Dear Mr. Pappas:
The Division has reviewed your request for revision of the NPDES permit for oil and grease
monitoring and deletion of the summer and winter NH3 limits that will be effective in May 2002. After
review of compliance data and consultation with regional staff, the following modifications will be included
in the permit:
• The monitoring frequency for oil and grease will be modified from weekly to two times per
month (2/month). Captain Stevens Seafood is classified as a Grade I biological control
treatment system and the monitoring frequency for the parameter of oil and grease is
twice month.
• The addition of twice per month monitoring for MBAS. This parameter was added
because of kitchen waste and the cleaning that must taken place at the restaurant.
It was also requested that the summer and winter NH3 limits of 2 and 4 mg/1 be removed prior
to their implementation date of May 1, 2002. Our records indicate that Captain Stevens Seafood
discharges to a zero flow stream. For the protection of the aquatic life from ammonia toxicity, the NH3
limits have been assigned. Conversations with facility staff and regional office personnel indicate that
there is always flow in the UT Reedy Creek. DWQ methods for estimating streamflow are not
adequate for a receiving stream of this size with a drainage area less than one square mile. It is our
recommendation that Captain Stevens Seafood solicit an estimate of streamflow from the United States
Geological Survey (USGS). Please contact Mr. Curtis Weaver at (919) — 471-4000 with your request.
There will be a fee charged for the estimate and a copy of a topo map with the discharge point of
Captains Stevens Restaurant will be needed. If a new estimate of positive streamflow is provided to
DWQ, then the NH3 limits will be reevaluated. If there is no revision of flow, then the NH3 limits will
be in effect on May 1, 2002 as noted in the permit.
Please find enclosed the amended Effluent pages for outfall 001, which should be inserted into your
permit. The old pages should be discarded. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency.

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be
final and binding.
Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change in ownership or control of this discharge.

5/23/2000 - Captain Stevens has requested modification to the permit.
1) Requesting reduction in monitoring frequency for Oil and Grease limit from weekly
to 2/month.
2) Requesting removal of NH3 limits of 2 and 4 mg/1. NH3 limits recommended
because stream is zero flow.
Talked with Jennifer Frye of WSRO. She said that O&G for a Class I facility should
probably be 2/month. We were unable to find the correct SIC code and category for a
restaurant. Captains Stevens has a subsurface sandfilter system and probably cannot
meet the NH3 limit of 2 and 4. They would need another system to meet 2 & 4. She
indicates that every time that she had been to the site, the UT had flow in it. The
stream has all characteristics of a channel; it is not a ditch. There are no reports of the
stream being dry. Recommends that we look at the stream flow again and see if it is
positive. No indication that city sewer will come out near them. Current plans for
sewer extension will miss Captain Stevens's area. May want to check to see if any plans
for sewer within the next 3-5 years. Also may want to consider relocation directly to
Reedy Creek, since the outfall is not very far from the mainstem.
Talked with Quintin Campbell of the facility: told him that facility may need to get
evaluation for streamflow of the receiving stream. Our methods indicate that the
drainage area for Captain Stevens (0.95 square miles) is unacceptable for estimating the
flow with the regression equations. USGS may be able to determine flow for the facility.
Need to send address and name of USGS contact for evaluation of streamflow.
Need to send effluent sheets with new Oil and Grease monitoring frequency and MBAS
monitoring.
Recommendation:
• Will reduce monitoring frequency for Oil & Grease from weekly to 2/month
• Will add effluent monitoring for MBAS to be conducted 2/month
• Will send name and phone number of USGS contact for evaluation of
streamflow

Jackie, I passed you a minor mod request on this facility a while back.
Turns out there's one more item to check. (I placed the notes in your
mailbox.)
When updating the permit on IMS, Ellen found a mention of MBAS
monitoring in Jeff's cover letter. However, MBAS monitoring wasn't on
the effluent page.
When you issue the mod, please confirm whether or not MBAS should be in
the final permit. When compliance gets a copy of the mod they can make
any corrections necessary.
Thanks for your help with this - I should have reviewed Jeff's work more
carefully before finalizing the permit.

Re: Permit # NC0059218
I would like to request that the oil and grease sampling
be done 2 times a month instead of weekly. This would save
me $50.00 to $75.00 per month, not including the trips to
the lab.
I would also like to request the (NH3N) ammonia limits be
lifted. The discharge stream is a very strong stream.
