On February 10, 2022, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR), conducted a site inspection for the American Phoenix, Inc. facility located at 318 Blount Street,
Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Ms. Rocky
Carr, Plant Manager, was present during the inspection and her time and assistance is greatly appreciated. The site visit
and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCGO50000 under
Certificate of Coverage NCGO50444. Permit coverage authorizes the discharge of stormwater from the facility to receiving
waters designated as Blounts Creek class C waters in the Cape Fear River Basin.
As a result of the site inspection, the following deficiency is noted:
The Stormwater Pollution Prevention Plan has not been fully implemented per the conditions of General Permit
NCG050000.

Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
Requested Response
A written response is not requested at this time.
Action Items
Immediately review and amend the facility's SPPP as needed and begin incorporating documentation pertaining to the
annual update requirements of the permit.
Thank you for your attention to this matter. This office requires that the deficiency, as noted above and detailed in the
enclosed inspection report, be properly resolved. Failure to address the deficiency could result in the issuance of
a Notice of Violation,which is subject to a civil penalty assessment of up to$25,000 per day for each violation.

Inspection Summary:
Melissa Joyner met with Ms. Rocky Carr, Plant Manager,at the American Phoenix, Inc.facility. She reviewed the
Stormwater Pollution Prevention Plan (SPPP). It was orderly and contained the majority of the required information per the
conditions of General Permit NCG050000.At the time of the inspection the following information needed to be included in
the SPPP.:t.The site map showing the topography and the percentage of each drainage area which is impervious.; 2.
Documentation of the annual employee training.; 3. On the Spill Prevention and Response Procedures (SPRP)a list of
personnel,with dated signatures who is responsible for implementing the SPRP.The Qualitative Monitoring records were
reviewed with no issues noted. The facility grounds, including the outfall and Best Management Practices were inspected.
All appeared well-maintained.
