The attached draft MS4 permit renewal will publish for public notice next week with comments accepted through February 27, 2022. This MS4 permittee is different than every other MS4 in NC. The permittee (The Fund for Sandy Point, LLC) is not a public entity. Sandy Point is a private New Urban Waterfront Development pilot project (NUWD) which was required to obtain an MS4 permit in accordance with NC Session Law 2004-117. Construction of the Sandy Point NUWD project has never started with the exception of installing a dock on Albemarle Sound. They have maintained continuous MS4 permit coverage since 2007 to comply with the session law and numerous other development permits which were issued predicated on this project maintaining an MS4 permit. The Sandy Point NUWD project is also subject to and maintains stormwater permits for: Stormwater Management Requirements for Coastal Counties under NCAC 15 A 02H .1019, which is a qualifying alternative program for MS4 post-construction in NC; NCG010000 for construction activities; and NC Sediment Pollution Control Act requirements. The draft MS4 permit is the same as all the other Phase II permits, with the exception that the required Stormwater Management Plan must be submitted for NCDEQ review and approval ninety (90) days of either the Sandy Point Development reaching a population of 1,000; or the Sandy Point Development being shown to be contributing to an impairment of State waters, as determined under the requirements of 33 U.S.C. 1313(d). This is the point at which Sandy Point would no longer qualify for a permitting exemption under 15A NCAC 02H .0151(c). If you have any questions or comments, please contact me via email.
