Dear Secretary Ross:
As Mayor of Stallings, I wrote to you on June 30, 2005, sharing my concerns about the
impact of a proposed 1.3 million square foot shopping mall on the the endangered Cazolina
Heelsplitter Mussel and other rare and endangered aquatic species in Goose Creek.
The Town. of Stallings is concerned about the adverse effect upon water quality in the Goose
Creek watershed and would again like to ask that the NCDENR require the submittal of an
application for an individual water quality certification for the Bridges at Mint Hill project.
Our town feels that the same environmental protections placed upon Union County for the
Cazolina Heelsplitter Mussel will not be required in Mecklenburg County or upon this
project; therefore, we again respectfully request the water quality certification for this
Mecklenburg County project.

The Town of Stallings is very concerned about the impacts of a proposed 1.3 million squaze
foot shopping mall on the endangered Cazolina Heelsplitter Mussel and other raze and
endangered aquatic species in Goose Creek. This mall is to be built on either bank of the
Goose Creek, at its headwaters. Because the proposed project is likely to have a significant
adverse effect upon water quality in the Goose Creek that could eliminate rare and
endangered species important to our state's natural heritage, we request that North Cazolina
Department of Environment and Natural Resources exercise its discretionary authority and
require the submittal of an application for an individual water quality certification for this
project.
On April 15, 2005, the United States Army Corps of Engineers received a preconstruction
notification for proposed stream impacts at The Bridges at Mint Hill in Mecklenburg
County. Since then, the North Carolina Wildlife Resources Commission, the North Carolina
Natural Heritage Program, and the United States Fish and Wildlife Service have each
expressed serious concerns about the direct and indirect impacts that this project will have on
Goose Creek water quality and the rare and endangered aquatic species that have the Goose
Creek as habitat. These expert agencies have concerns about the impacts of construction-
related sedimentation, the inadequacy of proposed buffers, inadequate post-construction
stormwater management, and the importance of maintaining the existing hydrograph
conditions. To my knowledge, North Carolina Division of Water Quality has not sent any
comment on this project to the Corps of Engineers.
Union County and the Town of Stallings have worked diligently with the North Cazolina
Wildlife Resources Commission and U. S. Fish and Wildlife to protect the endangered
Cazolina Heelsplitter Mussel. We have cooperated to limit development in certain areas of
the county (which included Lawyers Road in Stallings) to protect the Carolina Heelsplitter
Mussel. We aze very concerned that the same environmental protections placed upon Union
County will not be required in Mecklenburg County or upon this project. For these reasons,
we request that the NCDENR, Division of Water Quality, require General Growth Properties
and Childress Klein Properties to submit a format application for Individual Water Quality
Certification so as to prevent significant adverse impacts to the water quality of the Goose
Creek from the direct and indirect effect of this project.
