The Wilmington Regional Office received the Stormwater Management Permit Application for Waterway Project on May
7, 1998, with final information on November 18, 1998. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW8 980521 dated December 10, 1998, for the construction of the Waterway Project.
This permit shall be effective from the date of issuance until December 10, 2008, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B off North Carolina General Statutes, and filed with the Office
of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall
be final and binding.

construction, operation and maintenance of an extended detention wetland system in compliance with the provisions of 15A
NCAC 2H A 000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until December 10, 2008 and shall be subject to the following
specified conditions and limitations:
L DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 72,669 square
feet of impervious area. This wetland system must be operated with a 50' long vegetated filter.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans.

H. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a.. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
h. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear.
i. Ensure that wetlands plants are not dying. Replant as needed.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the
facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and
other supporting data.
Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
8. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of
the property.
9. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon
area.
10. The runoff from all built -upon area on the project must be directed into the permitted stormwater control system.
11. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the facility.

12. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification to the permit.
13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied
by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have
jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action,. including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of
the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

I. Monthly, or after every runoff producing rainfall event, whichever comes
first:
A. Inspect the vegetative filter; remove accumulated debris, repair if it is
not functioning.
B. Inspect the condition of the emergency spillway and erosion of
downstream bank.
C. Inspect the wetland side slopes; remove trash, and repair eroded areas
before the next rainfall event.
D. Inspect wetland plants to ensure they are not dying and replant as
needed.
II. (quarterly:
A. Inspect the collection system (ie. catch basins, piping, grassed
swales) for proper functioning. Accumulated trash will be cleared
from basin grates, basin bottoms, and piping will be checked for
obstructions and cleared as required.
B. Inspect Wetland inlet pipes for undercutting. Riprap or other energy
dissipation structures shall be replaced, and broken pipes shall be
repaired.
III. Semi-annually:
A. Remove accumulated sediment from the bottom of the outlet
structure.
B. Reseed grassed swales, including the vegetated filter if applicable,
twice a year as necessary.
IV. Annually:
A. Check wetland and forebay depth at various points. Sediment
removal is required when the forebay depth is reduced to 2'. Design
depth of the forebay is 3'. Sediment must be removed to at least the
original design depth. Sediment shall be removed from wetlands in
order to maintain design depths as needed.
B. Wetland should be inspected after a rain event to ensure that the
basin is operating as designed.
IV. General:
A. Mow side slopes will according to the season. Maximum grass height
shall be 6".
B. Keep all components of the extended detention wetland system in
good working order. Repair or replacement components shall meet
the original design specifications as per the approved stormwater
plan. If previously approved components are determined to be
ineffective, the component must be redesigned and/or replaced.

Trail Corporation is the financially responsible party for maintenance of this
extended detention wetland. Sea Trail Corporation will be responsible for the
performance of the maintenance as outlined above, as part of the Stormwater

ATTACHMENT A
1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
I. No more than N A square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size and the allowable built -upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be
recorded:
3. The connection from the outparceI or future area into the stormwater system must be made into the
forebay such that short-circuiting of the system does not occur.
4. All built -upon area from the outparcel or future development must be directed into the permitted
stormwater control system.

This letter is in response to your application request under the Coastal Area
Management Act (CAMA) to to construct a residential development on your property
in the Town of Sunset Beach, Brunswick County. Processing of the permit
application, which was received by the Division of Coastal Management's Wilmington
office on June 26, 1998 is nearing completion. However, it has been determined that
additional information will be required prior to the Division taking final action on your
application. This additional item is summarized below:
1) It is the policy of this Division that, prior to taking final action on a project of
this nature, a stormwater management plan for the proposed development must
be approved by the Division of Water Quality. It is our understanding that this
approval has not yet been received for this project . Therefore, it is necessary
that processing of your permit application be placed in abeyance until such
time as a stormwater management plan certification for the proposed project is
issued by the Division of Water Quality, and a copy of the approval supplied to
this office.

The incoming runoff from Forebays 2 and 3 will never benefit from treatment in the 18" wetland area.
It should be set up so that all the runoff enters at Forebay ##1 and is allowed to receive treatment from
all the wetland areas. The other alternative is to provide additonal deeper wetland areas that the runoff
from Forebays 2 and 3 can be treated in.
2, The surface area of the micropool needs to be 15 % of the permanent pool, or 1,148 square feet. You
provide only 730 square feet. Please revise.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to November 24, 1998, or the application will be returned as
incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. The

In response to your letter dated June 24, 1998 we offer the following:
1. Additional spot elevations for the parking areas have been added to the
revised plans.
2. Finished floor elevations have been added to the revised plans.
3. A typical building footprint has been enclosed.
4. Wetlands were delineated by Land Management, Inc. and survey
information was provided by Norris and Ward Land Surveyors, P.A. A
note to that effect has been added to the plans.
5. Dimensions have been added to the parking areas, drives, and sidewalks.
6. The Operation and Maintenance plan has been revised to include
inspection of plants and sediment removal within the wetland areas as
requested.
7. An outlet structure has been added to provide the required 2-5 day
drawdown.
8. Calculations indicating the required wetland percentages have been added
to the design calculations.
9. A planting table listing species and location is on Sheet 4 along with a
note requiring the landscape contractor to submit a planting plan for
approval. As discussed during our June 29, 1998 conversation.

Dear Mr. Houston:
The Wilmington Regional Office received a Stormwater Management Permit Application for Sea Trail
Plantation -Waterway Project on May 7, 1998. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
1. Please provide additional spot elevations for the parking areas. The contours do not convey
enough grading information, especially in the corners of parking areas, and on sidewalks.
2. Provide finished floor elevations for the buildings.
3. Provide a typical unit footprint of the building, with dimensions, and any wood deck or
concrete areas noted.
4. Delineate all existing wetlands on site, or note on the plans that none exist.
5. Provide dimensions for the parking areas, drives and walks.
6. The Operation and Maintenance plan does not address the following:
a. Inspecting the plants to make sure they are not dying, and replanting as needed.
b. Sediment removal within the wetland areas. (Only the forebay is addressed)
7. Provide an outlet structure to provide the required 2-5 day drawdown. No outlet structure is
located or detailed on the plans.

8. Provide calculations indicating compliance with the requirements to allocate the surface area
of the wetland system. Seventy percent of the provided surface area must be from 0"-18"
deep. This is further broken down in the BMP document to require half of that 70 % (35 %)
from 0"-9", and the other half from 9"-18" deep. Also, 15 % of the area must be available at
the outlet location as a deeper micropool. The proposed plans show no wetland area shallower
than 12" . The basic intent of a stormwater wetland is to create a shallow matrix of sediment,
plants, water and detritus that collectively removes multiple pollutants through a series of
complementary physical, chemical and biological pathways.
9. Provide a planting plan listing the species of plants to be used, how many will be used, and
where within the wetland they will be planted.
10. Ideally, the drainage area for a constructed stormwater wetland should not be less than 10
acres. The BMP guidance suggests that smaller watersheds tend to dry out more often, and
become nuisances.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to July 23, 1998, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

On behalf of Sea Trail Corporation, we are pleased to submit for your
review and approval two copies each of the Stormwater Plans, the hydrologic
and hydraulic calculations and the executed Permit Application forms.
As discussed between Scott Quaintance and yourself, this project drains
to SA waters, the Intercoastal Waterway. Due to a high water table,
infiltration is not an option for this project. Therefore, we have designed an
alternative solution using the Extended Detention Wetlands described in the
BMP manual.
The proposed subject project falls within the high density guidelines.
Enclosed is a check in the amount of $385.00 to cover the required high
density application fee.
