Jeanette: Thank you for providing us the draft renewal of the NPDES permit for the Sandy Point development project. We observe, however, that a permit "trigger" for implementing the reporting and enforcement regime, associated with a comprehensive SWMP, does not appear in the draft permit. We do understand that a specific State Coastal SWMP for each phase of development at Sandy Point is required to be submitted to DEMLR (Washington Area Region) before any construction occurs. The need for a trigger, of course, arises from the unique nature of the Sandy Point project, which is to become a private mixed-use community, and because we have not yet commenced physical development at Sandy Point. Accordingly, we anticipated a trigger such as you suggested in your email of August 1st last year: the "trigger will likely be a population density of 1,000 people per square mile or 400 housing units per square mile [Ref. 15A NCAC 02H .0151(2)(B)(ii)] unless a contribution to impairment of State waters is shown [Ref. 15A NCAC 02H .0151(c)]." So, we anticipated your acknowledging and publishing the trigger in the renewed and revised permit. Please let us know whether and how the draft permit must be revised. Thank you. For the record, we have recently participated in scoping meetings with an architectural team and expect to announce phased commencement of the Sandy Point development project in the near future. Comments on the draft permit will be accepted through February 27, 2022. This is the new permit format, so it looks a little different than the one you already have, but is the same for the most part. The big change is that the Stormwater Management Plan (SWMP) has to be submitted to DEQ for approval 90 days prior to commencement of construction.
