DANIEL SMITH Director Certified Mail # 7020 3160 0001 6632 2157 Return Receipt Requested James Duncan, Town Manager Town of Robersonville PO Box 487 Robersonville, NC 27871-0487 NORTH CAROLINA Environmental Quality February 17, 2022 SUBJECT: Establishing a Pretreatment Program Permit No. NC0026042 Robersonville WWTP Martin County Dear Mr. Duncan: Over the previous twelve months several Notice of Violations and Civil Penalty Assessments have been issued to Robersonville WWTP for NPDES limit violations. On February 8, 2022 during the wastewater treatment plant inspection a review of the sample results taken by Flagstone Foods on November 24, 2021 revealed high concentrations of multiple parameters being discharged to Robersonville's Wastewater Treatment Plant. NPDES Permit Standard Conditions state: PART IV SPECIAL CONDITIONS FOR MUNICIPAL FACILITIES: "Significant Industrial User" or "SIU" An Industrial User that discharges wastewater into a publicly owned treatment works and that [15A NCAC 02H .0903(b)(33)]: 2. Contributes process wastewater which makes up five percent or more of the NPDES or non -discharge permitted flow limit or organic capacity of the POTW treatment plant. In this context, organic capacity refers to BOD, TSS and ammonia; or 4. Is designated as such by the Permittee on the basis that the Industrial User has a reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, or the POTW's effluent limitations and conditions in its NPDES or non -discharge permit, or to limit the POTW's sludge disposal options; With high concentrations of pollutants from the discharge of Flagstone Foods and NPDES permit effluent violations occurring at the Wastewater Treatment Plant, the Town of Robersonville must start a Pretreatment Program to give more oversite of the Town's Industries. Within Ninety (90) days from receipt of this letter the Town of Robersonville needs to submit a timeline of how the Town plans to move forward with establishing a Pretreatment Program.
