Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on April 28, 2004. This permit includes a TRC limit that will take effect on February 1, 2006. If you wish to install dechlorination equipment, the Division has promulgated a simplified approval process for such projects. Guidance for approval of dechlorination projects is attached. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included herein. Town of Pilot Mountain is hereby authorized to: 1. Continue to operate an existing 1.5 MGD extended aeration facility consisting of an influent pump station, oxidation ditch, two clarifiers, chlorination, step reaeration, and an aerated sludge holding unit, located at Town of Pilot Mountain Wastewater Treatment Plant (WWTP), on Lynchburg Road, near Pilot Mountain, Surry County, and 2. After receiving an Authorization to Construct (ATC) from the Division of Water Quality for the necessary expansion/upgrade of the facility, operate a 3.0 MGD wastewater treatment system, and 3. Discharge from said treatment works at the location specified on the attached map into the Ararat River, which is classified as C waters in the Yadkin -Pee Dee River Basin. The total residual chlorine limit takes effect February 1, 2006. This time period is allowed in order for the facility to budget and design/construct the dechlorination or alternative disinfection systems. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC0026646 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (3) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (Quarterly) 1.5 MGD The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 3 % (defined as treatment two in the procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 4401 Reedy Creek Road Raleigh, North Carolina 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Town has separate sewer collection system. Facility has a permitted flow of 1.5 MGD discharging into Ararat River. For the past 2 years annual average flow varied within the range of 0.342-0.372 MGD. The Ararat River is on the 303 d list due to biological impairment, sediment is listed as one of the main causes of impairment. The main potential sources of pollution listed on 303d list are urban runoff, agriculture and municipal wastewater. The Town of Pilot Mountain has 2 significant industrial users and a full-scale pretreatment program. REASONABLE POTENTIAL ANALYSIS The following parameters are monitored through the permit: Cd, Cn, Cu, Zn, Ag, The following parameters are monitored quarterly through the pretreatment program: As, Cd, Cr, Cu, Pb, Hg, Mo, Ni, Se, Zn, Cn. Reasonable potential analyses were conducted forall the parameters monitored in the permit and through the pretreatment program (see attached). TOXICITY TESTING: Type of Toxicity Test: Existing Limit: Recommended Limit: Monitoring Schedule: Chronic P/F 001: Chronic P/F @ 3% 001: Chronic P/F @ 3% January, April, July, and October The facility has been consistently passing its WET tests with one exception. The toxicity test failed during October 2002. DWQ has notified the facility about steps they will be required to take under the Copper and Zinc Action Level Policy if they fail two or more toxicity tests during a calendar quarter. COMPLIANCE SUMMARY: Page 1 Version: June 15, 2004 DMRs have been reviewed for the period January 2000 through October 2003. Facility has a mixed compliance record. During review period following limit violations have occurred: 10/17/00 — Cn daily max.; 12/2000 — NH3 weekly average; 12/12/00 — Cn daily max.; 01/2001 — TSS weekly average for 3 weeks and TSS monthly average; 01/01/00 — Cn daily max.; 02/2001 BOD monthly average and TSS monthly average; 02/12/01 — Cn daily max.; 02/18/01 — Cn daily max.; 02/27/01 — Cn daily max; 06/27/01 — Cn daily max; 07/03/01 — Cn daily max.; 07/26/01 — Cn daily max.; 6/23/03 - Cn daily max., TSS weekly average and monthly average. A compliance evaluation inspection conducted on October 23, 2003 found that facility is well maintained and properly operated: A few minor issues that needed to be addressed were the method for collecting composite samples and monitoring frequencies for temperature, Cu, Ag, and Zn. An on -site inspection conducted on December 14, 2001 did not find any operational or maintenance problems, although it was noted that there is excessive amounts of sludge stored on the property. A compliance evaluation inspection conducted on October 19, 2000 found following deficiencies: too much sludge stored on the property, and some minor issues with DMRs and records. INSTREAM MONITORING: Instream monitoring is required for temperature, dissolved oxygen, fecal coliform, and conductivity. The facility is a member of the Yadkin -Pee Dee Monitoring Coalition, and all their instream monitoring is conditionally waived for the duration of their membership in the Coalition. Analysis of DO, temperature and conductivity data showed that facility has no negative impact on DO and temperature of the stream (table is attached). PROPOSED CHANGES: • Monitoring Frequencies: Weekly monitoring for lead has been introduced due to the implementation of the new permit limit. Monitoring for cadmium and cyanide has been reduced to 2/month due to the elimination of the limit. Monitoring for oil and grease has been reduced to weekly based on effluent data. • Limits: Based on Reasonable Potential Analysis, a limit is being introduced for lead. A weekly average limit for ammonia nitrogen has been added to the permit, and a daily maximum limit for total residual chlorine has been added to the permit. Limits for cadmium and cyanide have been eliminated based on Reasonable Potential Analysis. • Priority pollutant monitoring on an annual basis has been added to fulfill the permit application requirement in the future. Due to the facility's toxicity record, limits for these action level standards will not be implemented, but monitoring will remain.
