Non-Exempt Facilities and Activities
The following facilities and activities (list may not be exhaustive) are not exempt and must have
CVUA section 402 permit coverage to discharge storm water (if they do not qualify for the
conditional no exposure waiver). These are typically downstream from an oil and gas
exploration, production, processing ortreatment operation, or transmission facility, and they
involve or support the physical and/or chemical transformation of raw materials into final
manufactured products for sale.
• Improvements to public roads for access to projects
• LNG re-gasification terminals
• Conventional petroleum and petrochemical refineries (asdefined in 40 CFR419)
• Fischer-Tropsche "Clean Fuels" synthetic fuel plants
• Ethanol plants
• Oil shale refineries, Cracking Plants
• Natural gas utility or city-owned "end-user" distribution systems connecting industrial.

accepted for the following reason:
Section 402(1)(2) of Clean Water Act(CWA)provides that EPA shall not require, nor force a state to require a
CWA section 402 permit for discharges of stormwater runoff from oil and gas exploration, production,
processing or treatment operations, or transmissions facilities. A NCGO1 permit is NOT required for this
