Subject: Response to Comments ABTco, Incorporated NPDES Permit No. NC0005266 Wilkes County The Division of Environmental Management has reviewed your letter dated December 15, 1995 requesting that the Division revisit the total suspended solids (TSS) limit in the current permit. As you may recall, the TSS limits in the current permit were the result of the settlement of the Contested Case filed November 11, 1994. After several negotiation meetings, ABTco's subsequent Notice of Withdrawal March 23, 1995 indicated that the modified permit was acceptable. The permit was then issued with the agreed upon modifications. The revised permit was based on ABTco's concern about their ability to meet the potential settleable solids limit proposed in the original draft permit (established in accordance with 15A NCAC 4B .0406(d)). The compromise reached between DEM and ABTco was the reduction in TSS to 12,000 lbs/day monthly average and 18,000 lbs/day daily maximum by January 1, 1997. ABTco now contends that this value, which the company originally proposed, cannot feasibly be met without great capital and operational expenditures. ABTco also contends that the biological study was ambiguous and does not show that the company had an impact on the receiving stream. The company, therefore, has proposed a revised TSS limit of 22,000 lbs/day monthly average and 33,000 lbs/day daily maximum for DEM's consideration. The biological assessment was reviewed again to clarify any ambiguities. The assessment was re-evaluated using current identification manuals and classification criteria that were not available at the time the survey was conducted in 1993. Even under this reassessment, the classification indicated an impact downstream from the ABTco discharge. The sample upstream of ABTco was rated as "GOOD", while the downstream site was rated as "GOOD/FAIR". In addition, ABTco should be aware that the current requested TSS limits (22,000 Ibs/day monthly avg; 33,000 lbs/day daily max.) are higher than the TSS limits in the permit at the time the biological assessment was conducted. The TSS limits at that time were 21,169 lbs/day and 31,097 lbs/day monthly average and daily maximum, respectively. It is the Division's understanding that in December 1995 ABTco installed the in -line grinder which.was approved by the Authorization to Construct permit issued April 24, 1995. Not enough information exists to evaluate the performance and benefits of this modification. Moreover, the adjustment of the wastewater treatment plant operation from extended aeration mode to conventional activated sludge mode may take several months to evaluate. The wastewater treatment plant will need this time period to stabilize and adjust to the reduced mixed liquor suspended solids and mean cell residence time. P.O. However, the Division will offer ABTco the following: (1) The option to provide a four month extension on the dates specified in the current permit. This may be done through a minor modification of the permit. This would provide ABTco until May 1, 1996 to meet the interim 14,000 lbs/day monthly average and 21,000 lbs/day daily maximum TSS limits. This modification would also change the January 1, 1997 compliance dates to May 1, 1997. To pursue this option ABTco must submit a written request for extension of the schedule and a $100.00 modification fee. (2) The option to apply for a Special Order by Consent (SOC). With an SOC agreement, ABTco could obtain a more lenient TSS compliance limit for a specified period of time. During the life of the SOC ABTco would be required to continue efforts to reduce the TSS values. At the end of the SOC, ABTco would be required to meet the TSS limits specified- in the permit. If ABTco decides to pursue this option, an SOC application and fee must be submitted.
