Subject:DWR 22-0193 Flormann Shoreline_ Request for Additional Information
Hello Mr. Fraley,
Thank you for taking my call to discuss this project.
On March 02, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on‐hold until all of the following information is received:
1. Plans received with the subject application indicate proposed riprap stabilization will extend 4 feet below
and 4 feet above the ordinary high water mark. Work of this nature is typically covered by Regional General
Permit 30 issued by the USACE and written confirmation for coverage under General Water Quality
Certification No. 4502 by the Division of Water Resources. The proposed stabilization may exceed the
permitted limits detailed in RGP 30. Please provide revised plans that comply with the permit conditions of
RGP 30 or provide confirmation of coverage from the United States Army Corp of Engineers. [NCAC 02H
.0502(c)], [15A NCAC 02H .0502(a)(9)]
2. The photograph of the shoreline provided with the shoreline stabilization application does not indicate
active shoreline erosion. Please provide a photograph of the areas subject to erosion. Please note, material
placed for shoreline stabilization should only be placed where shoreline is actively eroding and should be the
minimum needed for erosion protection. [NCAC 02H .0502(c)], [15A NCAC 02H .0502(a)(9)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee. Please be aware that you have no
authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the
state may be a violation of North Carolina General Statutes and Administrative Code.
