On June 14, 1999 the Division of Water Quality issued NPDES Permit No. NC0050342 to
the City of Winston-Salem for its Muddy Creek WWTP facility. In response to your request the
permit has been revised to incorporate a clarification to the toxicity language. Specifically,
compliance with the toxicity testing condition has been defined as a quarterly average chronic effect
value greater than or equal to 5.5%. Although compliance is currently based on a quarterly average, it
should be noted that in the near future compliance will be based on individual test results while a
quarterly average will be used to assess civil penalties.
Please find enclosed amended permit pages. These pages should be inserted into your permit
and the old ones discarded. All other terms and conditions contained in the original permit remain
unchanged and in full effect. These permit clarifications are issued pursuant to the requirements of
North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North
Carolina and the U. S. Environmental Protection Agency.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (3). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) — 21.0 MGD
The permittee shall conduct chronic toxicity tests using test procedures outlined in the "North Carolina Phase
II Chronic Whole Effluent Toxicity Test Procedure" (Revised -November 1995) or subsequent versions.
The effluent concentration defined as the Instream Waste Concentration (IWC) shall be 5.5%. The chronic
value will be determined using the geometric mean of the highest concentration having no detectable
impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of
reproduction or survival. The presence of 48 hour acute toxicity will be determined using Fisher's Exact Test
at 48 hours from test initiation. The definition of "detectable impairment," collection methods. exposure
regimes, and further statistical methods are described by the document referenced above.
The permit holder shall perform at a minimum. quarterly monitoring using these procedures to establish
compliance with the permit condition. The tests will be performed during the months of January, April, July.
and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter measures 48 hour acute toxicity or a
chronic value less than that specified above. then multiple concentration testing shall be performed. at a
minimum, in each of the two following months. Compliance is defined as a quarterly average chronic effect
level equal to or greater than 5.5%.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code THP3B for
the Chronic Value and TGA3B for the 48 hour Acute Toxicity measure (Pass/Fail). Additionally, DWQ Form
AT-3 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of
the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste
stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required. then monthly
monitoring will begin immediately until such time that a valid test is submitted. Upon submission of a valid
test, this monthly test requirement will revert to quarterly in the months specified above.

Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival. minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day
of the month following the month of the initial monitoring.

Revised Chronic Toxicity Language
Due to recent discussions with EPA Region IV, the Division is further modifying its
Whole Effluent Toxicity Enforcement Policy. Therefore, the -chronic toxicity language to be
used in permits will once again change. Listed below are the nine facilities that currently have
a Phase II chronic toxicity testing requirement in their NPDES permits. Our office previously
sent you a memo dated 5/10/99 requesting modification of these nine permits to include the
new chronic toxicity language. However, through discussions with EPA, our office was told
that they would not approve permits which contained that toxicity language. The chronic
language has since been revised and approved by EPA Region IV. Our office now
recommends modifying the permits for the nine facilities listed below to include the revised
permit language for chronic toxicity testing.

CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of %.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina
Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests
will be performed during the months of . Effluent sampling for this testing shall be performed at the
NPDES permitted fmal effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then
multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in
"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a
detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods,

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after
the end of the reporting period for which the report is made.

residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
