplots,permanentphoto points,andlocationoftransects,Etc.;and 4. Monitoringdata,includingspecificvegetationcountsandheightsshowingthatthetrees ortreeandshrubspeciesplantedaremeetingperformancestandardsandupdated photographs;and 5. AcopyofthemostrecentBankcredit/debitlodgers;and 6. Correspondingverificationlettersfromdesignatedlocalgovernmentsuponrequest;and 9 7. CorrespondingMitigationTransferCertificatesuponrequest;and 8. Proofofperformancebondrenewaltocoverthenextmonitoringyear(whenapplicable). ContingencyPlans/RemedialActions M. IntheeventaBankParcelfailstoachievetheperformancecriteriadescribedinthisInstrument andintheapprovedBPDP,theBankSponsorshalldevelopnecessarycontingencyplansin coordinationwiththeDWRandimplementappropriateremedialactionsfortheBankParcelsand theBank.Dependingonthedegreeofremedialactionsrequired,theDWRmaymodifythe monitoringperiod. BANKPARCELCLOSURE A. BankParcelClosureforeachBankParcelunderthisInstrumentshallbeidentifiedastheevent whentheSponsorisrelievedofallitsresponsibilitiestotheBankParcelandtherearenoRiparian BufferCreditsorNutrientOffsetCreditslefttosell. B. Bank ParcelClosureshallcommenceonlyafterallfollowingeventshaveoccurred; 1. Transferorassigntheconservationeasementandallitsinterests,inperpetuity,toaland trustorstewardshipprogramasdescribedinSectionVofthisinstrument. 2. Allfiveyearsofmonitoringcompleted,andallmonitoringreportssubmittedand approvedbyDWR. 3.
