Good afternoon Mitchell,
After further review, our project meets all of the conditions under GC 4249 for NWP 18 and we will not require an
Individual Water Quality Certification. We will instead just require a General Water Quality Certification.
Could you please send me an invoice for the review fee that I could pass along to my client?

Hello Mr. Morley,

As discussed over the phone, the North Carolina Division of Water Resources has not received the application review fee
nor plans for the subject application dated March 01, 2022.
The cover letter received with your PCN application requests coverage under GC 4249 for fill impacts of 0.70 acres of
wetlands and stream impacts of 82 linear feet to an unnamed tributary to the Catawba River (Classification: WS‐IV).
Per our phone conversation, if your project does not exceed the thresholds and meets the conditions of GC4249, an
individual certification is not required. Ensure to notify the division by emailing mitchell.anderson@ncdenr.gov if you
wish to withdraw your application for an Individual Water Quality Certification.

If your project exceeds the thresholds or cannot meet the conditions of GC4249, an individual certification is required.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
You may email required documents to mitchell.anderson@ncdenr.gov and submit fee through the online portal by using
the link provided in the application fee request email.
