Box 29535 Raleigh, North Carolina 27626-0535 Dear Mr. Nizich: This letter is to confirm our telephone conversation of June 19, 1996 regarding permit limitations for Winston-Salem's Muddy Creek WWTP. The permitted flow capacity for this facility will not increase to 21MGD until construction on the upgrade is completed and the engineer's certification is received by DEM as required by the Authorization to Construct issued on May 31, 1996. The effluent dissolved oxygen limit stipulated in the table of limitations and monitoring requirements for the period beginning upon expansion above 15 MGD will not be in effect until the plant's permitted flow capacity increases to 21 MGD. We are required to continue monitoring effluent dissolved oxygen using the schedule in the table of monitoring requirements entitled "until expansion above 15 MGD". Box 29535 Raleigh, North Carolina 27626-0535 Re: Muddy Creek WWTP Upgrade NPDES No. NC0050342 Winston-Salem, N.C. Dear Ms. Sullins: As we discussed in our phone conversation of June 18, 1996, only three contractors submitted 7- bids on a contract to upgrade Winston-Salem's Muddy Creek WWTP and the low bid amounted to $2,200,000 more than the engineer's estimate of $5,449,000. The next lowest bid as $4,184,000 more than the engineer's estimate. We feel that the cost to begin work on the entire upgrade project is prohibitively high at this time and all these bids will be rejected. Winston-Salem intends to rebid the project in phases so bidding on some items can be postponed until market conditions are more favorable. Those portions of the upgrade which were needed to comply with the plant's residual chlorine limit, scheduled to become effective on May 1, 1997, will be rebid immediately. A contract will be awarded in September for this first phase of the upgrade. Given that most of this construction will have to take place during the winter months it is likely that substantial delays will occur due to inclement weather. Work may also be delayed due to Davidson County requiring us to obtain a special use zoning permit. A public hearing must be held before this permit can be issued and substantial opposition may be encountered. it A Page 2 Pk/V. 5j16(>1. This additional timeAa" should be sufficient to offset any delays in construction due to weather and provide us time to either obtain our special use zoning petition from Davidson County. We intend to solicit bids on the balance of the project when the demand for contractors subsides to the point where we can have a truly competitive bidding process. Our engineer estimates that it may be early 1997 before this occurs. All phases of this construction will be performed under the Authorization to Construct issued by your office on June 1, 1996. Per your instructions, we will have our engineer provide a partial certification of completion as each phase of the project is completed and placed into service.
