It's below threshold. They have good buffers. In general it looks like a good
project. If the heel splitters aren't threatened [no data or indicator to support],
I don't think one is required, but that doesn't mean there shouldn't be one so
everyone can voice their concerns and may help with future stream/wetland impacts.
I don't know much about the heel splitter. The main channel (Goose Creek) is just a
straight, channelized, incised stream, with cows walking through it. I am/was trying
to get some decent enhancement/restoration as mitigation for the section running
through the project. Cumulative impacts issue...it is right off 485 so if not here
it would be the next exit up or down.
If there is a hearing, lets do it and move on.

this is a fairly controversial project - the nearby town has objected (granted for
reasons that may include the fact that they want the mall instead), the Southern
Environmental Law Center and Wildlife Resources want a hearing and/or Individual
Certification. In addition, the cumulative impact aspects of the project are
daunting (i'll call the consultant to see what progress has been made in this
regard) and the waters are listed on the 303 (d) list along with the endangered
species. for these reasons, my recommendation is to have a hearing. cyndi may
have more to say as well.
alan - what does MRO think about a hearing? please advise.
tom - i'll get a copy of the application and material up to you soon for a
decision on the hearing.

getting a submittal to us (to address our incomplete
stuff) later this week supposedly.

as you may have heard, Cyndi Karoly is sick (pancreatic, gallstones, local
infection, etc.) and will be out for several weeks. she asked me to look at the
Bridges at Mint Hill project in Mecklenburg. Have you (the Corps that is) made a
decision about an Individual Permit versus NWP yet? we have several requests to
do an Individual Certification (which - unlike the Corps - does not change our
review process just requires more public input). i am leaning toward an
Individual Certification if you do not do an IP (if you do an IP, there will
automatically have to be an Individual Certification based on your Public
Notice). Please advise. the project is still on hold for us - they have not
responded to the June 14 letter for more information. once you decide on IP vs
NWP, i'll get ahold of them to work on the Cumulative Impact analysis. This will
require action by the Town to adopt proper land use control measures so they may
as well start that process. tom - once the Corps decides on the permit type, i'll
talk to you about these issues.
