David Smith Commissioner and Consumer Services Chief Deputy Commissioner March 2, 2022 Stephanie Goss Division of Water Resources 3800 Barrett Drive 1628 Mail Service Center Raleigh, NC 27699 Reference: NOV-2021-PC-0538 Dear Ms. Goss: In response to the Notice of Violation -Notice of Intent to Enforce dated 1/26/22 for DWR Project #20201897, the developer of the onsite improvements, Athens Development Partners, LLC, provided the following information detailing their activities: #1 Riparian Buffer (Sediment Imnacts)- All foreign sediment has been removed from the riparian buffer area down to native soil. All areas landward of the 50-foot buffer have been stabilized and reseeded utilizing a riparian seed mix. #2. Stream Restoration Plans (Sediment Impacts) - All foreign sediment has been removed from the stream bed down to native soil. Removed sediment has been secured as required in this Notice of Violation. #3. Erosion Control: Additional erosion control measures were established once the restoration process was complete. This included extending and deepening the diversion ditches along the perimeter of the gravel lot to deter any future waterflow and/or sediment from the stream area. We [Athens Development Partners, LLC] also removed all sediment from the permanent storm water management system around the property to help direct future waterflow to the sediment basin. #4. Plan and Schedule: All stream restoration activities were performed between 10/20/21 thru 10/29/21. An inspection was performed by Division of Water Resources on November 30, 2021, after the stream was restored to original condition.
