Thank you for tracking that down for us. I noticed Nationwide Permit Number 14 was referenced in the letter as being required. Based on our correspondence below with COE, we were with the understanding that a Nationwide Permit 3 would be needed. However, I did not know if the minor changes performed with riprap and your other concerns warranted a change of Nationwide Permit Classification. I wanted to check with you about this discrepancy from our prior conversations, before beginning the Nationwide Permit 14 application process. The app will change to a NW3. Still need clarification on the use of rip rap. The amount proposed appears excessive. Discussion earlier that the rip rap would be placed on the bank only. Also Class II rip rap should be used, will be a requirement. Notification to us is not required if total impact is < 40 additional ft of the existing impact. But must meet all conditions of the general certification : #3883 New culvert shall be 6 ft longer than existing. The pump around will impact ? ft. Rip rap in the stream shall be ? ft. Based on the information you provided during this discussion and the submitted pre- construction notification (PCN) package, your work is authorized by Nationwide Permit (NWP) 3 for Maintenance and does not require a PCN provided it is accomplished in strict accordance with the NWP 3 conditions and submitted plans. Any violation of the attached conditions or deviation from your plans may subject the permittee to a stop work order, a restoration order and /or appropriate legal action. Attached is a copy of the NWP 3 and the applicable permit conditions. The expiration date for the permit authorization is March 19, 2017 unless the nationwide authorization is modified, suspended or revoked. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case - by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 of the Clean Water Act may also require an individual Section 401 Water Quality Certification. All rip rap is to be installed on banks, and the volume has been greatly scaled back per your recommendation. Yes, the existing corrugated rusted pipe culvert is slightly shorter than the proposed (about 3 feet shorter). Proposed precast culvert is 56 feet in length. We felt we needed the additional length to deal with the potential of erosion due to high / steep embankments. I will be in the field tomorrow.
