Attached are modifications that were approved by the Corps. Basically, the applicant was able to significantly reduce
impacts associated with the road crossings within the site. This is reflected in the 404. By copy of this email I am asking
Karen Higgins to verify that the impacts have been reduced.

Please call to discuss the attachments as it will, I think, be easier to discuss this than go back and forth with
emails. Basically, EEP wants to confirm that the phases of mitigation are appropriately calculated so that they can invoice
the applicant.
The first phase of mitigation need is 0.22 acres and 95 linear feet of streams. The Corps can confirm this.
The attachments are a copy of the modification letter and plan sheets that were sent to the Corps and DWQ in late
November 2012 or early December 2012. Also attached is the Corps approval of the impacts dated December 14, 2012,
a copy of which was sent to DWQ.

Please remind me where the 401 stands. I have one from November 2011 that requires a lot more mitigation than this
recent COE revision.
Have you already sent me a 401 revision/modification or other written confirmation that they are approving the
mitigation as stated in the COE permit? An EEP invoice would reflect the highest of whatever the permits require……

Dear Mr. Levinson:
Please reference the Department of the Army permit issued on March 7, 2012, for the
discharge of fill material into waters of the US adjacent to South Prong Anderson Creek, for the
construction of the Anderson Creek South residential development and the associated 31.4 acre
amenity lake. Reference is also made to your letters dated July 25, 2012, September 14, 2012,
and your submittal received November 19, 2012 requesting modifications to the permitted
project.
In your letter you requested modification of the plans to allow additional road crossings to
access high ground within the development {Impacts R-9, R-10, R -I I and R-12) and
modifications to road crossings including the use of wing walls, resulting in an overall decrease
of impacts to jurisdictional waters. The following table includes the impacts authorized in the
original permit, and the proposed new impacts at each location, including the newly proposed
road crossings:

Accordingly, your permit is hereby modified to authorize revised impacts to 298 linear feet
of stream, and 0.71 acre of wetlands for the construction of road crossings and in accordance
with the attached, revised project plazas, dated October 24, 2012. Additionally, please find
attached the modified preservation trap, dated December 5, 2012 that accommodates for the
revised impacts to jurisdictional waters.
You additionally requested that Special Condition (m) be modified to allow you to make in -
lieu -fee payments to the North Carolina Ecosystem Enhancement Program (NCEEP) in stages
prior to beginning construction within jurisdictional areas. In your September 18, 2012 letter
you provided us with a schedule for payment of mitigation and for all corresponding impacts to
occur over four phases, with final mitigation payment to be completed by September 1, 2017.
Accordingly, Special Condition (m) is hereby replaced with the following:
m) In order to compensate for permanent impacts to 2,136 linear feet of stream channel
and 8_9 acres of riparian wetlands, the permittee shall make payment to the North Carolina
Ecosystem Enhancement Program (NCEEP) in the amount determined by the NCEEP,
sufficient to perform the restoration of 1,400 linear feet of stream channel and 8_9 acres of
Riparian, Non-Riverine wetlands (of Headwater habitat type) in the Cape Fear River Basin,
Cataloging Unit 03030004, and in accordance with the below phased mitigation table:

Construction within jurisdictional areas of each phase on the property shall begin only after
the permittee has made full payment to the NCEEP and provided a copy of the payment
documentation to the Corps for impacts authorized in each respective phase, and the
NCEEP has provided written confirmation to the Corps that it agrees to accept responsibility
for the mitigation work required, in compliance with the NCEEP In -Lieu Pee Instrument,
approved by the United States Army Corps of Engineers, Wilmington District on July, 28,
2010."
Additionally, the following permit special condition (t) has been added as follows:
11 Temporary impact_areas should be restored back to pre -construction contours and
in accordance with your temporary impact area restoration plan.
After review of the file and all modification requests we have determined that the proposed
changes to the permit are minor, and that a supplemental public notice is not necessary.
It is understood that all other conditions of the original permit and previous modifications
remain applicable, including the permit expiration date of December 31, 2017. This permit
modification letter does not authorize any additional impacts to wetland or other waters of the
U.S. Any request for new work, including requests for authorized work not completed by the
expiration date of this permit, shall warrant re-evaluation under current regulations and other
program stipulations.
Please also reference the "Permanent Conservation Easement" you provided to us on
December 11, 2012. In the document you have stated that the easement holder would be
Anderson Creek Property Owners Association, Inc. The Corps requires that the conservation
easement be held by an acceptable easement holder; specifically the holder should be either a
recognized conservation organization, or a governmental entity that intends to enforce the conditions
of the conservation easement. As such, please locate an approved easement holder and update the
conservation easement documentation accordingly. You should be aware that condition "n)"
requires that an acceptable conservation easement be executed and recorded in the Harnett
County Register of Deeds prior to beginning any work authorized by the permit.
