We do have an application in house for the subject project. They have applied for a Nationwide Permit from the USACOE (they issue the permit based in part on our water quality certification). The COE has not made a decision to require an individual permit. We have issued genera1401 water quality certifications that match the COE's NW permits. I am not aware of another situation where we have determined that we need to issue an individual certification where a NW permit application has been deemed appropriate by the COE. There appears to be discretion within our rules to take such an action, at this point, I do not believe we have sufficient information to warrant such action. Some specifics on the project: the impacts are relatively minor (654 feet of intermittent stream impact and less than 2001inear feet of perennial stream, they are proposing an open cut across Goose Creek of 40 LF -this could be handled by not allowing an open cut, i.e. require boring). The property in question is 7 miles upstream from the known endangered species population. The COE has requested input from USF&WL as to whether they intend to request a formal Section 7 consultation (if they think it might or will jeopardize a population, then a formal consultation would be called for by the USF&WL, I would imagine that it would be at this juncture that a decision would be made on whether the COE thinks an individual permit would be needed). The application for the genera1401 certification is on hold at the moment, as we have requested the applicant provide asecondary/cumulative impacts analysis.
