This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 'and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. In accordance with your comments on the draft NPDES permit received on May 22. 1999, the following modification has been made: • The total residual chlorine limit has been removed from outfall 002 requirements per the settlement agreement resulting from the petition for contested case filed by Winston- Salem upon issuance of the previous permit: With respect to your comment regarding the toxicity testing language. paragraphs 3 and 4 of the existing language seem to make the point that was made in your comment letter. Aquatic toxicology staff have reviewed the toxicity testing language and have determined that no modification is necessary. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you. you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes. and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Permit No. NC0050342 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (3). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) — 21.0 MGD The permittee shall conduct chronic toxicity tests using test procedures outlined in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -November 1995) or subsequent versions. The effluent concentration defined as the Instream Waste Concentration (IWC) shall be 5.5%. The chronic value will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The presence of 48 hour acute toxicity will be determined using Fisher's Exact Test at 48 hours from test initiation. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are described by the document referenced above. The permit holder shall perform at a minimum, quarterly monitoring using these procedures to establish compliance with the permit condition. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter measures 48 hour acute toxicity or a chronic value less than that specified above, then multiple concentration testing shall be performed. at a minimum, in each of the two following months. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed. using the parameter code THP3B for the Chronic Value and TGA3B for the 48 hour Acute Toxicity measure (Pass/Fail). Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 4401 Reedy Creek Road Raleigh, NC 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name. permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a valid test is submitted. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. In response to your request the permit has been revised to incorporate a clarification to the toxicity language. Specifically, compliance with the toxicity testing condition has been defined as a quarterly average chronic effect value greater than or equal to 5.5%. Although compliance is currently based on a quarterly average. it should be noted that in the near future compliance will be based on individual test results while a quarterly average will be used to assess civil penalties. Please find enclosed amended permit pages. These pages should be inserted into your permit and the old ones discarded. DWQ removed this limitation from the plant's existing permit as part of an agreement to settle an adjudication initiated by Winston-Salem following the issuance of the plant's current permit. The 002 discharge is used only when the plant's effluent flow rate exceeds the carrying capacity of the 001 outfall. When this occurs, a portion of the treated discharge overflows into a channel leading to Muddy Creek. This discharge occurs approximately five times per year during heavy rainfall events and each discharge lasts about four hours. In that a typical 002 discharge lasts for only a short while during flood events, Winston- Salem does not feel that it is appropriate for DWQ to impose a residual chlorine limit. We feel that the dilution factor resulting from the discharge into a flooded stream is adequate to insure that the chlorine residual does not violate the water quality standard for chlorine. We ask that the final permit require that we monitor for residual chlorine and that DWQ remove the proposed limit. * Special Condition A(3). entitled Chronic Toxicity Permit Limit (Quarterly)-21 MGDdoes not clearly stipulate what constitutes a violation of the permit limit. The existing language could be interpreted to mean that a single test failure constitutes non-compliance. The chronic value will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The presence of 48 hour acute toxicity will be determined using Fisher's Exact Test at 48 hours from test initiation. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -November 1993) or subsequent versions. The permit holder shall perform at a minimum, quarterly monitoring using these procedures to establish compliance with the permit condition. The tests will be performed during the months of . Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. Over the years it has undergone numerous expansions. The facility is currently permitted to discharge 15.0 MGD and 21.0 MGD upon completion of construction. An Authorization to Construct (ATC) was issued on May 31, 1996 for the expansion to 21.0 MGD. An engineer's certification for the chlorination/dechlorination facilities was received on December 3, 1998. Stanley Webb with the City's Public Works Department indicated that all construction associated with the expansion to 21.0 MGD will be completed sometime in March. He confirmed in a telephone conversation on February 5, 1999 that it would not be necessary to include effluent limitations pages for flows less than 21.0 MGD. The facility operates two outfalls. The primary outfall is labeled 001. The second outfall, 002, is essentially an overflow outfall for 001. This outfall is used when discharge to the Yadkin River through 001 is not possible. Discharge through 002 occurs perhaps once a year for approximately 2 hours. Upon permit renewal in 1994, the City filed a Petition for Contested Case Hearing with the Office of Administrative Hearings. The issues related to the petition were resolved in a mediated settlement conference held on March 10. 1995. The primary issue was with respect to cyanide. Specifically, a cyanide limit was installed in the originally issued permit. As a result of the settlement, a one-year cyanide study was completed. Also. the settlement indicated that the TRC limit would be considered a daily average instead of a daily maximum. This agreement has been maintained in the draft permit. No reasonable potential analysis is necessary for this renewal as lead has not been detected and there is no adopted state standard for zinc. No other toxicant monitoring is required outside of the facility's LTMP administered by its pretreatment program. LTMP REVIEW The facility's LTMP data is being reported on its DMRs. This data was reviewed during the compliance review. PROPOSED CHANGES: • Monitoring Frequencies: In accordance with the Division's current strategy for permitting facilities discharging in the Yadkin -Pee Dee River Basin, the monitoring frequency for total phosphorus and total nitrogen has been changed from monthly to weekly. • Effluent Pages: All effluent limitations pages for flows less than 21.0 MGD have been eliminated as all necessary construction for the expansion will be completed sometime in March. • Instream Monitoring: Due to Winston Salem's participation in the Yadkin -Pee Dee River Basin Association (the Association), instream monitoring requirements have been provisionally waived and stated as such on the effluent limitations page. • Lead Monitoring: Lead monitoring will be removed from the permit as it was never detected during 1998. • Sample Type: With the permit renewal application. the permittee requested that the sample type for all parameters monitored at outfall 002 be changed from composite to grab. The reason being that discharge occurs extremely seldom and when it occurs, it lasts for a few hours at the most. The short duration of discharge makes composite sampling impossible as it is defined in the permit. Additionally. there have been times when discharge did not last long enough to provide enough sample for analytical testing. As such. all sample types have been changed from composite to grab. However, the City should expect stricter limits for oxygen consuming wastes in the Archie Elledge NPDES permit if this facility plans any expansion of its wasteflow above its current 30 MGD limit, or if water quality standards in Salem or Muddy Creeks are not being met. Currently, the instream standard for DO is being protected, however the Division is concerned about the relatively low DO concentrations (mid 5 to 6 mg/L range) which were reported during a low stream flow period in 1995. During this period the Elledge WWTP was treating to well below its BODS limit, which suggests that the assimilative capacity of Muddy and Salem Creeks may be over allocated. Additional field data may need to be collected before an assessment could be made regarding speculative permit limits for the Muddy Creek WWTP in association with an expanded wasteflow from this facility. Additional information concerning oxygen consuming wastes and related management strategies for Salem and Muddy Creeks can be found on pages 6-14 and 6-15 of the ensed DRAFT Yadkin Basinwide Management Plan. As you may already be aware, the Division is investigating the possibility of designating all or a portion of the High Rock Lake watershed as Nutrient Sensitive Waters (NSW). Both of the City's major WWTPs would likely be affected by a reclassification to NSW of the respective receiving streams. Again, during the next 5 years no changes to NPDES permits are expected. However, the Division does recommend that major dischargers in the High Rock Lake watershed, which includes the City of Winston-Salem, act to improve phosphorous removal. Winston-Salem has several concerns regarding the existing permit monitoring requirements. We would appreciate DWQ considering these concerns while preparing the draft permit. Monitoring Requirements for 002 Discharges: The Muddy Creek Plant's 002 discharge outfall is essentially an overflow point on the 001 outfall which allows the flow that cannot be discharged to the Yadkin River via the 001 outfall to flow into Muddy Creek. An 002 discharge occurs about once a year and lasts — two hours. It occurs during flood events when the plant's discharge flow rate exceeds the hydraulic capacity of the 001 outfall. The Muddy Creek Plant's existing permit requires that a 24 hour composite sample be used to Mr. Don Safrit January 20, 1998 Page 2 monitor for CBOD-5, TSS, Ammonia, Total Nitrogen, Total Phosphorus, Lead and Zinc. An 002 discharge, however, typically lasts for only a couple of hours and this makes it impossible for us to perform monitoring on a daily composite as required by the permit. There have also been occasions when an 002 discharge did not last long enough for a composite sample to contain sufficient volume to provide analytical aliquots for all the analyses that were required on the sample. Winston-Salem feels that the duration and low flow associated with an 002 discharge, especially since it occurs during times when the stream is flooded, is such that all the monitoring requirements should be based on a grab sample. This provision will allow us to ensure that we will always have an adequate volume of sample to perform the necessary monitoring regardless of how brief the discharge was. Residual Chlorine Limit The Muddy Creek Plant's existing permit requires the plant to meet an average daily residual chlorine limit of 28 ppb upon expansion above a permitted flow of 15 MGD. The facilities necessary to allow the plant to meet this limit must be constructed in Davidson County. Davidson County has refused to grant us the special use zoning permit we need to begin work and we have filed a suit against them. The court recently ruled in Winston-Salem's favor and we are now waiting for Davidson County to either grant us a special use permit or appeal to a higher court. Since Winston-Salem is unable to meet this limit until the dechlorination facilities are constructed, we ask that the renewal permit include language delaying the implementation of this limit until DWQ receives the Engineer's Certificate of Completion. NC0050342 Winston Salem North Carolina December 15, 1997 BIOSOLIDS DISPOSAL STRATEGY CITY OF WINSTON-SALEM ARCHIE ELLEDGE WWTP MUDDY CREEK WWTP Residual biosolids from both of Winston-Salem's two wastewater treatment plants are treated to meet the Class B criteria established by the EPA's 503 Sludge Disposal Regulations. This level of treatment is achieved by subjecting the biosolids to anaerobic digestion at 94 degrees Fahrenheit for at least 45 days. The average digestion time at the Elledge Plant is -48 days and the Muddy Creek Plant's digestion time is -67 days. Both facilities meet or exceed the volatile solids reduction criteria established by USEPA for vector control. Winston-Salem's primary sludge disposal strategy is to land apply its digested biosolids to farm land at an agronomic rate. Winston-Salem currently has 8,622.08 acres of agricultural land permitted to receive biosolids. These lands lie in Davie and Yadkin counties and solids are applied to these sites in accordance with the requirements of DWQ non discharge permit WQ0000094. Winston-Salem has also applied to Region IV of EPA for a federal sludge disposal permit. We submitted this application to EPA in February of 1994 but the permit has not yet been issued. Archie Elledge WWTP The Archie Elledge WWTP currently produces —24 dry tons of digested biosolids daily. Under normal conditions, these solids are stored in one of three sludge holding lagoons until they are land applied. These three lagoons have a combined storage capacity of 32.4 million gallons. While in the lagoons free water forms as the solids settle to the bottom. This free water is removed and this process serves to thicken the solids content of the biosolids from —2% to —5%. The solids concentration in the biosolids actually land applied varies according to the crop being grown, but on average this value is 5.47%. Adverse weather and cropping patterns prevent our being able to land apply biosolids on a continual basis. During these times, solids are stored in the holding lagoons until we are able to resume land application. If conditions are such that we anticipate exhausting all our storage space before we can resume application operations, we utilize contract dewatering firms to dewater the plant's daily sludge production. The plant may also utilize its sixteen acres of sand drying beds in conjunction with mobile dewatering equipment to dewater its sludge production. All biosolids dewatered under these conditions are disposed of in a lined solid waste landfill. Biosolids Disposal Strategy Winston-Salem, N.C. Page 2 Muddy Creek WWTP The Muddy Creek WWTP produces —8 dry tons of biosolids daily. The plant has mechanical dewatering facilities which dewater —37% of the daily biosolids production. The remaining solids are stored the plant's 12.8 million gallon lagoon storage system until they are land applied. The plant's lagoons are not large enough to contain the daily sludge production during periods when land application is not possible, so belt filter presses are operated continually to supplement the lagoon's storage capacity. The Muddy Creek Plant is equipped with a sludge blending facility which is designed to mix dewatered cake with the thinner biosolids removed from the holding lagoons. This operation allows the plant to formulate a biosolids slurry with a nutrient content that is appropriate for the crop being grown on the application site. In the event the plant exhausts all its lagoon and cake storage capacity during periods when field operations cannot be conducted, the plant's strategy is to dewater its entire daily solids production and dispose of the resulting cake in a lined landfill. Future Disposal Strategy Winston-Salem has retained Black and Veatch Engineers to evaluate its residual management program and recommend an appropriate long term strategy. This evaluation concluded that Winston-Salem's total biosolids production will ultimately increase from the current 32 dtpd to —52 dtpd. Given this, it is expected that the rate of development in our service area may result in an inadequate supply of suitable farmland to support land application as our sole disposal option. Black and Veatch has recommended that Winston-Salem begin building permanent dewatering facilities for the Elledge Plant as a first phase of a long term residuals management strategy. These facilities are currently in design and we expect to begin construction in early summer of 1998. The engineer estimates that this equipment will be on line by the fall of 1999. The second phase of the management strategy recommended by Black and Veatch will be to begin piloting work to identify a Class A disposal option to augment our land application program. Our long term strategy is to continue land applying all the residual biosolids that we can and utilize the most cost effective Class A option to dispose of the excess. We will continue disposing of sludge cake in a lined landfill until the facilities are on line to implement a suitable Class A disposal option. ALTERNATIVES TO DISCHARGE ANALYSIS ARCHIE ELLEDGE WWTP MUDDY CREEK WWTP CITY OF WINSTON-SALEM, NORTH CAROLINA Upon the completion of the upgrade currently in progress at Winston-Salem's Muddy Creek WWTP, the combined permitted flow for these facilities will be 51 MGD. Winston-Salem is not requesting an increase in permitted flow capacity for either of these plants at this time. Facilities are either currently in place or under construction to adequately treat the permitted flow at each of the plants. The size and location of these plants are such that it is difficult to identify and implement alternatives to continuing point source discharges to a receiving stream. Several alternatives to surface water discharge were evaluated as part of this permit renewal application and the results of these evaluations are itemized below. Diverting Discharges to a Regional Treatment Facility: This alternative is not a viable option because there are no other treatment facilities in the area with the capacity to assimilate the flow and organic loading currently being treated by the Archie Elledge and Muddy Creek WWTPs. This option is also not considered a means by which a discharge of treated wastewater to a stream is actually prevented since the wastewater treated by the "Regional Facility" would only be discharged into a different stream. Land Applying the Treated Wastewater to Agricultural Land: This alternative would involve pumping the combined effluents from the two plant to a site where treated wastewater would be applied at rates of -5 feet/acre/year to agricultural crops or a tree farm. This alternative would involve the purchase of a large tract of land and the construction of pumping and distribution facilities needed to get the plant's effluent to the application site and apply it. The construction of a lagoon to provide - 20 days storage capacity during freezing weather and precipitation events would also be constructed. A low rate of application will also reduce the possibility of "run-off' from the site into adjacent lands or waterways. The operation of this system would have to be conducted at low hydraulic loading rates due to the low percolation rates of the clay loam soils prevalent in the upland regions of the piedmont area. Furthermore, the region in and around Winston-Salem are highly developed and there are no large tracts of land available for use as a land disposal site. Winston-Salem is also concerned that the implementation of this alternative may result in the removal of enough water from the Yadkin River Basin to cause water supply problems in the lower reaches of the river during 7Q10 flow events. Currently, the permitted flow capacity of Winston-Salem's wastewater treatment plants amounts to 14% of the rivers 7Q10 flow. Alternatives to Discharge Analysis City of Winston-Salem, North Carolina Page 3 Reduction in Discharge Flow The size and location of the Muddy Creek and Archie Elledge Wastewater Treatment Plants are such that practical alternatives to continued discharge to surface waters do not exist. Winston- Salem feels that it is necessary for us to continue discharging to a receiving stream but we have adopted a strategy to minimize the rate of increase in our discharge flows by constantly surveying our collections system to control routes of inflow and infiltration. During the past two years we have concentrated these efforts in the collection lines we incorporated into our system from the Town of Kernersville and Rural Hall. Our best estimate is that we have reduced inflow and infiltration in these systems by —40%. We have also established rainfall monitoring equipment in key drainage areas so we can correlate increases in pumping rates at lift stations with rainfall events. This allows us to determine the time lag between rainfall events and peak flow periods so we can locate likely areas where an I&I problem may be occurring. We are also reviewing proposals from various Engineering Firms to conduct a detailed study of our system to identify ways to reduce uncontaminated flow into our POTWs. The permits have been modified as follows: • Fecal Coliform Limit: The summertime 200 MPN/100 ml monthly average and 400 MPN/100 ml daily maximum fecal limit for both wastewater treatment plants (WWTP) will delayed until April 1, 1996. • Residual Chlorine Limit: Since a continuous monitoring system will be used, the chlorine residual permit limit for the Muddy Creek WWTP has been changed to 28 µg/1 as a daily average, to be effective May 1, 1997. A special condition has also been added requiring the submittal of plans and specifications for the chlorination/dechiorination system by March 1, 1996. t7 • Cyanide Limit: The effective date of the cyanide limit has been postponed until December 1, 1996. A footnote to the limit specifies that upon completion of the one year cyanide study, if DEM determines that there is no reasonable potential for the levels of cyanide in the effluent to exceed 6.6 1.1g/1, DEM will remove the limit from the permit. A special condition has also been added to the permit which requires Winston-Salem to complete a one year cyanide study analyzing the levels of cyanide in the effluent and evaluating the collection system and wastewater treatment plant to determine sources of cyanide in the effluent, incorporating by reference the mediated settlement agreement. Attached is a typed copy of the mediated settlement agreement in which the cyanide study requirements are detailed. As a result of the mediation conference, DEM and Winston-Salem are required to schedule a joint meeting with the third party consultant hired by the city to perform the cyanide study. With respect to the Muddy Creek NPDES Permit (NC0050342), the chlorine limit will become effective on May 1,1997. Winston- Salem/Forsyth County will submit plans and specifications to DEM by March 1,1996 for an authorization to construct the chlorination/dechlorination system. #2. With respect to the cyanide limit: • The City of Winston-Salem will obtain the services of a third party consultant to collect and preserve effluent samples on a weekly basis for a minimum of one year, in accordance with standard methods established by the U.S. EPA and submit split samples to at a minimum of two North Carolina certified laboratories for analysis. The data will be reported in accordance with the procedures set forth in the NPDES permit NC0037834. • City of Winston-Salem will also use the third party consultant to evaluate the collection system and wastewater treatment plant for sources of cyanide for a minimum of one year during the above effluent evaluation process. • If at the end of the year of sample collection and evaluation by the third party, it is determined by DEM that there is no cyanide in the effluent or the levels of cyanide in the effluent do not have a reasonable potential to exceed 6.6 µg /1, DEM will remove the permit limitation. • If at the end of the year of sample collection and evaluation by the third party, it is determined by DEM that there is reasonable potential to exceed 6.6 µg/1 cyanide in the effluent, the limit will take effect in six (6) months. • DEM and the City of Winston-Salem agree that the schedule as set forth above will be evaluated upon the selection of the third party consultant and subsequent consultation with DEM the City and consultant as to whether the 18 month time frame established above is feasible. This consultation shall occur within the next 30 days. The consultation will establish the procedures for verification of sample analysis to include the acceptable level of variation in the split samples.
