SUBJECT: Permit application for: Bowlin stream mitigation site, stream bank stabilization
and habitat improvement, Peak Creek, Ashe County, North Carolina.
The North Carolina Wildlife Resources Commission is resubmitting the enclosed plan for 2,747
linear feet (1,907 if along both banks and 840 if on the left bank) of stream enhancement on Peak
Creek, Ashe County for your approval fora 401/404 permit (Nationwide Permit number 27,
NCDWQ # 3399). The plan was originally submitted for review in May, 2003 to the NCDWQ
and the USACE to help meet mitigation requirements associated with the US 421 NCDOT
Project R-529, Watauga County project. The plan was permitted under the USACE permit for
the US 421 project (USACE action ID No. 19970761). The NCDWQ approved the plan for 401
Water Quality Certification on May 29, 2003 (DWQ Permit No. 030599). Enhancement work
was delayed because of issues in obtaining the conservation easement. The 401 permit was re-
issued on August 15, 2006. The USACE permit was not re-issued and therefore both permits
expired. The conservation easement has been obtained and we are ready to proceed with the
project.
The enclosed plan (7 copies for NCDWQ) is the same as the one submitted in May 2003 with
one minor change. The stream from station 7+00 to station 8+00 has migrated approximately 15
feet down valley. We are proposing to move the stream back to its original location and use rock
vane/weirs for bank stability and grade control. Both Monte Mathews (USACE) and Sue
Homewood (NCDWQ Winston Salem office) indicated this was a minor change and should not
require additional information (personal conversation May 2007).
The site will be monitored for five years using North Carolina Ecosystem Enhancement
Program's (NCEEP) monitoring protocols that meet the interagency Stream Mitigation
Guidelines, 2003, USACOE, USEPA, NCWRC, NCDENR-DWQ.

Other stream enhancement activities include changes in dimension and profile, in-stream habitat
improvement structures, vegetation planting in the riparian buffer, and fencing for livestock
exclusion. The site is in a 3.05 acre conservation easement to ensure long term protection. The
plan view map has been updated (see enclosed erosion and sediment control plan view map).
Once the project is completed, as-built plans along with a copy of the recorded conservation
easement will be submitted to NCDWQ, USACE, and NCEEP.
The $475 Pre-Construction Notification Application fee required by NCDWQ has been
electronically transferred (electronic warrant # 24583). The email notification for the transfer is
enclosed. Also enclosed find the erosion and sediment control plan view map, approved
sediment and erosion control plan, Agent Authorization letter, May 29, 2003 NCDWQ permit
approval letter, August 15, 2006 NCDWQ permit re-issue letter, Apri120, 1998 NCDWQ
certification letter for the US 421 project, list of Project Review Team members, and NCEEP
authorization letter.
Copies of the plan have been submitted to the NCWRC and U.S fish and Wildlife Service for
their review. The NCWRC's email supporting the project is enclosed. We plan to receive
USFWS's comments this week and will be forward to you.
