Pell Town Manager Post Office Drawer AA Pilot Mountain, North Carolina 27041 Dear Mr. Pell: AVA NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES Subject: Final NPDES Permit Permit No. NC0026646 Town of Pilot Mountain WWTP Surry County In accordance with the application for a discharge permit received on December 2, 1998, the Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended. Please note the following changes from the previous permit (as indicated in the draft) have been finalized: • Limits for Cadmium (Cd) and Cyanide (CN) have changed. Because data indicate there is reasonable potential to exceed allowable concentrations based on acute water quality criteria, the limits have been modified. Monitoring must still be performed weekly, consistent with other Class III facilities. • In light of information available regarding CN measurement techniques, the Division feels it is reasonable to specify the quantitation level for CN as 10 14/1. CN levels reported as "<10 14/1" will be considered zero for compliance purposes. This information is footnoted on the effluent pages. • Monitoring requirements for Arsenic (As) and Selenium (Se) have been removed. Because the facility already monitors these parameters as part of its Long -Term Monitoring Plan (LTMP), monitoring requirements are not necessary in the NPDES discharge permit. • Weekly monitoring for Total Nitrogen and Phosphorus has been added. This change is consistent with an effort to gather more data about nutrient loading in this portion of the watershed. • Chronic Toxicity monitoring must be performed concurrently with metals, cyanide, and zinc monitoring. This change will ensure Whole Effluent Toxicity (WET) ,data may be compared with toxicant data. Optimizing Phosphorus Removal This facility is located in a watershed draining to High Rock Lake, where high phosphorus loading has been documented by numerous studies. The Yadkin -Pee Dee River Basinwide Water Quality Management Plan recommends that dischargers in the High Rock Lake watershed conduct evaluations of existing facilities and optimize phosphorus removal to the extent practicable during the next permit cycle. Permit No. NC0026646 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (3). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)-1.5 MGD The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 3 % (defined as treatment two in the procedure document). The permit holder shall perform uarterl monitoring using this procedure to establish compliance with the permit condition. The tests will ebe performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 4401 Reedy Creek Road Raleigh, North Carolina 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A review of the DMR files since that time indicated facility is performing within limits (see attached notes). According to a 1/12/99 letter from the Pretreatment Unit, the SIU Armtex closed and moved. This facility had contributed 0.5 MGD, or 60% of Pilot Mt.'s capacity. The facility has been delinquent on several occasions with Toxicity Monitoring Reports. Per a phone conversation with Kevin Bowden at ESB, 3/99 was the fifth time the facility has failed to send in any WET testing results. The probable cause is personnel problems recently experienced by Pilot Mt. WWTP. Facility was assessed civil penalties for two of these occasions in 10/98. Region —any comments on what facility is doing to rectify problem? Since this portion of the Ararat is impaired, and elevated fecal levels have been observed, instream fecal monitoring has been retained at this renewal. Conductivity was also retained since this facility accepts industrial waste. All changes are consistent with North Carolina's Anti -Degradation Policy. This facility is located in sub -basin 03-07-03, which is in the High Rock Lake watershed. Since High Rock Lake is impacted by heavy phosphorus loading, the Basinwide plan recommends that dischargers in this watershed evaluate existing facilities for optimizing phosphorus removal and attempt to minimize loading discharged. Pilot Mountain currently discharges concentrations of 2-5 mg/1 of total phosphorus. Permit Information: The previous permit was issued March 2, 1998. See Fact Sheet. Basinwide Plan Information: • This sub -basin (03-07-03) contains the Ararat River and its tribs. Macroinvertebrate sites on the Ararat had Good -Fair bioclassifications in '96. Mt. Airy WWTP and Pilot Mt. WWTP (moved to river in '96) both discharge to Ararat. • Nearest ambient station is upstream near confluence with Flat Shoal Cr. Ambient , monitoring has documented impacts of point sources; fecal coliform appear to be a chronic problem at ambient sites, and suspended sediments are also a problem. The Ararat River regularly has total residue and conductivity values double that of the Yadkin. • This section of the Ararat River is impaired (Partially Supporting). Fecal and turbidity levels exceed the standard, and considerable sedimentation are evident, and sources are both point and non -point. The old location of Pilot Mt.'s discharge (.Heatherly Cr) is also impaired (toxicity problems) . Since the facility moved discharge to the Ararat River,no instream DO violations have been reported. Instream data from Mt. Airy suggests possible water quality problems pdue to oxygen -consuming wastes. • Additional activities/resources are needed to identify causes of impairment in the Ararat; no management strategies have yet been developed for this waterbody. DWQ igntends to develop NPS managemenstrategies, as well. Correspondence: • 1/12/99 Pretreatment Compliance Inspection report indicated Armtex closed their plant in '97 and moved. This plant contributed 0.5 MGD, or 60% of the hydraulic flow. • 10/28/98 letter assessed a civil penalty ($500) for failure of the facility to submit toxicity monitoring results in May and June. CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 3 % (defined as treatment two in the procedure document). Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Although the arsenic detection was well below the allowable effluent concen1rations at o and 3:O MGD, its concentration was well above a water uali standard, Thus, it is considered a _.... pollutant of concern and monitoring (lout no limit) will be required. Monitoring will not be _required for any other inorganic parameters detected during the APAM analyses because allowable effluent concentrations are significantly greater than detected concentrations. In addition, for these other inorganic parameters, the detections were also below the water quality standards. • • Bromodichloromethane, bromoform, chloroform, and dibromochloromethane were all detected at concentrations less than 50 ug/1 during the 1995 APAM sampling event. At those concentrations, it is expected that these four compounds originated from formation of chlorine with organic matter (i.e.are likely disinfection by-products). All four of these compounds are carcinogens, yet monitoring will not be required for the following two reasons: 1) Concentrations detected were below federal criteria, and 2) None of the four compounds were detected during most recent APAM sampling event. The APAM will no longer be required in the NPDES permit. Instream Monitoring Review of instream data from January 1995 through May 1997 indicates that the discharge generally does not appear to be having an adverse impact on the receiving stream. There are a few instances (5/21,22/96 and 8/19-21/96) where fecal coliform may have had an adverse impact on the stream. The facility is conducting instream monitoring for dissolved oxygen although is not required. Compliance Summary On October 1, 1996, the SOC expired and the final limits for Pilot Mountain became effective. Review of compliance data for the period May 1996 - March 1997 indicated the following violations: NH3N monthly average violations (9/96, 10/96), TSS monthly average violations (8/96, 11/96), TSS weekly average violation (9/16-20), BOD weekly average violation (1/6-10), fecal coliform weekly average violations (8/19-23, 11/4-8) and fecal coliform daily maximum violation (10/1/96). The facility has passed the majority of its toxicity tests (Chronic), but most recently failed in July 1996. Average flows at the treatment facility indicate they are operating under a permitted flow of 1.5 MGD. Review of compliance data for the period May 1996 - March 1997 indicated the following violations: NH3N monthly average violations (9/96, 10/96), TSS monthly average violations (8/96, 11/96), TSS weekly average violation (9/16-20), BOD weekly average violation (1/6-10), fecal coliform weekly average violations (8/19-23, 11/4-8) and fecal coliform daily maximum violation (10/1/96). - The facility has passed the majority of its toxicity tests (Chronic), but most recently failed in July 1996. - - Average flows at the treatment facility indicate they are operating under a permitted flow of 1.5 MGD. Instream Monitoring Review of instream data from January 1995 through May 1997 indicates that the discharge does not appear to be having an adverse impact on the receiving stream. There are a few instances (5/21,22/96 and 8/19-21/96) where fecal coliform may Have had an adverse k impact on the stream. The facility is conducting instream monitoring for dissolved oxygen although is not required. The ammonia toxicity mass balance calculation using S7Q10 and permitted flows indicated that the ammonia limits will also remain unchanged from the previous permit period: 28.6 (summer at 1.5 MGD) and 15.0 mg/1(summer at 3.0 MGD) and no limits in the winter. The chlorine toxicity mass balance calculation using S7Q 10 and permitted flows indicated very high chlorine limits and thus the cap of 28 ug/1 will remain unchanged in the permit. Total nitrogen effluent concentrations ranged from about 5-14 mg/1 and total phosphorus effluent concentrations ranged from 2-5 mg/1, but the treatment system does not discharge into a nutrient limited stream. Thus, these concentrations are not expected to adversely impact the receiving stream. Recommend the temperature footnote be eliminated from the permit because • this is not a thermal discharge. The Long Term Monitoring Plan (LTMP) requires monitoring for all of the parameters listed in the above table. Monitoring (but no limit) will be required for copper and silver. Although the MPC exceeded the AEC for these two parameters, they do not have water quality standards, only action levels. The Pretreatment Allocation table indicates that copper, cyanide, lead, and zinc are expected to be discharged from the three industries which discharge to Pilot Mountain WWTP. Selenium monitoring will be required (but not limited) because the 1996 detection was greater than the allowable effluent concentration at 3.0 MGD. Although the arsenic detection was well below the allowable effluent concentrations at both 1.5 and 3.0 MGD, its concentration was well above the water quality standard. Thus, it is consideered a pollutant of concern and monitoring (but no limit) will be required. Monitoring will not be required for any other inorganic parameters detected during the APAM analyses because allowable effluent concentrations are significantly greater than detected concentrations. In addition, for these other inorganic parameters, the detections were also below the water quality standards. Bromodichloromethane, bromoform, chloroform, and dibromochloromethane were all detected at concentrations less than 50 ug/1 during the 1995 APAM sampling event. At - those concentrations, it is expected that these four compounds originated from formation of chlorine with organic matter (i.e.are likely disinfection by-products). All four of these compounds are carcinogens, yet monitoring will not be required for the following two reasons: 1) Concentrations detected were below federal criteria, and 2) None of the four compounds were detected during most recent APAM sampling event. The APAM will no longer be required in the NPDES permit.
