This letter is to inform you that the Division has finalized its review and the comment
period is now closed for NPDES permit NC0059218. A final copy of the permit is attached to
this letter. This permit is issued pursuant to the requirements of the North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the US Environmental Protection Agency dated December 6, 1983.
The following list has been included to outline the changes that were addressed in
the draft permit. These changes remain unchanged in the final permit.
➢ The permit expiration date has been changed. The permit renewal will expire on
May 31, 2004. The expiration date has been revised so that an equal number of
permit renewals will come in at any one time. This change will allow the Division
to issue permits more efficiently.
> The summer and winter limits for ammonia have been revised. The facility will be
required to meet a summer limit of 2.0 mg/1 and a winter limit of 4.0 mg/1 by May
1, 2002. It is division policy to include these limits for facilities that discharge into
waters of the state classified as zero flow streams.
> A limit for oil and grease has been included in the draft permit. This limit was
incorporated due to the presence of kitchen waste in the discharge.
> A requirement to monitor temperature on a daily basis has been included in the
draft permit. This change is consistent with the requirements for Class I facilities
as outlined in the North Carolina Administrative Code 2B.0500.
> The upstream and downstream monitoring requirements for conductivity and fecal
coliform have been deleted. It has been determined that these sampling
requirements are no longer necessary.
• The monitoring frequency for ammonia has been changed from monthly to
2/month. This change is consistent with the requirements for Class I facilities as
outlined in the North Carolina Administrative Code 2B.0500.
> MBAS monitoring has been included in the draft permit. This limit was
incorporated due to the presence of kitchen waste in the discharge.

If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be in the
form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be
final and binding.
Please note that this permit is not transferable except after notice to the Division.
The Division may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirement to obtain other permits which may
be required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other Federal or Local governmental permit
that may be required.

Summary
Facility has submitted an application for renewal. No modifications were requested in
the permit renewal. It is not known why the Permittee has not been required to perform
an EMo address alternatives to direct surface water discharge.
The facility discharges into a zero flow stream. Therefore, the facility is required to
meet very stringent effluent limits. Several facilities across the state have been faced
with the same problem and have either upgraded the facility to meet the restrictive limits
or moved the discharge location. We understand this is a burden on the facility, but we
need to be consistent across the board. The facility needs to seriously consider
removing the discharge from this unnamed tributary or make required upgrades to meet
the restrictive limits.
Due to the fact that the facility has not identified any alternatives to direct surface water
discharge, the facility will be required to meet 5 and 2 limits. The permit renewal was
drafted with a compliance schedule of three years to meet the revised limits.
The following notes were taken during the review of the application package:
• 303(d) List Review: UT to Reedy Creek (below the Landfill) was listed on
the 1998 303(d) List. This stream was listed as partially supporting. The
problem parameter was not listed. It does not appear that the subject
discharge is located on this portion of the unnamed tributary.
• Review of Basin Plan: No specific information was documented for the
subject watershed.
• Wasteload Allocation (prepared 07/19/94): BOD TSS, pH and fecal limits
were determined to be secondary. DO was limited at 5 mg/1. Oil and Grease
was limited at 30.0 mg/1 (Although this limit was not included in the last
permit renewal). Region, please comment whether or not MBAS monitoring
should be included to cover kitchen waste. Instream monitoring was
recommended for temperature, DO, and fecal coliform and conductivity.
The facility discharges into a stream classified as zero flow (both 7Q10 and
30Q2 are zero). The WLA made no statement recommending that this
discharge should be removed when an alternative becomes available.

The permit renewal was drafted with 5 and 2 limits based on the fact that
they are discharging into a zero flow stream. The current limits will remain
effective the first three years of the renewal. After this time, the 5 and 2
limits will become effective. Region please comment of the time frame
given to comply with the revised limits.
• DMR Review:
Compliance inspection report was prepared on 4-30-98. A review of the self -
monitoring data for the period of April 1997 to February 1998 revealed that
all permitted parameters were within limits, with the exception of one
violation of the monthly average limit for flow in April 1997. No other
violations were noted.
Effluent DO levels for 97 and 98 were above the limit of 5.0 mg/1 (data
ranged from about 5.7 mg/1 to 6.0 mg/1).
BOD levels for 97 and 98 ranged from 1.35 mg/1 to 20.0 mg/1.
Ammonia levels for 97 and 98 ranged from 1.39 mg/1 to 11.6 mg/l.
Effluent TRC levels appear to be high.
Instream monitoring parameters appear to be normal.

The Division is beginning the second five-year cycle of river basin planning and permit renewals. An
examination of the basin planning schedule has revealed that the timing of permit renewals does not
allow an evenly distributed workload as first envisioned. This results in problems with the efficiency
and effectiveness of the NPDES program. In an effort improve customer service, and after thorough
review of the water quality issues in your area, the Division is changing the permit renewal schedule for
all NPDES permits in your sub -basin.
This permit modification changes the expiration date of the subject permit to May 31, 1999. Please find
enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old
page. All other terms and conditions contained in the original permit remain unchanged and in full
effect. This permit modification is issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If you have already submitted a permit renewal application for the subject facility, the Division will
retain the application until your permit is due for renewal. No additional forms or fees will be required.
If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt_of this letter. This request must be a written petition conforming to
Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be final and binding.

'urpose: The facilities listed above all discharge into the Yadkin River basin. Other
ermits in the Yadkin River basin have expiration dates in calendar year 1999. The
acilities listed above have permit expiration dates in 1998. In order for the Division to
.valuate all permit renewal requests in the Yadkin River basin during the same calendar
-ear, the Division plans to extend the expiration dates of the permits for the facilities
istcd above. No conditions in the existing permits will be changed or modified. This is
al administrative change to better align permitting and Basinwide Planning operations
vithin the Division of Water Quality. On the basis of preliminary staff review of Article
!1 Chapter 143, General Statutes of North Carolina (and other lawful standards and
egulations). the North Carolina Environmental Management Commission proposes to
extend the duration of the NPDES permits listed above, subject to specific pollutant
imitations and special conditions.

Dear Permittee:
After a thorough review of the Yadkin -Pee Dee River basin management plan and water quality issues relevant to
the subject facility, the Division of Water Quality has decided to extend the duration of the subject permit. The
expiration date of your permit will be changed in order to allow the Division to review all NPDES discharge
permits in the Yadkin River Basin during calendar year 1999.
All terms and conditions in the existing permit will apply until a new expiration date is assigned by the Division.
Extension of existing Effluent Limitations and Monitoring Requirements does not exempt the subject facility from
the new Enforcement Policy recently enacted by the Division.
Attached to this letter is a copy of the Public Notice that is being published to announce the planned extension of
your permit. After Public Notice has been made by the Division, the expiration date of your permit will be
changed via a permit modification. No draft permit will be sent out with the Public Notice, as none of the
conditions in the existing permit will be modified.
The Division appreciates your patience and understanding to date regarding the rescheduling of the subject
permit. If you have already submitted your renewal application package, no additional fees or documentation will
be required as a result of this change to your permit's expiration date.
